The Public Works Coordinator has been asked to review the need to designate utility and drainage easements to the City. Staff recommends approval subject to review by the Public Works Coordinator and subject to review by the City Engineer. The City has a conservation and f lowage easement over the wetlands area designated at the 1032 elevation. It would appear after our rainy summer that the 1032 elevation did not adequately define the retention area. The house is now 15 feet from the newly defined perimeter of the wetland instead of 26*+ as approved. The wetland is a grassed area that contains water only at wet times of the year and based on the soils make up has moderate to^ slow permeability. The outlet of the wetlands is at the culvert^in the southwest corner of the lot. Such a wetlands has high assimilative capacity. As the City Engineer suggests the 8,000 sf of open water area should be replaced with an additional grassy drainage area southward to the culvert. I have no information as to the size of the watershed area and the retention capacity of the area after #2 back to back 100 year storms. During the review of the Raster application eary this summer, the Council considered the many conflicts in the reports presented by the various reviewing agencies and the traditional position of the City regarding the alteration of designated wetlands. Council decided there was no need to change the ordinance but merely to set up criteria for such reviews and that if specific findings could be made, the alteration of the wetland would be considered. Review Criteria 1.Disposal of soils: Soils excavated from wetland could not be used to grade and fill banks of pond but had to be placed a minimum of 50 feet away from pond/wetland basin and hay bales staked around the spoils area. 2.Time of year alteration is performed: Suction dredging remains the best method but not always feasible. Early winter is the best time to dredge wetlands. In this application given the type of soils make up, early winter may be a must. 3.Location of dredged area within wetlands: Vegetation must not be disturbed between pond and outlet from wetland. Vegetation must remain to catch or filter sediment and slow down rate of flow. In this case, the grassy area at the 1032 elevation leading to culvert will serve as buffer—Conservation and Flowage easement should be amended to include newly defined protected area. 4.Replacement Factor - If the reviewing staff confirms reduction in assimilative capacity of wetland created by alteration than a matching area must be set aside to replace assimilative capacity. The extension of the protected wetland area south to the culvert providing additional grassy, permeable surface will provide replacement but adequacy of that replacement should be confirmed by hydraulic information. Staff Recommendation To approve the partial alteration of the designated wetlands on Lot 2, Willow Run based on the following findings: 1. The wetlands functions as a localized, seasonal collection basin and is not part of a major wetlands system. 2. Wetland is located in the outer edges of the watershed leading to Lake Minnetonka. 3. The water table was determined to be approximately at elevation 1030.5. This elevation is about 1.5 feet below the existing grade in the vicinity of the proposed pond on Lot 2, and 2.5 feet below the existing grade in the vicinity of the pro­ posed pond on Lot 3. RECOMMENDATIONS It has been proposed that one pond be excavated on each lot (see the pond location plan Figure 2). The ponds will enhance the aesthetic value of the property; however the benefits for wxldlife habitat is somewhat limited. Among the reasons for this is the close proximity of the ponds to the single family dwellings as well as the absence of proper vegetative cover for wildlife nesting and brooding areas surrounding the ponds. The ponds themselves should not exceed 8000 square feet in area at the t-r p* ^ meandering shaped pond of approximately 50 to 60 feet wide and 100 to 120 feet in length is recommended. The min­ imum excavated depth should be approximately 3-1/2 feet and the max­ imum excavated depth should not exceed 5 feet. Assuming an average excavated area of 5000 square feet and an average depth of 4.5 feet amounts to nearly 835 cubic yard*: per pond. If the excavated soil is not utilized as fill material elsewhere, it should be leveled adjacent to the pond to a maximum depth of 2 feet. . As discussed earlier, the excavated soil consists of silty clay. The characteristics of this soil is that it is very sticky and soft when wet, hard and difficult to mold when dry. It is a most difficult soil to handle by mechanical means, especially hand tools and small scale equipment. Due to the wet soil conditions and V V." im ..f ‘■■f-r!Am the large amount to be excavated, it is suggested that the ponds be dug out with either a dragline or 2 to 3 yard backhoe on tracks. Generally, ponds are constructed to provide water for live­ stock, fish and wildlife, recreation, fire control, or aesthetic related uses. The unfortunate feature of a pond is that it is a body of water in which drowning can occur. Brownings are the outstanding non-motor-vehicle cause of accidential deaths among people in active age groups, especially children. Some Safety Recommendations Are: 1. Post warning signs near each pond. These signs should be adjacent to each pond telling all who come near what the extreme depth of the pond is. The pond should be constructed with 4:1 side slopes on the uppermost portion of the pond, as illustrated on Fig ure 4. This flatter slope will reduce the chances of someone accidently slipping into the pond. Since this is predominantly a residential area, it is suggested that a low fence be installed around each pond, thus reducing the chances of unsupervised toddlers from accidently wandering into the ponds. These recommendations may not completely satisfy the requir- ments of local laws. EVERY POND OWNER SHOULD CONSEL with an attorney to determine: - his liability in case of serious accident or death at his pond. - legal requirements pertaining to precautions and safety at ponds. The privilege of having a pond on his property give the owner additional responsibilities. POSTING THE POND AGAINST TRESPASSERS DOES NOT RELIEVE THE OWNER OF THESE RESPONSIBILITIES. The house is the main structure on an 82.5 acre parcel used mainly for pasture. This house is 600' from the nearest lot line. A second house exists on the property near Watertown Road and has been historically a caretaker and/or rental house. This second house has its own well and septic system, and could be divided off from the rest of the property with no problems. The proposed guest unit in the main house should not have an appreciable effect on the septic system. The existing septic system should be inspected to ensure it is functioning correctly. The standards set forth by the ordinance for "Caretaker Apartments" require additional area to support an additional residential unit. This 82 acre parcel certainly meets this standard. The OHM of the northern wetland has been designated at 927' elevation the plan must designate the area to be excavated, the amount of spoils to be removed and the slope ratio of the banks. A short synopsis of this project follows: The City issued a 101.4 feet of rip-rapping 1983^ TheDredaina Company for this address on September 22, 1983. ine application noted only 30* would be rip rapped at this time, no time frame stated for completion of the rest. Early this summer staff was notified by a Planning the aooarent violations of tree cutting within 75* of the laxe ana construction otretaining walls. Staff • s subsequent investigation revealed 2-24"+ stumps which appeared to be y5-2" cut must have been dead trees. No stumps greater than 1/2 2 diameter were apparent on the slope. Thelarger trees were cut and stumps removed at the crest of the hill. Tne ownir states that only small brush was removed from the J to "see what was there". As of today there appears to be roughly 50 percent cover again established over the slope. There is no evidence of erosion of the slope occurring. Retaining walls ("planters") and steps had also been constructed. I measured the slope at about 70 percent (19* of drop in a 28* run) which without some stabilization seems quite precarious. The submitted plans do not indicate the depth of the walls or how they are anchored into the hillside. The applicant has give me the impression that these walls are for aesthetic purposes and to help stabilize the stairway and not necessarily the hill. The planter terraces may have some benefit in slowing runoff which otherwise would run right down the hill. On the other handr will retention and absorption of this runoff in^ the planter boxes cause saturation of the slope and possible sliding? The City Engineer has reviewed the plan presented and recommends^ that the owner substantiate the stability of the slope by submitting a report and recommendation from a qualified soils engineer. The rip-rapping done in 1983 appears to have been necessary to stop erosion and undercutting of the banks. Approximately 30* of rip—rap was done, but the remainder appears to be needed as soon as possible. Staff recommends that the applicant be required to submit the bank stability information as recommended by the Engineer. Your recommendation for approval or denial could be conditional on staff review of this information, or you could table the application. That, at least, is how Bruce and Sharmainejohanson of White Bear Lake approached today ’s housing conundrum. To be sure, the Johaasons began their pursuit of a house with stronger pre­ conceptions about design than most first-time buwrs. A N’ear of reading about housing led them' to A Pattern Lan­ guage, a book by the architeaural the­ orist Christopher Alexander. The book, the second volume of a series by Alex ­ ander (see related article for pre-pub­ lication excerpts from his volume 77je Production of Houses ) provides a lan ­ guage” for planning and building. Choos ­ ing that pattern determines the central place of the kitchen in the house as a whole. . The patterns —253 in all—can be combined to form infinitely different but equallv meaningful entities, just as words are used to create sentences. What A Pattern Language does is de- mN-stifi' the steps architects go through; it makes the process of design acces­ sible to laymen. And that, indeed, is precisely what the lohansons wanted—to be involved in the design of their owti house. Firmlv committed to Alexander s pattern language, the Johansons faced the next challenge; how to find an ar- chitea who could help them apply Alexander ’s approach as the\' built their own house. The>’ proceeded most straightfor- w’ardly. They called architeaural firms and a^ed if they knew of A Pattern Language. Failing to find any that did, the>’ contaaed Alexander ’s Center for Environmental Struaure in Berkeley, California and asked for advice. Sara Ishikawa, a colleague of Alexander ^ recommended Dale Mulfinger and Sarah Susanka, Twin Cities architects she had met at a conference. The Johansons took the advice and found in Mulfinger and Susanka two young architects who not only kne^' Alexander ’s approach but were enthu­ siastic about applying it to an aaual design process. Susanka had been thoroughly steep>ed in the principles of A Pattern Language in architecture school at the Universitt' of Oregon and had applied those principles in her early design projects. Mulfinger had used Alexander ’s work in teaching architec ­ ture. The Johanson house presented the first opportunity for the two of them to "do a pattern house ” together. By the time the Johansons met wim the architects, they had a long want list devised from their study of the book. "We spent an entire day together and developed the design from the inside out,” says Susanka.
