John Guthrie arrived at 7:55 p.m. Chaiiwoman Dunlap announced that this was the time and place for a Public Hearing on the proposed land donation of Bruce Dayton located at 475 East Long Lake Road. The Zoning Administrator presented the Notice of Public Hearing and the Affadavit of Publication. Bruce Dayton was present. He stated he would like to give this property to Orono. He has lived in Orono for the past 25 years and has enjoyed the area. ^Vhen he first purchased this property it was a resort. His main objective was to clean up the area. Now he would like this to be opened up for public use. Mr. Dayton stated that Herbert Peterson, the adjoimng property owner to the west, had future plans for donating some of his land to the City of Long Lake. David Pagel, a nearby property owner, wanted to know to \diat extent this park land would be developed. He was con cern^ about the possible increase in traffic at the inter section of East Long Lake Road and Old Long Lake Road. Hank Muhich infoimed him that the City had no immediate plans for this area and wanted to keep this as a low profile use. He then introduced Walt Lathrop, Chaiiman of the Park Conmission, and requested his input regarding future plans for this park land. Mr. Lathrop infoimed everyone in attendance that this park land was basically intended for Orono area residents. Some of the things that were being considered were parking by permit only, closing up of area at approximately 9:30 or so by tlie police, and fencing the land to allow more control. Mr. Dayton felt that it would be unfortunate to restrict this area to Orcmo area residents only. Marjorie Boshane expressed her concern for the need of restrooms and lighting in this area. A large number of residents have been using the swimning beach. An increase in this number would require the use of restroom and lifting facilities. Bert Gallistel was also present and expressed his appreciation to Bnice Dayton for thi; generous <;ift. He felt that park property is getting scarce and Orono should take advantage of this offer. After all the public were heard, the Public Hearing was closed at 8:07 p.m. Guthrie moved, Hannah seconded, to accept this offer and express appreciation for same. Motion - Ayes (5), Nays (0). ATIENDANCE - 7:55 P.M. PUBLIC HEARING - 7:55 P.M. BRUCE DAYTON LAND OFFER EAST LONG LAKE RCVkD (#193) I4INUTES OF A PLANNING CatflSSION MEETING HELD NOVEMBER 15, 1976 - PAGE 2Qiairwomaai Dunlap announced that this Was the tijne and place for a public hearing oh the NaVarre Area Rezoning. The Zoning Administrator presented a copy of the Notice of Public Hearing. The Zoning Administrator stated tliat the area of concern is property south of the County property between County Road 15 and 19 and the 2 lots north of #15 and east of Blaine. *niis urea would be rezoned from present LR-lC-1 (residentialj to B-5 (Limited Neighboihood Business District). Hank Muhi(± pointed out this proposed rezoning to those in attendance. The following came forward to identify themselves: Conrad Schimmelpfennig, Clifford Klapotz and Bert Gallistel. They were interested in knowing vdiat some of the proposed uses would be. Chair- worn^ Dunlap then informed them that uses such as municipal buildings, offices, clinics, locksmiths, hobby shop, jewelry store, library, record shop, pet shop, etc. would be permitted. After all the public were heard, the public hearing was closed at 8:15 p.m. Those people vho were at this meeting did not express any objection to this rezoning. The Zoning Administrator informed those in attendance that this B-5 zone would have to be established before proceeding with the Navarre rezoning. At the present time, there are no plans for any proposed building. Woolley moved, Guthrie seconded, that the new B-5 zone be granted and subject property be designated as B-5. Also recommended adoption of zoning ordinance amendment. Motion - Ayes (5), Nays (0). NAVARRE AREA REZONING 6 ORDINANCE AMENEMENT (#193) The Zoning Administrator informed the C miission that no new material had been submitted. However, the new owner of this property, Jim DeSplinter, was present and submitted his proposed plans. After reviewing these plans, it was discovered that all the necessary data was not included. The Zoning Administrator informed the new applicant that it would be necessary to meet with him to discuss this proposal in order to meet the requirements. Hannah moved, Guthrie seconded, to table this application until the Zoning Administrator has a chance to review. Motion - Ayes (5), Nays (0). ROBERT JOHNSON 1121 ELMI^D AVENUE VARIANCE - LOT AREA § WIDIH (#164) The Zoning Administrator informed the Commission that he did not have all the material requested. He did have a conversation with the flood plain people and Hainepin County Conservation District will outline wetlands area for us. Mr. Muhich informed the Commission that in talking with the flood plain people, they told him that the flood plain had no bearing on the subdivision. Their only concem was insurance which would be increased in a flood plain area. Guthrie moved, Hannah seconded, to table this mat" r until all additional material is conplete. Motion - Ayes (5), Nays (0). STEVE IVALUCK (T.M.G.) (Continued) #188 Mr. Solie was present and submitted a letter from the Pollution Control Agency. Chairwoman Dunlap read this letter which, in effect, stated that they were not opposed to the use of creosote ties and felt the ties would not have a si^ificant impact on the surface runoff. Mr. Solie also mentioned that the MOVD had mentioned that these ties were non-polluting. The Planning Commission was concerned about this as it has been their understanding that creosote ties were polluting. In the past six months, many applications requesting the use of these ties have been turned down. After a short discission, the Planning Commission felt they needed more time to obtain additional information. Hannah moved, Guthrie seconded, to table this application in order to receive documentation from the engineer regarding the amount of creosote in the logs and the uipact this would have on Lake Minnetonka and any other documentation that is appropriate and- make a decision at that time. Motion - Ayes (5), Nays (0). The Zoning Administrator stated that the applicant is requesting a variance for the proposed addition to the existing dwelling. The location does not appear to conflict with any neighbor’s view of the lake. There is no other land available and addition would be an in^rovement to the property. Hannah moved, Woolley seconded, that this variance be approved given the fact of the confi^ration of the lot, does not interfere with neighbo'^'s view of lake and no other land is available. Motion - Ayes (5), Nays (0). ROBERT SOLIE 1085 NORTH ARM DRIVE CONDITIONAL USE PERMIT GRADING AND FILLING (#190) DAVID BUTLER 4685 NORTH SHORE DRIVE VARIANCE - LOT AREA § LOT WIDTH (#194) The Zoning Administrator informed the Planning Comnission that the applicant had telephoned earlier explaining that he could not attend the meeting until 10:00. Mr. Ortenblad is requesting variances for construction of a new dwelling on this lot. Two concerned neighbors were present and the Planning Commission heard their comments at this time. Audrey Santella, neighbor to the south, objected to the proposed location of this hoase vdiich would extend closer to the lake than her home and felt would obstruct their view. City Ordinance states that houses should be in line and her feeling was that this should be followed. Ron Grundeen, neig^ibor to the north, was not concerned about the side yard setback. However, he did object to the proposed location which would extend 15-20' closer to the lake than his home. After their comments were heard. Chairwoman Dunlap stated that this matter would be continued later in the meeting ahd that Mr. Ortenblad would be ihformed of these concerns. WARREN ORTENBLAD (Continued) #195) r Noim Kuglin, son of the applicant, was present. The Zoning Administrator stated that the applicant is requesting approval to add a garage to the existing non-conforming lot. The cars, etc. that he io currently storing outdoors would now be enclosed. Per my suggestion, he has agreed to maintain an Sij' side yard setback, a 10' setback from his house and a 22' setback from his property line along Olive Avenue. Proposed garage would be 22' x 22'. If proposed location would be changed to meet side yard setback, the rear entrance to house would be obstructed. Woolley moved, Guthrie seconded, to approve variances so as not to obstruct the house entry and no other land is available. Motion - Ayes (5), Nays (0). EDIVIN KUGLIN 2314 SHADYWOOD ROAD VARIANCE - ADD GARAGE TO NON-CONFORMING LOT AND SIDE YARD ^ STREET SETBACK (#196) Mr. Jenson was present. He is requesting approval for an addition to their non-confoiming structure which does not meet the front and side yard setback requirement. The proposed addition would have no affect on the front yard setback; however, the same 2.8' side yard setback would be maintained. Hank Muhich stated that the unimproved platted alley between subject property and neighbor to the north would tend to provide the necessary distance between structures. The addition would be an improvement to the property. No other land is available for expansion. T\vo lots are ccmibined. CURT JENSON 2700 ETHEL AVENUE VARIANCE - LOT AREA § SIDE YARD SETBACK FOR ADDITION TO NON-CONFORMING LOT (#197) Hannah movedMcDonald seconded, to approve because of the nature of the lot, no other land is available, platted alley provides necessary distance between structures, no additional encroachment as proposed addition would only be a continuation of existing house lines. Motion - Ayes (5), Nays (0). The Planning Ccxnmission took action on the following Work Session items. The Zoning Administrator stated that the Mondale's are requesting approval to add a 24' x 30' attached garage to their existing dwelling. The present tuck-under garage would be used as a recreation room. There would be no change in access. All setback requirements would be met. There is no way to expand lot. Guthrie moved, Hannah seconded, to recommend approval as no othei land is available and all setback requirements v;ill be met. Nfotion - Ayes (5), Nays (0). GARY F. VICTORIA GRAIN CaiPAI'JY (BRAUER 6 ASSOCIATES) NORTH ARM DRIVE SUBDIVISION (PRELIMINARY) (#200) The Planning Commission requested staff to obtain the dimensions of present building and total amount of useable sq. ft. to be presented at the next meeting. JA^ES McCLEARY 3445 BAYSIDE ROAD CONDITIONAL USE PERMIT (#201) 5 ORMING Mr, Keaveny was present. He will be moving his drug store into the old Super Valu building. He is requesting approval to use the existing sign which is O' from the front property line and 8' larger than peimitted by our ordinance. He has agreed to remove the 64 sq. ft. lower area and use only the 108 sq. ft. at the top which is within 8' of the 100' per mitted size. The Planning Commission was concerned about the stone planter in the parking lot. They felt that this stone planter should be removed. The Zoning Administrator infoimed the Planning Ccsranission that the Public Works Department has considered removing this planter because of obstruction to the walking traffic. Mr. Keaveny stated that he would agree to remove the planter as soon as possible. V/oolley moved, Hannah seconded, to approve the area variance of 8 sq. ft. and setback variance of 10' on the basis that Mr. Keaveny remove the stone planter at his earliest convenience. Motion - Ayes (5), Nays (0). The Planning Commission suggested that the Public Works Department continue previous investigation for removal of stone planter and possible erection of transit shelter for that same location. RICHARD KEAVENY 3425 SHORELINE DRIVE VARIANCE - FRONT SETBACK SIGN LOCATION (#204) Applicant arrived at 10:10 p.m. The Planning Commission continued discussion of this application. Mr. Ortenblad was informed of the concerns of the adjoining neiglibors. Neighbors were still present at this time. A lengthy discussion followed concerning the proposed location of the house. The Planning Commission was also concerned about granting tlie 4' side yard setback variance. They felt a dwelling could be designed to fit on this lot and meet the required 10' side setback. Mr. Ortenblad would like to use his present plans to build this house and was reluctant to submit an alternative plan. Woolley moved, Hannah seconded, to table this matter and suggest he suomit revised plans showing the front of the house no further ahead than the average setback of the homes on either side and that the side yard setback be 10'. Haiik Muhich pointed out the colored areas on the map of Navarre to be considered for rezoning. The red colored areas would be rezoned from present zoning classification to B-5, and the yellow and blue areas adjoining the present Keveany and Super Valu stores would be rezoned from B-1 to LR-IB and LR-lC-1. After a short discussion, Guthrie moved, Hannah seconded, to recommend to Council that all these areas be rezoned as shown on the map with the exception of the Texaco Station. Motion - Ayes (5), Nays (0). Member Guthrie reported that the conprehensive sewer plan has been reviewed by the Planning Commission and Council. A preliminary draft is being submitted to the Metro Council. After brief review, it was discovered that all detailed data as requested was not noted on plans. Planning Comnission requested necessary data. Tabled proposal to give applicant opportunity to meet with Zoning Administrator to resolve questions so proper plans can be submitted. STAFF - Novenber 24, 1976 New applicant, Mr. Jim DeSplinter, has come in with some revised plans, but they weren’t complete (all potential problems were not resolved). If proper material is submitted in time for mailing, we can consider applicaticm. STAFF - November 30, 1976 The applicant has submitted one plan of his proposal. The plan is too large for Staff to duplicate on our machines, so I'll present this single copy at the meeting so we can consider the proposal. I believe we should treat this as a work session item only as all problems have not been resolved as yet. I*ve received some additicsial data as to the wetlands and soil status of this property from the Hennepin County Conservation Department. I'm enclosing copies of the reports, but the ?w**ps are too large and conplicated to send out. I'll have these maps for the Planning Coninission meeting of Deceirber 6, 1976. STAFF - December 2, 1976 (Late Correspondence) I am enclosing copies of correspondence regarding proposed realignment of Councy road systems in the general area of the Wallack property. We reviewed the.proposed plat and have the following recommendations for your consideration: 1.It is still Hennepin County's intent to pursue the realignment of CSAH 6 in accordance with Alternate No. 4 of the Northwestern Lake Minnetonka Area Study, as previously agreed upon by Orono and Hennepin County. This alternate includes realignment of CSAH 6 along the section line between Section 30 and Section 31. Proposed System Revisions ALIEKNATE 4 4 I. l\TR('>DUCTION 11-18-76 ITiis is a preliminary soil, site and wetland evaluation for the pro- jxDsed Painters Creek Estates in the City of Orono. A detailed soils map for the area of the proposed development is pro vided with this report. This map is based on a detailed on-site investigation and information contained in "Soil Survey of Hennepin County" and "Landscapes of Hennepin County". Each of the soils mapped in the area of proposed development is briefly described. The favorable and unfavorable development character istics of each soil type are discussed. The suitability of each soil as a site for an on-site soil absorption system is also discussed. Explanations for the soil i. . symbols and map colors are presented in Sections II and III. This is a preliminary soils evaluation and additional engineering tests should be conducted before actual construction begins. In addition to the soils information provided the areas within the pro posed development which are wetland areas were delineated.^ The areas were marked and a survey was conducted by the firm Egan, Field and Nowak to determine the elevation of the highest extent of the wetland. II. HOW TO USE THE SOIL MAP To use the soil map one needs to know what the symbols mean. The soil symbol consists of three parts arranged as follows: HbB2 = Hb (Soil B (Slope)(Erosion) The first two letters denote the soil type; the last letter is the slope of the land in percent, and the absence or presence of a number indicates the degree of erosion. Erin loam: This is a deep, well-drained, moderately fine textured soil that formed in calcareous shaly till. The soil is found on smooth, irregularly shaped hills, lliere are stones and boulders present in this soil. The native vegetation was mixed hardwood forest. Several slope phases are mapped. Each of the slope phases is discussed separately. a). Erin loam - 2 to 6 percent slope: ITie map symbol for this soil is EnB and the map color is medium red. This is a gently undulating soil which occurs on irregular hillsides and knolls. The soil is well-drained. The rolling slopes offer good building sites with a variety of scenic views. Soil strength is adequate. Shrink-swell hazard is moderate. Due to the clay content of this soil the infiltration rate is very slow. b). Erin loam - 6 to 12 percent slope: The map symbol for this soil is EnC and the map color is medium red. This is a rolling soil occurring on hillsides and knolls. The soil is generally never saturated but sidehill seeps and wet spots near the base of slopes can be expected to persist for a few weeks following a wet period. Soil strength is adequate. Shrink-swell hazard is moderate. Due to the clay content of this soil the infiltration rate is very slow. c). Erin loam - 12 to 18 percent slope: Tly nap sym^l for this soil is EnD and the map color is dark r^. This is a moderately steep soil occupying areas on hill sides and knolls, llie soil is never saturated but seeps may break out on sidehills during wet seasons. The infiltration rate is very slow. Erosion is a hazard when vegetation is re moved. Shrink-swell potential is moderate. The soil is clayey and is sticky when wet and hard when dry. d). Erin loam - 18 to 24 percent slope: The map symbol for this soil is EnE and the map color is brown. This is a steep soil occupying areas on hillsides. The soil never becomes saturated except on the lower part of the sidehills where seepage is not uncommon during rainy seasons. The very steep slope is a constraint to most urban development. Erosion is a hazard if the natural vegetation is removed. The infiltra tion rate of this soil is very slow. This soil is deep and ver>' poorly drained, 'fhe soil was formed in loamy colluvium over calcareous loamy till, llie soil is nearly level occupying depressions and sluggish drainageways. Site development characteristics are generally unfavorable. The water table is above or near the surface the entire year and the soil has low soil strength. 5. Hamel loam: The map symbol for this soil is 11a and the map color is medium blue. This is a deep, well-drained loam soil that occurs in short, narrow drainageways on foot slopes and in long winding drainageways between knolls and hills. During wet periods of the year there is a perched watertable within 1 foot of the surface. These soils often wet for a good portion of the year. They are also subject to ponding and the upper horizons are high in organic matter content giving than low bearing values. There is also a high potential for frost action to roads or parking lots constructed on these soils. 4. Hayden loam: This is a deep, well-drained loam soil that occurs on gently sloping to very steep slopes, on knolls and hillsides. The soil was strongly influenced by a forest environment in its development. Shale and limestone fragments as well as granitic cobbles and boulders are com mon throughout. Several slope phases are mapped. Each slope phase is discussed separately. a). Hayden loam - 2 to 6 percent slope: The map symbol for this soil is HbB and the map color is medium green. TTiis is a gently undulating soil occupying areas on knolls and hillsides. This soil is well-drained and therefore never saturated although sidehill seepage is not uncommon around base ment walls during rainy seasons or spring thaws. The rolling slopes offer attractive building sites. 5. Lerdal loam: The map symbol for this soil is LmB and the map color is light red. This is a deep, somewhat poorly drained soil that formed in a cal careous loamy mantle of till 3 to 20 feet thick. The soil is nearly level occupying areas low knolls and on the tops of large hills. There is a seasonal groundwater table at a 3-5 foot depth during wet periods and usually persists near these levels over winter after a wet fall. Soil strength is adequate. The infiltration rate of this soil is very slow. Shrink-swell potential is moderate. Marsh: The map symbol for this soil is Ma and the map color is dark blue. The upper 5 to 10 feet of the marsh is peaty muck or muck. This covers other layers formed in what was formerly a glacial lake. The watertable is near or above the surface the entire year. These soils have very low bearing capacity. The development characteristics of these soils are generally unfavorable. These areas are best used for natural water storage and as scenic open space areas of developments. 7. Peaty Muck over loam: The map symbol for this soil is I’m and the map color is medium blue. This soil occurs in depressions and drainageways. The depth of the peaty muck varies from 12 to 42 inches. The underlying material con sists of gray loam, silty clay loam, or clay loam. The watertable is at or near the surface except during exceptionally dry periods. The soil is subject to px)nding during wet periods. There is a high px)tential for frost action to roads and parking areas. IV. SOIL SUITABILITY FOR ON-SITE WASTE DISPOSAL The area of proposed development is not scheduled to receive municipal sewer services. This means that any homes constructed must utilize some sort of on-site soil absorption system for the disposal and treatment of the household wastes. A discussion of each soils potential as a waste disposal site follows: 1, Erin loam - EnB, EnC, EnD, EnE : This soil is a well-drained upland soil. The watertable is usually below 5 feet. Erin soils however have a large clay content in their subsoil. The USDA textural classification is clay loam. Percolation rates properly conducted on this soil are generally greater than the 60 minutes per inch required by the present Minnesota Sewage Code. This would prohibit the installation of the conventional on-site soil absorption system consisting of a septic tank with seepage trenches 24 to 36 inches deep in the soil. Erin soils can in many cases be utilized for waste disposal ^d treat ment if an innovative mound systan is installed. The following general conditions must be met: a).Percolation rate - The percolation rate in 12 inches or more of natural surface soil shall be faster than 60 minutes per inch and the percolation rate in subsoil and/or substratum shall be faster than 120 minutes per inch. b).Depth to groundwater - The depth to groundwater shall be greater than 5 to 4 feet if the percolation rate is 60 to 120 minutes per inch and 2 to 3 feet with a percolation rate of 30 to 60 minutes per inch. The system shall not be installed in depressions, swales, or drainageways. Information on construction tecliniqucs and procedures for the mound system may be obtained from the Hennepin Soil and Water Conservation District Office in Wayzata. 2. Glencoe silty clay loam - Gc: This is a very poorly drained soil occuring in depressions and drain- ageways. The soil may be subject to ponding during wet periods of the year. Installation of any on-site soil absorption systems on soils of this type should be prohibited. The presence of the seasonal watertable at or near the surface would interfer with the proper functioning of an on-site soil absorption system. 3. Hamel loam - Ha: This is a poorly drained soil occuring in depressions and drainageways. The maximum level of the seasonal perched watertable is within 1 foot of the surface. Installation of an on-site soil absorption system on this soil is unacceptable. The presence of this watertable will result in the malfunction of the soil absorption system leading to the surfacing of the sewage effluent creating a public health hazard. 4. Hayden loam - HbB: This is a well-drained upland soil. The soil is usually never saturated. In many instances this soil is completely acceptable for the in stallation of the conventional on-site soil absorption system. The requirements for a system of this t>T)e are as follows: a). Percolation rate - The percolation rate must be faster than 60 minutes per inch. b). ^pth to groundwater or seasonally saturated horizons - For proper functioning of this system the minimum depth to groundwater of seasonally saturated conditions shall be more than 5 feet. c). Depth to land rock or other impervious materials - the depth to iJi5)ervious materials must be more than 6 feet. Another innovative system can be installed on Hayden soils. This system, the Shallow Subsurface Soil Abso^tion System, improves the chances of proper functioning. The requirements for this system are as follows: a). Percolation rate - The percolation rate must be faster than 60 minutes per inch. b). Depth to groundwater - Depth to groundwater or seasonally sat- urated area must be greater than three feet. c). Flood Hazard - There must be no flooding hazard. d). Slope - The land slope in the area being considered for install- ation of the system must not be greater than 12%. e).Position on the landscape - The system shall be installed on level areas, on top of rises on convex slopes, on sides of rises on plane. The systems shall not be installed in depressions, swales, or drainageways. Details on the construction procedures for these systems may be obtained from the District Office in Wayzata. 5. Lerdal loam - LmB: This is a somewhat poorly drained soil. There is a seasonal water- table present 3 to 5 feet below the surface. The soil is also slowly permeable with slow percolation rates quite common. The soil absorp tion system which will function on soils such as this is the Innova tive Mound System. Requirements for this system were given in Section 4.1. 6. Marsh - Ma: This is a collection of organic soils. There is generally water at the surface for the entire year except during exceptionally dry periods. On-site soil absorption systems may not be installed in these wet land areas. 7. Peaty muck over loam - Pm: This is a shallow organic soil over loamy material. The soil is found in depressions and drainagewa>s. The watertable is at or near the surface for the entire year except during exceptionally dry periods. This soil is unsuitable for installation of any soil absorption system. I f \ «! DELINEATIffi) OF WETLAND BOUNDARIES The wetland boundaries present within this area were set on the basis of soil and vegetative type. Flags were set along the line of trans ition from wetland peat soils to upland mineral soils. These flags were set at intervals of 50 to 75 feet apart. The firm of Egan, Field and Nowak then will survey these points to determine the contour line which can be used to set the wetland boundaries. VI. CONCLUSIONS This area has large portions which lie either within the wetland areas, or which consist of poorly drained soils. Finding suitable areas for the disposal and treatment of septic tank effluent will be quite difficult. A series of soil borings and percolation tests should be made on each proposed lot in areas that are indicated as possible sites by the detailed soils map provided with this report. Solie 1100 North Arm Drive Mound, Minnesota 55364 Dear Mr. Solie; This letter is in reply to your November 3, 1976 correspondence requesting information on the water pollution potential of weathered creosoted railroad ties. From a previous telephone conversation with you, it is my understanding that your town board is concerned over the potential contamination of surface water with creosote. Creosote is a derivative of the distillation of coal tar produced by high temperature distillation and carbonization of bituminous coal. Creosote contains primarily liquid and solid aromatic hydro carbons and may contain tar acids and tar bases. Creosote has been used as a wood preset.ative since the 1840's but is being used less by the wood preserving industry than in the past. Railroad companies, however, have continued to use creosote due to its ability to reduce the mechanical wear of wood ties by its oily, waxy properties. The purpose of the treating operation is to impregnate the wood cells with the preservative to decrease the susceptibility to rot. The effect of the addition of the wood preservative is to extend the useful life of the wood. It would appear that weathered railroad ties that have been salvaged from abandoned railroad spurs would not have a significant impact on the quality of surface runoff where these ties are utilized for landscaping purposes. The amount of creosote residue in these ties is relatively less than what new ties would contain. The Planning Comnission reacted favorably toward the new proposal as the revised right of way would also provide access for properties if any future divisions were made. I once again explained exactly what we needed, but he felt they shouldn't have to submit the mylars and hardshells that we require especially since one lot will be part of the public park system. I explained to him that the preliminary approval was given for the subdivision proposal on the basis of two residential lots meeting code requirements. He informed me that tlie Park Reserve was definitely considering purchasing tlie larger parcel as an addition to the Park Reserve property and felt the cost involved in supplying the required engineering data would be too high. I told him that the City had never made a determination whether they wanted any additions to the Park Reserve until we had some explanation as to the long range plans of the system. Mr. Westman*s proposal requires a conditional use permit to add a bam 222 sq. ft in area. It would also require a lot width variance for this addition on to the 223 ft. substandard lot. Ihe proposed location would also require a variance for the setback from the north proper^ line. The enclosed sketch shows the proposed location to be only 20* from the north lot line and 150* is required. A variance of 130* would be necessary on this. I am enclosing copies of letters of no objection to the conditional use on variances from the nei^ibors on either side of the Westman property. Lakeshore Setback - 75' or average between neighboring dwelling The following conditions now exist in regards to tliis subject lot: 1. Area - Approximately 29,000 sq. ft. 2. Width - 107' 3. New structure can be designed to meet 10’ side yard setback 4. Existing carriage house is 24' frewm rear lot line 5. Lakeshore setback for proposed new dwelling exceeds 75', but would be between 65' SO' forward from existing dwellings on adjoining lots. The following variances would be necessary for approval: 1. Average setback from lake - 65' to 80' The parcel is a previaisly platted lot with no additional adjoining land available. The applicant would like to remodel the existing gray colore<l, cedar shingle carriage house as a guest house. Tliis wuld require a rear yard variance of 6' as it is located only 24' from the rear lot lino. A variance of 65-80' from the average lakeshore setback from adjoining dwellings would be necessary for the proposed location of the new house. The system plan is based on 1973 population trend projections. Any contesting of system conclusions can then best be made by ccxitesting these growth trends: 1. With slower growth rate facts and figures 2. With urban service area growth restrictions (i.e. lack of sewer extensions). 3. With facts about how our local growth can be accoimnodated in our existing urbanized area. A Public Hearing was scheduled for December 20, 1976, at 7:30 p.m. STAFF - December 1, 1976 I've done s^ additional diecking into the status of tlie subject property and rind that the 1 acre existing parcel which has been excluded from the subdivision proposal IS, in fact, a separate parcel. However, tliis one acre parcel and the surromding properties to be divided arc all listed under one owner C^^r. Paul F Boeye) as of January 1, 1976. Since all this property was under single ownership, I believe we should trv to include it in the subdivision so as to eliminate the non-conforming situation. It would be difficult to approve any future applications for variances on this one acre parcel since we liavc all this other land available at this time. I am enclosing copies of th* tax sheets confirming ownership of both properties. This is an unsewered area so on-site systems would be required on all lots. It's true we haven't had any known problems with sewer seepage from the existing residence, but we have a vast undeveloped area supporting the single on-site system.
