The City of Orono is very anxious to add this property to our total park properties which will be determined at a later date as to the specific uses that will be applied to this unique area. Gerhardson, Public Works Supervisor DATE:August 6, 1976 SUBJECT: Bruce Dayton property. East Long Lake Road In July, 1976 Mr. Benson requested that I look into the property at 455 East Long Lake Road. It is my understanding that Mr. Dayton would like to give this property to the City of Orono for park use. The property is five acres, of which approximately 60X is heavily wooded. In the wooded area there is .6 acre wet* lands. There is 500 feet of lakeshore. In checking with some of the local people they stated it is the best swimming beach on the lake. Also on this property is one very old single family dwelling and one small beach house. I talked to Mr. Bernard Statema, the caretaker for Mr. Dayton, and he recommended razing the buildings. The 1976 market value is $63,000, and the taxes for this year are $1,834.28. Chairwoman IXmlap announced that this was the time and place for a Public Hearing on the petition of Steve Wallack (T.M.G. Corporation) for a sti>division of property located at 4100 Sixw Avenue North. The Zoning Administrator presented the Notice of Public Hearing and the Affadavit of Publication. The Zoning Adninistrator stated tiiat a previous proposal submitted in 1974 consisted of 54 lots. The applicant is now submitting a revised proposal for 14 lots. This is quite an inprovement. The total dry buiidable area for this plat is 68.41 acres vhich is 97.731 of the required ^ appear to be at least 300» wide at the balding site and projected locations appear to meet all minimum setback recpiirements. Jfr. and the developer, Bruce Grivna, were present. The Planning CommissiQn asked the applicant if he had coa­ sted Hennepin County regarding the proposed location of the curb cuts and what effects this subdivision would have on the future plans for Coimty Road 6. Mr. Wallack stated he ww not aware of the fact that the subdivision was to be sUomitted to the Comty for their review. At the time of TO last proposal, the rerouting of Hi^ay 12 was discussed, out TOre was no mention of the rerouting of County Road 6. The Planning Conmission was concerned about how much land in this subdivision was in the flood plain and also how much was acTOl wetl^ in relation to^hat is indicated on the ™ Planning Conmission felt that a report should be oMawed ^i^pm the Hennepin County Conservation District or TO Jtodiaha Creek Watershed District and Hickok 6 Associates. The finance states that this cost, if any, would be absoibed by the developer. Also present at this meeting were quite a few surrounding omers. The following came forward to identify themselves: Marie Peterson, Mr. 8 Mrs. Maurice Swanson, C^^lo Carruthers (name not included on the Abstractor’s Wst), Mr. 8 Mrs. F. Joe Thompson, C. E. Larson, Robert Gwiman and Qirt Hagfors. They were interested in seeing TO map of this proposed subdivision. Robert Gehiman, TOse property adjoins Lot 9 of the Subdivision, stated that this area is marshy in the spring. Several neighbors were interested in knowing how many lots were less than 5 acres. They felt that this is a 5 acre zone and should remain as such. However, some of these same nei^ors own 1, 2 and 3 acre lots themselves. After all the p«jblic were heard, the public hearing was closed at 8:00 p.m. iXfter continued discussion, the Planning Commission tabled this matter to allow the applicant time to submit the follow­ ing information: (1) (2) (3) Review by the Minndiaha Credc Watershed District to deteimine actual wetlands designation in relation to areas shown on topog. Review by agency such as Hennepin County Conservation Department or Hickok 6 Associates to deteimine flood plam area and what the restrictions might be. Review by Hennepin County regarding proposed rerouting of Coimty Road 6 and vhat effect the proposed sub­ division might have on any such future plans. Hake moved, Guthrie seconded, that the minutes of the October 18, 1976, meeting be approved as corrected: Page 8, the following sentence be added to the Hennepin County yo-Tech item: It should be noted that the Planning Comnission Members present are opposed to the Vo-Tech proposal. Motion - Ayes (7), Nays (0). The Zoning Administrator stated that copies of the final plat had been sent to each Conmission ^fe^ber. Both parcels exceed the minimum requirements of 2 acres and 200* lot wid^s. Hake moved, Hosfield seconded, to recommend approval m^ect to receipt of the Park Dedication Fee and approval from the County regarding location of any cuib cuts. Motion - Ayes (7), Nays (0). Hank Muhich informed the Conmission that this final plat is the same as the preliminary and meets all the requirements Van Nest moved, Guthrie seconded, to reconmend approval of the final plat of the lot rearrangement. Motion - Ayes (7), Nays (0). Nw applicant was not present to submit necessary informa­ tion. Richard Tiegen, a neighboring property owner, was present and asked if he could address the Conmission. He wanted to express his concern about the drainage should the road be raised. The Planning Conmission assured him that the drainage would be maintained. STEVE WALLACK (T.M.G.) The two parcels resulting from the proposed division contain 8 and 32 acres respectively. Each lot contains 5 or more acres and subdivision meets Section 39.021. Exceptions of our code. Pesek moved, Hake seconded, to recomnend approval of the final plat stbject to the receipt of the Park Dedication Fee of $500. Motion - Ayes (7), Nays (0). HUGH HARRISC^ 1305 SIXTH AVENUE NORTH SUBDIVISION (FINAL) (#172) Mr, Wolfe was in attendance and presented the survey show­ ing the location of the proposed garage. Mr. Wolfe felt this was the best location for the garage to preserve the trees, shrubs and bushes on his property. Van Nest moved, McDonald seconded, to recomnend approval of this variance based on the hardships as demonstrated as this is a narrow lot, it is the only practical location to preserve trees, etc. and existing driveway will act as turn around for side entry on garage. Motion - Ayes (7), Nays (0). Mr. Ldnnan presented certificate of title for Lots 1, 2 and 3 showi^ Mr. Lehman and his brother as joint owners. A lengthy discussion followed concerning lot area com- pliai^e. Mr. Lehman felt he was doing everything humanly possible to meet the code requirements for this subdivision. Member Van Nest stated that Mr. Lehman had agreed to give up the conmercial 250* of Lot A provided that he would not have any problems vdien he planned to subdivide. Van Nest moved, Oithrie seconded, to recomnend preliminary approval of the siixlivision of Lots A, B, C and D based on the hardships demonstrated because of the contour of the land and narrowness of lots A, B, and C, there is no other land avail^le within 1 acre district to make standard for Lot D, and if LR-lCl zoned area were developed under a PRD proposal the developer would be entitled to four living units. Approval was conditioned on the following: (1) A conservation easement over the marsh and wetlands area be granted to the City. (2) Water drainage easement be granted to the City along the drainage ditch. (3) Subject to a Park Dedication Ftee for 4 lots. Motion: Ayes - 5 (Van Nest, Hosfield, Guthrie, Hake, Dunlap) Nays - 1 (Pesdc), Abstain - 1 (McDonald). G. RAYMOND WOLFE 2925 CASCO K)INT ROAD VARIANCE - SITE YARD SET­ BACK (#177) ED LEHNttN 3527 SHORELINE DRIVE SUBDIVISION (PRELIMINARY) (#182) 4 MINUIES OF A PLANNING OCTfilSSION MEETING HELD NOVEMBER 1, 1976 - PAGE 4 Mr. Larson was present. He is requesting approval to build a new garage with the proposed location to be 6* from the side lot line and 6* from the street line. A previous variance request was granted in 1975 to build a house on this property. Variances were approved subject to several conditionsy one being that no other variances be necessary. There was some discussion over the meaning of this stipula­ tion. Some members felt this was meant to include the garage, vhile other members felt this pertained to the house only. Mr. Larson who purchased the house from Paul S^rber stated he could not use the present garage in the winter time. The proposed location extends over a vertical drop. Mr. Larson's plans are to build up a concrete wall on a footing from the lower elevation up to the hi^er grade at road level. Lower level would be used for storage. After some discussion, Guthrie moved, Pesek seconded, to recommend approval because of the topography of the land, it is consistent with the nei^ibors and location would presem large maple tree on property. Motion - Ayes (5), Nays (2) - Van Nest and Hosfield. Mr, Peterson was present. The Zoning Administrator infoimed the Comidssion that the applicant is requesting variances for an addition to the rear of the existing residue and a garage addition to the front. No other land is available and proposed additions would be a great improvement to the existing house. Several pictures of property were presented to the Commission. Chairwoman IXmlap was conceined about the large tree on the property. Mr. Peterson assured her that there was approximately 15-20' between the tree and the addition. Both additions would continue the existing line of the building. Pesek moved, Hosfield seconded, to recommend approval of the necessary variances because house is consistent with neighborhood and would upgrade to houses already there, lot is narrow, and no other land is available. Motion - Ayes (7), Nays (0) Nfr. Solie was present. Hank Muhich informed the Commission that the applicant has done some grading and filling on his property without approval. Mr. Muhich further explained that this was first brought to the attention of Staff on August 8, 1976, vhen a conplaint was received concerning work in progress on this property. Investigation revealed a major ex^vation done with earth filled near to the shore and siltation of the water evident. A stop work order was posted and a tag vjas issued. Mr. Solie was advised to make a permit application and to seek approval from the other agencies. Additional work was apparent ^ done prior to September 9 without the knowledge of staff The MCWD made an inspection as per their letter to Staff on* September 29, 1976. A Conditional Use Permit application was not ria^ until September 20, 1976, after a renewed request following Staff *s discovery of additional work having been done, iius application was incomplete and not updated until October 1, 1976. At this point, the Municipal Court has ccntpued this case until Council shall take action on this aiplication. The work done includes cutting down a high bank and grading the dirt down toward lake level in one comer of filled up to 5 ft. high and to wittm 10 ft. of the summer water level. A creosoted tie retaining iv^l was erected on the lower end and small trees iiave been planted. Mr. Solie stated that he has been to court se-.^eral times concerning this matter. He was not aware that he needed a conditional use permit from Orono for this work. He felt ^t Ae approval of the MQVD was sufficient. The Zoning Admmistrator infoimed Nfr. Solie ond the Commission that the generally enforces regulations. Agencies like ® recommendations and generally do not enforce o3verai members were concerned and voiced tlieir disapproval regarding ^ procedures of the MCl'/D and I^ICD when granting approval of such applications. They requested ^at Council Tu n? letter to ^ese agencies expressing this concern. The Planning Commission also wanted to inform these agencies that Oimo does not approve of the use of creosoted ties in ^y land of lakeshore improvements. The Commission also felt that wono should contact the Board of Governors for these agenues and discuss their policy for granting approval of applicatiOTs, such as Mr. Solie *s, before approval has been given by the Council. Mr. Tiegen, a neighbor to the south, stated that it is quite maintain the bank in this area, and can symphathize with Mr. Solie. Few modifications have been made. Ihe Con?)rehensive Sewer Plan has been submitted to the Metropolitan Waste Control and a meeting is scheduled with them for later this week. The Public Hearing on this matter will be held on November 10, 1976, at the Freshwater Biological Institute. The Zoning Administrator explained that a Public Hearing has been scheduled for November 15, 1976, at 7:45 p.m. concerning the rezoning in Navarre resulting from the settlement of the law suit. Final action is to be completed by November 29, 1976. Member Van Nest pointed out the additional area in Navarre to be considered for rezoning also. The Planning Comnission is requesting that Council study this additional property to be rezoned for their input as to what is reason­ able to rezone. The Planning Commission is in favor of this rezoning. The Planning Commission went into work sessions on David Butler, Warren Ortenblad, Edwin Kuglin and Curt Jenson. The Planning Commission received a copy of the letter Mrs. Watson sent to Dick Benson requesting that she be considered for an opening on the Planning Commission. Chairwoman Dunlap infoimed the Commission that she knew this woman personally and felt she was a conscientious person. Van Nest moved. A.®ie program established by Congress in the National Flood Insurance Act of 1968 and expanded in the Flood Disaster Protection Act of 1973 is designed to provide flood insurance at rates made affordable throufi^ a Federal subsidy. In return, communities must adopt and administer local measures that protect lives and new construction from fhture flooding. 2. Q. Is the program designed for individuals or communities? A.Both. While Individuals in a participating community may obtain financial protection against flood losses, the community itself enhances the overall value of its flood plains and assures the increased safety of its citizens. 3. Q. Who may apply for participation in the program? A.Any community with the authority to adopt and administer flood plain management regulations for the flood-prOne areas within their jurisdiction. Q. What communities should apply for participation in the National Flood Insurance Program? The National Flood Insurers Association (NFIA) or its servicing company for that area also sends out notices to inform insurance agents and brokers of the availability of coverage. Notice is also inibliahed in the Federal Register. Vhat is the National Flood Insurers Association? The NFIA is an association of private insurance cooq>anies formed specifically to provide flood insurance under the cooperative Govemment<>private industry program. Membership is open to .all qualified companies licensed to write property insurance under the laws of any State. Member insurance conq)anie8 have subscribed more than H4I1 million in risk capital, nie NFIA appoints a servicing coinpanyy generally on a statewide basis y to disseminate information both to the public and to insurance agents y to process all insurance policies y and to handle the ^justment of claims for loss payments. Is assistance available to a community in qualifying for flood insurance? Yes. A community may contact the appropriate State Coord­ inating Agency, the Flood Insurance Specialist in the HDD region in \diich the community is located, or FIA in Washington, B. C. for program information, application forms, sample ordinances, etc. (See the lists at the end of this brochure for the appropriate agencies you may contact.) What is a State Coordinating Agency? A. A. Q. A. 13. Q. A. - 3 - 10. Q. By what means is a community notified of its identification as having one or more areas of special flood hazard? An "identified” flood-prone community is one for .which PIA has published a map called a "Flood Hazard Boundary Map" vdiich delineates the areas subject to severe flooding within the community. This map is usually the first map PIA sends to a flood-prone community. Together with this map, PIA sends a letter of transmittal explaining the map, application forms, and program information to community officials. 11. Q. What is a special flood hazard area? It is that area subject to inundation by the base flood i.e., a flood that has a one-percent chance of occurrence in any given year. This standard is used by virtually every Pederal agency in the administration of its programs as they relate to the flood plains. In addition, the same standard is required either by law or regulation in many States and is used in the administration of State programs in virtually every State. Can a community challenge PIA's Flood Hazard Boundary Map? Yes. If, after receiving a Flood Hazard Boundary Map, the community feels that it is not flood-prone or has corrected the flood hazard, it has six months from the date of the nap to challenge PIA*s designation. A community may agree with PIA's determination that there are local flood problems, but dispute the extent of the hazard areas as shown on PIA's map. In this case, the community may at any time submit data for review. FIA will review the data and, if warranted, amend the community's map. Is there a specified time by which communities should qualify for the program? Yes. July 1, 19751 or within one year of notification, whichever is later. If an identified community hsis not qualified for the program by the prescribed date, no Pederal or federally-related financial assistance may legally be provided for the construction or acquisition of buildings in the community's identified special flood hazard areas. Such assistance will remain unavailable until the community has qualified. A.The term includes direct Federal financial assistance such as grants, SBA and TaSA loans, VA and fSA mortgage loans, and conventional construction and mortgage loans from federally Insured, regulated or supervised lending institutions, e.g., banks insured by FDIC, savings and loan institutions insured by FSLIC or regulated by the Federal Home Loan Baxik Board, credit unions insured by the National Credit Union Administration, banks regulated by the , Comptroller of the Currency or the Federal Reserve Board. 1^. A. flood insurance must be purchased as a condition of obtaining Federal financial assistance for the construction or acquisition of buildings in the identified special flood hazard areas of communities where flood insurance is available. Who determines whether properties require flood insurance? When the financial assistance is directly from a Federal agency, the agency Itself must make the determination. In the case of lending institutions covered by the Act, the lender or his authorized representative must make the determination. This responsibility cannot be discharged by obtaining a self-certification from the borrower. How much flood insurance is required by law? Usually, up to the amount of the financial assistaxice or the max inn UP amount of insxirance available under the program, whichever is less. What insurance benefits are available under the program? When a community initially qualifies for the sale of flood insurance under the Bnergency Program, limited amounts of coverage are available at subsidized rates for virtually every building as well as the contents regardless of the risk. After FIA*s detailed Flood Insurance Rate Map has been prepared, and the community enters the Regular Program, the available limits of coverage are double those available under the Emergency Program. Hie second layer . of coverage at actuarial (non-subsidized) rates is available together with the subsidized first layer of - more - - s - covera^ for all existing structures regardless of location. Can condominium units be insured separately? Yes. When the condominium unit is a traditional townhouee or rowhouse, it is considered for insurance purposes as a single-family dwelling and may be insured separately. For other types of residential condominiums, the buildings are considered multi-faxnily dwellings and insurance must be taken out in the name of the condominivims owners' association, l^e coverage may be taken out in an amount equal to the maximum amount available on the building or in an amount to cover the value of each unit until the m^yimum amount of insurance available on the building has been purchased. What kinds of property are not ins\irable under the program? Wharves, piers, bulkheads, growing crops, land, shrubbery, livestock, roads, bridges, motor vehicles, etc. What is a Flood Insurance Rate Map? A Flood Insurance Rate Map is usually the second map FIA furnishes to a community. This map is the result of a detailed engineering study and is used in conjunction with a community's participation in the Regular Program. This study and map further refine the boundary lines of a community's special flood hazard areas to reflect the flood elevations in such areas that would occur during a flood with a one-percent chance of occurrence in any given year. In this case, the work in question has been done, and staff has instructed Mr. Solie to seek Council approval. Oi August 8, 1976, staff received a complaint of work in progress on this property. Investig,ation rwealed a major excavation done with earth filled near to the shore and siltation of the water evident. A stop work order was posted and a tag was issued. Mr. Solie was advised to make a permit application and to also seek approval from the other agencies. An application apparently was made to the MCiVD because we liave a copy of a letter from tliem to Mr. Solie on August 27, 1976, approving his request. Additional work was then apparently done prior to September 9, 1976 (without Orono Staff knowledge) with an MOVD inspection as per their letter to me on .September 29, 1976.. 'fhe Conditional Use Permit application was not made initil September 20, 1976 (initially incomplete; not updated until October 1, 1976) after a renewed request following staff's discovery of additional work having been done. At this point, the Municipal Court has continued this case until the Council shall take action on this application. The work done inclutles cutting down a high bank and grading the dirt down toward lake level in one comer of the lot. TIic loiver level was filled up to 5 ft. high and to within 10 ft. of the suimer water level. Our home became ours this October after living here for twenty years and finally making that last mortgage payment. We treasure the beautiful lake in front of our home and the privacy we have had these many years. Needless to say, we were very distressed when Mrs. Parten chose to build her deck 10 feet from our property line, half story above the ground level, looking down directly onto our patio and into the lake front windows of our family room, when her property has a depth of over 600 feet. We thought the village had a policy of not allowing a new house on the lakeshore to be built in front of an existing one. Mrs. Parten chose to build her house in front of ours and at an angle facing across our property, using the view over our property for her lakeside windows. Mrs. Parten has lived in the immediate area for about 15 years so was aware of our family desire for reasonable privacy. Since we put in the patio 18 years ago, we planted evergreens along the north property line by our patio giving us a growth of approximately 6 feet. About five years ago on the property directly south of us, the village allowed the Partens to subdivid^i their property so they could sell the lot when it did not meet the width requirement at the building line. When the new house to the south of us was built, they built their deck looking over our property at which time we built a fence for some privacy as that area had been all wooded. Being well aware of our family*s desire for reasonable privacy, Mrs. Parten chose to design her house in such a way that her deck and large window are directly above our patio. We are asking for a variance to construct a fence approximately 22 feet long and 11 feet high to give us some reasonable privacy. With the evergreens we planted, we need an additional five feet of height to the fence to aquire the reasonable privacy our family desires when we are using our patio and family room. i 11 1:^ Mrs. Robert H. For Planning Commission Members a Council Members ONLY The developement of the lot to the north of our property has been most distressful to our family. Mrs. Parten chose to burn down the old cottage and it was done in such a way that thousands of gallons of water had to be poured on our roof to keep our home from being damaged by the heat. This caused water in our basement and two of our trees had some damage. Now whenever it rains, which hasn't been too often this summer, the water and soil from their property drain down onto the north side of our house. We have been patiently tolerating this situation until the final grading is done. We thought this would be done before winter as we are very concerned about spring runoff. This has not yet been done. Then the placement of their house in front of ours, looking over our property. Then when the deck was built in that location, we felt it was more than we could tolerate. This, we felt, was directly affecting our peace of mind and reasonable privacy. We have the greatest desire to be friendly with all our neighbors but Just not that friendly!
