Zoning Admin istrator A1 Olson. Also present were Council Members Mary Butler and Noiman Paurus. C^irwoman Dunlap announced at 7:30 p.m. that this was the time and place for the continued public hearing on the sub division application of Van Eeckhout Building Corporation for property located at 400 Old Crystal Bay Road. Mr. Van Eeckhout was present. At their previous meeting, the Planning Cormission had requested that a drainage plan be submitted for review by the City Engineer. Mr. Olson infoimed the Commission that he had not received any revised plans, but that he had talked with our City Engineer who had reviewed the proposal and had no objection. Mr. Van Eeckhout explained that he had not submitted a drainage plan because of the fact that there would be no changes made in the flow of drainage, rtenber Van Nest suggest^ the possibility of drainage easClients on this property. Mr. Van Eeckhout stated that they would grant vhatever reasonable easements necessary. Mr. Rosengren, property owner to the west of this subdivision, again stated his concern that the drainage be maintained. After all the public were heard, the Public Hearing was closed at 7:40 p.m. Qmrwoman Dunlap announced at 7:41 p.m. that this was the time and place for the Public Hearing on the petition of Ed Lehnan for a subdivision of property locat^ at 3527 Shoreline Drive. The Assistant Zoning Administrator presented the Notice of Pii)lic Hearing and the Affadavit of Publication. ATTENDANCE - 7:30 P.M. Zoning Administrator explained that Mr. Lehman is requesting approval to subdivide this property into four tracts. Mr. Lehman’s property is located in two different zcning districts. The northern portion ir zoned LR-lCl - 1/2 acre. The southern portion is zcmed 1 acre. One year ago, Mr. Lehman was granted approval to move in a new home. This home is on Lot A and is occupied by his daughter. Mr. Lehman is also the owner of Lots 1-6. Mr. Richard Edwards owns Lots 7 § 8. Mr. Lehman was present and infoimed the Ccmnission that both he and his brother oivned Lots 1, 2 § 3. The Asst. Zoning Administrator presented the Notice of Public Hearing and the Affadavit of Publication. Mr. Olsm stated that the City had recently been informed that this area was being used for swinming and docking of boats. Notification was given to remove the dock. Neighbors then approached the Council requesting that the City open this area as public access. As a result of this di:»cussiQn at the Council meeting, a Public Hearing was scheduled for this evening. He further stated that the Comnission should have received a copy of a letter to Bruce Malkerson from James Lane idio is the attorney representing Ridiaid Mirlowski. The letter defines the legal status of Ivy Lane. Mr. Lane stated that it is important to distinguish tetween a dedicated street and a mere easement for such street use. The Asst. Zoning Administrator stated that our City Attorney agrees with what is put forth in this letter. Several con cerned neighbors were present at this meeting. The following came forth to identify themselves: Robin Crawford, Donna Crawford, Lew Capron, Dick Murlowski and George Olen. Mr. Crwford stated that Ae neighbors in the immediate area have enjoyed the use of this beach for swimning would like to continue the use as sudi. There is room for only one dock and Mr. Crawlord has been the only one docking a boat. He stated that the City had been taking care of this area when he moved in 5 or 6 years ago. Mr. Murlowski then approached the Commission. He stated that he ^ been living here since August of this year. He is: familiar v;ith vhat has been happening and wants no hostility from this action. After talking with A1 Olson and Attorney lou Cbeihauser, he feels this should be a restricted area and w^d like the privacy. He presented severox pictures of this area to the Commission. ^rge Olen informed the ConmLssion that he had been living in this area for 10 years and felt it was a public access. He mentioned that there weren*t any problems until Rev. Westerdahl, the previous owner of Murlowski *s property, com plained. They have been using it mainly for the enjoyment of the children and have been keeping the area clean. Mr. Cra^ord then explained about the day Mr. Westerd^ com plained. It was very hot that day and they had been cleaning ^e beach area. They were drinking beer, but were not having a party. Mrs. Crawford mentioned that idien they pur chased their property the real estate agent from Roger Fazendin Realtors told them they would have lake access. Ann ^ron then explained that Jim Albee, the original suibdivider, stated it was a pUblic road and he wanted every one to use it. General feeling is that there are no problems with mis subdivision, but there should be concern about the drainage. Pesek moved, ^thrie seconded, to recomnend preliminary aroro^ of this subdivision on the basis that we have the City Engineer review for any necessary drainage easement recrements and access, subject to a Park Dedication Fee. and approval of the final plat. Motion - Ayes (8), Nays (0). The Commission was concerned about the actual buildable area in each proposed parcel. They had not received copies of the survey drawing showing the necessary information. There was ^so co^eni about the adjacent parcels not now included in the subdcsicm. Mr. Lehman agreed to supply copies for the members to study. The Planning Comnission also wanted a true classification of the wetlands on this property. HakeGuthrie seconded, to table this matter in order for Mr. Lehman to siAmit a topographic survey and a current mstr^tor s certificate of property owners. Motion - Ayes (8), Nays (0). The Planning Commission proceeded to discuss this fire lane leage. Menfcer Van Nest understood that this fire lane had been serving the needs in the area. However, sooner or later the number of people using this access would start creating problems as public use would have to be open to all and not limited to local residents. It is one thing to use this uccess, but it is another thing for the City to promote this use and to maintain the area. Similar situations in other are^ of the City have occurred and these requests were dOTied because of similar problems. Member Van Nest felt this matter should be reviewed by the Park Ccmmission. Van Nest moved. Hake seconded, that Council consider the inpirt from the Park Caimission and also the recomnendation Oi. the Planning Comnission to deny this request because the narrow width of this access and terrain of the area prevents development and regulation of this property and recommends »^t the easement be posted for use as fire lane access only Motion - Ayes (8), Nays (0). Zoning Administrator explained that no additional material had been submitted; however, Mr. Jim DeSplinter had just approached him and stated he had just signed a purchase agreement for this property. Mr. DeSplinter r^uested that the Planning Commission give him a future tune limit to submit necessary infoimation • The Comnission informed the new applicant that he should provide information on the proposed driveway and what he intended to build, and to also provide a survey. Hake moved, Guthrie seconded, to table this matter to allow the applicant to submit the necessary • « requested at the Septenfcer 9, 1976, meeting. Motion -Ayes (7), Nays (0).. ROBERT JOHNSON 1121 ElMm) AVENUE VARIANCE - LOT AREA 6 WIDTH (#164) Mr. and his Attorney Doug Carney were present. They resubmitt^ tlie original subdivision proposal after having the Planning Commission Members visit the site again. Mr. Ryan had studied the area again and feels that the only acceptable way to subdivide is with two lakeshore lots. Any other way would interfere with his driveway and garage. Some members felt that the lot lines could be arranged to meet the lot width requirement at the building line. After a brief discussion, Pesek moved. Hake seconded, to accept this subdivision proposal based on the following: TOM RYAN 1060 TONKAWA ROAD SUBDIVISION (PRELIMINARY) (#170) (1) (2) (3) (4) It is consistent with land ■ lot on either side is of same width. Chairwoman Dunlap stated as minority opinion that she is opposed because ^is is a new subdivision and cannot vote ror any new subdivisions requiring variances. Mr. Olson informed the Comnission that the applicant had no new infoimation at this time. Necessary" information would be stbmitted at the next meeting. RAYM3ND § RtHH WOLFE 2925 CASCO POINT ROAD VARIANCE - SIDE YARD A MMTTES OF A PLANNING OCMIISSION MEETING HELD OCTOBER 18, 1976 - PAGE 6 The Asst. Zoning Administrator stated that the applicant, Mr. Corny, was requesting several variances and a conditional use peimit to construct a home on the one remaining lot on Scotch Pine Lane. The subdivision had been ^>proved prior to the z^ng change and is the reason for the variance request at this time. The Asst. Zoning Administrator said he had a report from the City Engineer approving the soils as suitable for cn-site septic system on this 1/2 acre lot. Mr. Conry stated that he had contacted nei^bors Marfield and Kennedy and they were unwilling to vacate the street or to replat. The main concern of the Planning Coomission was the public health problem which could result from an ineffective on site septic system. Soil report received from City Engineer reveals there would be no problem. After a short discussion Van Nest moved. Hake seconded, to recomnend approval of the variances on the basis that there is no other land avail able, and approval of the conditional use permit for dock subject to no other accessory buildings on Lot 4, subject to the fact '^at Lots 2 6 4 be under the same ownership, and before building peimit is issued septic system design meets the ^roval of the City Engineer. Motion - Ayes (7), Nays (0). Mr. Rivers is considering reaching an agreement with Mr. ^fcMah^ to lease or purchase his property to the north of the Windward Marine. This would include the residence behind "Mac's Pizza" building. Mr. Rivers is requesting approval for an addition to this residence. Existing residence is approximately 38' from the shoreline. Proposed addition would extend 9' closer to the shoreline resulting in a 29' lakeshore setback from the present shoreline. The applicant also has plans to remove the bait shop and the concrete slab between boat works building and residence. It should be stipulated that thjs lot would then be used residentially until such ^ime when the applicant would decide to use this property cdimercially, and would therefore be required to remove the residence. Mr. Olson stated the septic system should be reviewed and approved by the City Engineer. After considerable discussion. Van r«‘'est moved. Member Pesek left. ^pplicwt is requesting i^roval of two variances to build an addition to tiie existing residence on substandard lot (13,500 sq. ft. in area and a side lot setback of 27.6'). Although Suninit Street is platted alongside his property, there appears to be very little likelihood that it would be uiqproved to any extent. The pressed addition would have no bearing on the existing conditions as it would be added to the opposite side. McDonald moved, Hannah seconded, to recomnend approval of this variance as addition would be an improvement to th? property. Motion - Ayes (6) Nays (0). JAMES RIVERS (#185) 1442 SHORELINE DRIVE (continued) PAUL CHRISTENSEN 1304 EIMIOOD AVENUE VARIANCE - LOT AREA 6 EXISTING SETBACK FOR ADDITIOJ (#186) BACK The Planning Commission tabled this matter until their next meeting as applicant was not present. The Park Gun Club presented a marked calendar showing the proposed hours of operation, a colored plat map showing adjacent property owners, and a large aerial photo of the entire property. It was established that weekday shooting will not conmence prior to 5:00 p.m. and will run until ^ik or no later than 10:00 p.m. Saturday and Sunday shoot ing will not commence prior to 1:00 p.m. and will teiminate no later than 5:00 p.m. or dark, whichever occurs first. The Park Gun Qub requested reasonable rescheduling of special weekend shoots they would have to cancel due to any inclement weather. The Park Gun Club proposed planting a sound barrier of weeping willow trees along Starkey Road between the existing trees at Sixth Avenue and the wooded area in the center of the property. Planting would not begin until May of 1977. Grading may be necessary for the planting of these trees. The proposed lighting and night hours will be handled when a separate, formal proposal is made. M Olson stated that he had been advised by the Park Board that mey had no conflicts concerning this matter and the use of their own land.
