Lai>«, 117 » JWti iSrf >4% «, ^ ®0N0, MNNESOTA REGULAR PLANNING CX3^tlISSION MEETING HELD SEPTEMBER 20, 1976 Ototo Planning Conmission met on the above date with the following members present: Ghairwoman Diane Dunlap, Meni>ers ^irwoir^ Dunlap announced that this was the time and place for a public hearmg on the petition of Holiday Station Stores for a conditional use permit and variance at 3340 ^oreline Drwe to constnjct one of their Station Stores. TOe Zoning Administrator presented the Notice of Public Hearing and the Affadavit of Publication. Bradley Steinman of Holiday Station Stores was present. He submitted a copy of the site plan and stated that the double access propos^ had been approved by the County. The pre­ ssed plan in^cates there would be two access points to this station from County Road 15. Mr. Steinman felt that because ^©re are three stations at this intersection already Holiday should be granted this conditional use ^rmit. The Zoning Administrator explained that the request for a third station constituted a variance and had no bear­ ing on conditional use peimit determination. Conditional use pmit approvals are subject to the conditions set forth in Section 32.460 of our Zoning Ordinance. The Planning Conmission was concerned about the traffic proble^ that could result at the intersection of County Road 15 and 19. Traffic studios indicate that a great portion of this traffic would be coming to the station northern part of Orono. This would mean that traffic T^i^d be turning left on to County Road 15 and then left into the station. The public hearing was closed at 7:40 p.m. Chairwoman Dunlap announced the opening of a public hearing regarding the petition of Tom Ryan for a subdivision of property located at 1060 Tonkawa Road. The Zoning Adminis- tratcr presented the Notice of Public Hearing and the Mfadavit of Publication. Mr. Ryan is requesting approval to suodivide this parcel into two lakeshore lots. The ZOii.^ng Administrator stated that consideration should be given to storm water runoff. Tom Ryan and Attorney Douglas Carney came forward to review the proposal with the Conmission and the Public. Mr. Carney told the Planning Commission that there is a ditch running from the ponding area to the lake. Mr. Ryan was asked what he planned to do with the dirt that was stored on this property. Mr. Ryan explained that this dirt would be ATTENDANCE - 7:30 P.M. Any unused portion would be removed. The Planning Comnission also asked Mr. Ryan if he was suing the City on the 73-1 sewer assessment. He stated that he was not. Ihe public hear­ ing was closed at 7:55 p.m. The Planning Commission continued to discuss this proposal. Merijer Van Nest felt that this parcel should be subdivided so as to create only one lakeshore lot as both lots would then meet all code requirements. Mr. Ryan felt that two l^eshore lots were not unreasonable as they would be con­ sistent with the other lots in the area. Also, the sewer is in front of the lots. Mr, Ward Parten and Harry Larson, neighbors present at this meeting, agreed with Mr. Ryan. After continued discussion, Pesek moved, Guthrie seconded, to ^prove this subdivision based on the following: (1) It is consistent with the neighbors. (2) It is the only logical way to subdivide. (3) Consists of two acres with two sewer assessments. (4) Lot is not wide enough to confoim with the two lots on either side. (5) Conditioned on the fact that Mr. Ryan is not suing the City on the 73-1 Sewer Assessment, (6) Subject to a Park Dedication Fee. Motion: Ayes - 2 (Pesek, Guthrie), Nays - 3 (Hosfield, Van Nest, Dunlap), Abstain - 3 (Hake, Hannah, McDonald). The Planning Comnission Aen tabled the matter and suggested to ^fa*, Ryan that he submit a revised proposal vhich would meet both lot area and width requirements. Chairwoman Dunlap announced that this was the time and place for a public hearing on the petition of Hugh Harrison for a subdivision of property located at 1305 Sixth Avenue N. The Zoning Administrator presented the Notice of Public Hearing and the Affadavit of Riblication. The proposal is to split off 8 acres from the original 42.7 acres to remain as the site of the present home. The remaining 34.7 acres would be left as the site for a new home. The access to the new house would branch off tlie existing private drive. Don Umd, George levering and several other neighbors were present and interested in knowing how this land was going to be subdivided. No one had any objections. The public hearing was closed at 8:35 p.m. After a short discussion. Hake moved, Hannah seconded, to recOTmend approval of the preliminary subdivision proposal based on the fact tliat no variances are required, subject to ^e fact that the new structure require no variance and subject to a Park Dedication Fee. Motion - Ayes (8), Nays (0). THCMAS RYAN (continued) HUGH HARRISON 1305 SIXTH AVENUE N. SUBDIVISION (PRELIMIi>lARy) ^MINUTES OF A PLANNING CCMMISS.^N MEETING HELD SEPIBIBER 20, -PAGE 3 The Planning Commission further discussed the Holiday a^lication. Tlie Planning Comnission felt this was more tnan a service station and would generate more traffic into this area. Mr. Steinman stated they would be willing to close off the access closest to the comer of County R^d 15 f, 19 which they feel would help eliminate some of the congestion at this intersection. HOLIDAY STATION ^'CWES 3340 SHORELINE DRIVE CONDITIONAL USE PERMIT VARIANCE 4ARY) Tne Planning Commission reviewed proposed schedule of shooting dates and hours for 1977 submitted to staff on September 17, 1976. The Planning Commission felt there were discrepancies ?n this proposed schedule and that it w.^ very confusing. Mr. Maas, President of the Park Gun ^ of sufficient time to submit a more detailed schedule. Mr. Coffin would do the survey during the first two weeks of October. i-t* Laidlaw and Mr. Earl Hanson, neighbors to the Park Gun Club, were present. They felt the Park Gun Club was a good cat’se and tliey had no objection to the hours of operation or the noise. Indications on the sketch are that the addition would be 5* higher than the existing house. The Farley's were present at the meeting. Van Nest moved, Hosfield seconded, to recommend approval of the variances required for the proposed addition to the non- confonnmg residence based on the sketch provided, addition is 5' higher than present ridge line and does not extend g^^do^resent extremities of the house. Motion - Ayes (8), CHARLES FARLEY 2700 CASCO PC»INT ROAD VARIANCE - SIDE LOT SETBACK The Planning Coirniission took action on the following work session items. The Nelson's are requesting approval to replace tlieir existing garage whidi is badly in need of repair. ffcDonald moved, Hannah seconded, to recommend approval to replace garage based on the fact that the new structure would be located at the same setback points and any other location for this garage would require more fill. Also, ^lew garage would be a great improvement to the property as the existing structure is badly in need of repair. Motion - Ayes (8), Nays (0). OLLIS NELSON 4099 HiaiV\IOOD ROAD VARIANCE The Olson's were present. They are requesting approval for an addition to an existing non-conforming situation. Pesek moved, H^e seconded, to approve this variance based on ^e fact that the proposed addition to the existing residence would meet all setback requir^nents and the Olson's have sufficient lot area. Motion - Ayes C8).Nays (0). TERRY OLSm 3640 bays™ road VARIANCE C^cil previously approved a 15' variance (#133) so an addition could be made to the existing dwelling. Mr. Jansen n^ds an additional 2' width for his kitchen reducing the side yard setback from the originally approved 15' to 13'. Dunlap moved, Pesek seconded, to recommend approv2il of this yari^e to a 13' side yard setback so the Jansen's could build the addition as originally designed but had mis­ calculated on the dimensions. FIRE LANE USAGE 1535-1545 LONG LAKE BLVD. )AD MIMJTES OF A PLANNING COMMISSION MEETING HELD SEPTEMBER 20, 1976 - PAGE 5The Zoning Administrator explained to the Comnission that this item was not on the agenda. The Mayor had set up a m^t^ earlier today at the Village Office with Mrs. William IVyatt. The Mayor requested that this subdivision (final) proposal be brought before the Planning Comnission tonight for a recoimendation to Council. The Zoning Administrator stated that this is not a legal plat and does not meet final requirements. The plat submitted by the IVyatt's was a copy of the preliminary plat. Therefore, the signature of the surveyor was also a copy. Plat does not have the necessary property description and space for signa­ tures. The proposal (k>es not meet the stbdivision exceptions as a variaiKe would be required for the lot that does not meet the minimum zoning area requirement (39.021). Hank Mjhiw also infoimed the Commission that the surveyor, Arleigh C. Smith, had voluntarily surrendered his Certificate of Registration to practice Land Surveying rather than face charges of incompetency. The V\^tt’s were present and were very persistent in express­ ing their feelings that the plat submitted was satisfactory. After much discussion. Van Nest moved. Hake seconded, to deny ttie final plat on the basis that it does not comply with Section 39.400 and does not meet the requirements for Exception, Section 39.021 • The Planning Commission requested that the final plat TO redone and submittedin compliance with Section 39.400 as interpreted by our legal staff and Zoning Administrator. Motion - Ayes (8), Nays (0). The Wyatt's were advised to make the necessary changes to meet the requirements and to bring the plat back to the Commission. ROBERT WATT 4220 mTERTOW ROAD SUBDIVISION (FINAL) ^e Comnission reviewed this matter and after some discussion Pesek moved, Guthrie seconded, to reccninend not to extend the moratorium, but instead enforce the 200' dock length as established by the liCD. Motion - Ayes (8), Nays (0). The Planning Comnission appointed a comnittee on the Platting Ordinance. Paul Pesek was named Chairman and will have assistance from George Hosfield and John Hake. The Planning Commission expressed their surprise and concern to ^e Zoning Adm^istrator concerning Council's reversal of uieir recommendation on the Klaus Becker subdivision. The Plan^g Comnission had recommended denial of the proposed sub^vision of 5 lots. They offered Mr. Becker the oppor­ tunity to submit a revised proposal of only 4 lots, or the ^ssibility of a^uiring enough additional land for the 5 lots to meet minimum area requirements. A reason for their concern of Council's decision was this item was listed as a progress report on the j^enda for the Council meeting of Septencer 13. Lot 2 has some existing ponding areas that we should try to protect from excessive fill. We should trv’ to determine the best location for a liouse and access road. Zoning AcJministrator Vv DATl:: .mJECT: October 13, 1076 Rolxjrt Solie - 1085 North Arm Drive Conditional Use Permit - Crading and Pilling This application is persnant to Section 31.700 and 31.705 requiring a Conditional use Permit for grading and filling of any land, especially lakeshore property, within Orono. In this case, the work in question has been done, and staff has instructed Mr. .Solie'to seek Council approval. On August 8, 1976, staff received a complaint of work in progress on this property Investig.ation revealed a major excavation done with earth filled near to the shore ^d siltation of tlie water evident. A stop work order was posted and a tag was issued. Mr. .Solie was advised to make a permit application and to also seek approval from the other agencies. An application apparently was made to the MGVD because we have a copy of a letter from tiiem to Mr. .Solie on August 27, 1976, approving his request. Additional work was then apparently done prior to September 9, 1976 (without Orono Staff knoivledge) with an MOVD inspection as per tlieir letter to me on .September 29, 1976. The Conditional Use Pennit application was not made until September 20, 1976 (initially incwnplete; not updated until October 1, 1976) after a renewed request following staff's discovery of additional work having been done. At this point, the Minicipal Court has continued this case until the Council shall take action on this application. The work done includes cutting down a high bank and grading tlic dirt down toward lake level^ in one comer of the lot. Tlie lower level was filled up to 5 ft. high and to wi+! in 10 ft. of the summer water level. A creosoted tie retaining wall was erected on the lower end and approximately 2 dozen small trees have been planted. The slope has been seeded.
