Ihe proposal as submitted consists of 5 parcels with a private road and cul-dc-sac. The owner has been notified that he would be required to grant to the City of Orono easements over these private approaches. The survey includes sane wetlands, but these marsh areas have been deducted in calailat ing tlie areas of the individual parcels. I don't believe these 4 additional sites will have much of an impact on the traffic on Femdale. Several items to consider on this proposal are: 1.Lot area variances will be required for 2 of the lots. Ihe 200' lot width requirement will be determined by properly locating the ilwelling. 5.^linimum setback requirements will have to be met for any future constiuction. Mr. Becker has been informed of the Park Dedication Fee requirement. ($250 per lot or $1,250 total.) Mr. Becker is the applicant, but the assessor's records show a Harold L. Holden as the owner aild homesteader of the property. The Planning Comnission should schedule a Public Hearing on this matter. The structure is near completion. He is now requesting approval of a Conditional Use Permit to add self service gas pianps for retail sales in conjunction with the other retail sales services. Motor fuel stations require a Conditional Use Permit in a B-1 zoned district (Section 35.022), and if approved must comply with all requirements as listed under Section 38.500 of our zoning ordinance. I would recommend we liold a l\iblic Hearing before any action is taken. Gene Woolley arrived at 8:25 p.n. ATIENDANCE - 7:50 P.M. Acting Chairman Hannah announced that this was the time and place for a Public Hearing on the petition of Gerald Parten for a siAdivision of property located at 985 Tonkawa Road. The toing Administrator presented the Notice of Public Hearing and the Affadavit of Publication. Hank Hdiich explained that the original proposal was to subdivide the 5+ acres into three lots and that the Parten's had changed this request to two lots both exceeding two acres. Carl Parten, a brother of the petitioner and neigji- bor to the south, was concerned about the swan^) area on the rear lot. He felt that this wild area should not be destroyed if a new road were built. Mrs. Gerald Parten explained that the road to their property is already there. Therefore, no new road is required on the south lot. Another nei^ibor, Ken Weestrand, was concerned about the lake setbacks for ffliy new homes that were built. He was concerned about ^ssible obstruction of his view. The Planning Commission informed him that the lakeshore setback requirements are 75'. The suggestiOT was made to try and line up the homes. After all the public were heard the public hearing was closed at 8:05 p.m. The Acting Chairman announced that this was the time and place for a Public Hearing on the petition of Robert Niichel for a subdivision of property located at 3175 Sixth Avenue N. The Zoning Administrator presented the Notice of Public Hearing and the Affadavit of Publication. Hank Muhich stated that this petition is located in a 2 acre zoning district and tiiat Mr. Niichel is requesting approval of subdividing this parcel into 5 lots, each exceeding five total acres. Mr. Muhich also informed the Commission that he had received a letter from Donald Murphy of Hennepin County regarding the proposed access to this subdivision. The si^t distance required to safely enter highway is 845' to the left. The actual sight distance to the left is 450'. Because of this limited sight distance, the County has reccminended that the proposed access be relocated to a more safe location. PUBLIC HEARING - 7:50 P.M. GERALD PARTEN 985 TONKAVA ROAD SJBDmSKM (PRELIMINARY) PUBLIC HEARING - 8:05 P.M. ROBERT NIICHEL 3175 SIXTH AVENUE N. SUBDIVISION (PRELIMINARY) MINUTES OF A PLANNING COfUSSIC^I MEETING HELD AUGUST 16, 1976 - PAGE 2 !. Robert Niichel and his attomey, Bob Ntary, were present at the meeting. They explained that no other property was available to relocate the access point. Mr. Niichel also stated that a cliange in the access would destroy his original plan. They recognized the concern of the County, and hoped that the County would understand their situation. After all the public were heard, the public hearing was closed at 8:20 p.m. ROBERT NIICHEL 3175 SIXTH AVENUE N. (continued) I P.M. mo P.M. ARY) The Acting Chaiiman announced that this was the time and place for a Public Hearing on the petition of William IVear for a Conditional Use Permit (Service Station) for property located at 2260 Wayzata Boulevard. The Zoning Administrator presented the Notice of Public Hearing and the Affadavit of Publication. Mr. Wear was present and explained that the service station would be in the frcHit of the building. This would be self- service with the customers pa>ing inside the mini mart. Mr. Todd Fruen, a property owner to the west of this appli­ cation, informed the Conmission that a restrictive covenant had beei. set up by the property owners. Mr. Fruen stated that he was not opposed to the mini mart; however, he did feel that there was no need for this 24-hour service as it would only be a nuisance. The Zoning Administrator infoimed the Planning Conmission that we were not involved with restrictive covenants and could address only through zoning. Mr. Wear then stated that the restrictions had been removed from the deed. Member McDonald was concerned about the amount of traffic involved with this service station. Mr. Michael, attomey for Mr. Ifear, stated that he felt they would be catering to the traveling public which would generate the same kind of traffic as the mini mart. After all the public were heard, the public hearing was continued until the next Planning Canmission meeting. Acting Chairman Hannah called to order the Regular Meeting of the Orono Planning Conmission. WILLIAM WEAR 2260 WAYZATA BOULEVA’d) CONDITIONAL USE PERMIT (SERVICE STATION) CALL TO ORDER - 8:30 P.M. REGULAR MEETING Hosfield moved, McDonald seconded, that the minutes of the Planning Conmission meeting of August 2, 1976, be approved. Motion - Ayes (5), Nays (0). APPROVAL OF MINUTES MEETING AUGUST 2, 1976 The Planning Commission proceeded to discuss the subdivision application of Gerald Parten. Member McDonald was concerned about drainage at the existing road. The Parten's informed bfejnber McDonald and the Conmission that there is now a culvert under the gravel road. Hake moved, Hosfield seconded, to reconmend approval of this subdivision subject to a park dedication fee and final plat to be submitted, and on the condition that the County approve of any new access to the north parcel. Motion - Ayes (5), Nays (0), GERALD PARTEN 985 TCMCAVA ROAD SUBDIVISION (PRELIMINARY) J m m MINUTES OF A PLANNING CCMMISSICN MEETING. HELD AUGUST 16, 1976 - PAGE 3 The Zoning Administrator again reminded the Coimission of the 0?imty's concem of the proposed access to this sub­ division, After some discussion, Hannah moved, Woolley seconded, to grant approval of this subdivision subject to a park dedication fee, approving solely the subdivision as stated, being cognizant of the letter from Donald Muiphy of Hennepin County, and that any conceptual approval or reasonable solution of this condition by the County should come back to the Planning Comnission. Motion - Ayes (5), Nays (0). Member McDonald once again expressed her concem of the heavy amount of traffic that would be driving in and out of Ais mini mart. Mr. Wear stated that traffic was his business. He also told the Planning Comnissicn that he had contacted the State Hi^iway Department, and they did not feel there would be any traffic problem at this location. Councilman Norman Paunjs was in attendance at this meeting to inform the Commission of the action that was taking place on the following items: Gray*s By Dam - Project was started tlire*^ years ago. A control dam near the freeway in Minnetonka had been considered. A major ccaicem was who would control it for the flood in the spring and the drought in the fall. The new dam will be located down stream from existing dam. Tanager Bridro - ^fayor Searles, Dick Benson and Norman Paurus met with the County. Their plans are for a 36' bridge which would consist of two 12 ♦ lanes rnd two 6' bike lanes. The soutlieasterly portion of the bridge would be m the same location. The northwesterly portion of the bridge would be moved somewhat which would cause cutting into the landscape. This would be kept to a minimum. ^ng Route - The County would like to get into straighten ing out #110 before tlie City does anything en #19. The County's plans are north on #110, east cm County Road 6 a year or tivo later. The City would support this. ROBERT NIICHEL 3175 SIXTH AVENUE N. SUBDIVISICN (PRELMNATOf) IVILLIAM IVEAR 2260 WAYZATA BOULEVARD CONDITIONAL USE PERMIT (SERVICE STATION) NORMAN PAURUS GRAY'S BAY DAM TANAGER BRIDGE RING ROJIE i It L MINOTES OF A PLANNING C0M4I^|JN MEETING HELD AUGUST 16, 197^PAGE 4 James Boerhave of Bather, Ringrose, Wolsfeld presented the revised drainage plans to the Planning Commission. He ^cplained that there wasn’t much of a change in these plans. There is still ^e same major break. An overflow pipe would be installed which would carry the drainage toward the swanp. Mr. Lyman, a neighbor to the south of the proposed subdivision, was present, ftice again he expressed his concern about the drainage of this area onto his property. There is a potential for a runoff problem, and he was concerned about the possible increased runoff which might be caused by the initial develop­ ment and future development. Mr. Boeihave explained to him that they had developed collection points and drainage ease­ ments to take care of this runoff. Mr. Lyman understood that these easements are shown on the map, but he wanted to be assured that they are maintained. nie ^veloper requested that the road to this subdivision be public. He infoimed the Planning Conmission that banks were no longer issuing conventional mortgages on homes with private roads. The Planning Commission requested a written statement to this effect. After considerable discussion, Hake moved, Hosfield seconded, to recommend approval based on the folloi/s: 1. 2. 3. Seme substandard lot widths due to a desire for con­ servation of the existing wetlands. The understanding that only Lots 5, 6, and 7, Block 1, will have lake access. The request is for a public road with a 60' right of way (conditioned on the review and approval of the City Engineer and Attorney). Subject to: 1. 2, 3. City Engineer's approval of drainage plans. City and County approval of access locations for the proposed street (and also for access to Lot 1, Block 3, when a residence is proposed for that site). Submission of final plats for approval and payment of a park dedication fee. Motion - Ayes (5), Nays (0). Fbimer Orono Policeman Red Daniels was present at the meeting tc express his concern and conplaint about the inconsistency in the hours and days in vhich members are allo;ved to shoot. No one from the Park Gun Club was in attendance to present their application. Hake moved, Woolley seconded, to table this application until the next meeting and that staff send a letter to the Park Gun Club requesting a representative appear and suggesting that it is to their advantage to present their own case for approval of their conditional use permit, ftotion - Ayes (5), Nays (0). CHARLES VELIE (DAVE NITZ) 2905 FCDC STREET SUBDIVI SION- PRELIMINARY PROPOSED DRAINAGE PLAN PARK GUN aUB 3660 SIXTH AVENUE N. CONDITIONAL USE PERMIT REVIEW OF EXISTING OPERATION i MINUTES OF A PLANNING OTMISSION MEETING HELD AUGUST 16, 1976 - PAGE 5 Hie Zoning Administrator explained to the Commission that the Heroux*s were relating two variances (front setback and setback from residence) to build a two-story garage. He felt the following problems might result from the proposal as submitted: (1) Possible ccxmercial use of a garage of this size. (2) Second stoiy above garage could provide second residence on a single parcel. (3) IWo-story structure would obstruct the vision of the residence on the west. Gould consider approving if the proposed structure were to be built smaller and lower with the condition that the existing garage be removed because it is non-confoiming as it extends over the property line onto City Row. Mr. Heroux was present. He explained to the Conmission that the garage was to be used for several cars he owned. The second story of the garage would be used for storage as he does not have a basement . He also stated that the view of the neighbor to the west would not be obstructed because of the two-story structure, but by a 6’ fence which he planned to put up. After some discussion, Hannah moved, Woolley seconded, to reconinend approval of this variance on the condition that the second story be for stora^ only and the existing garage be removed within 30 days of the ccHnpletion of the new garage. Motion - Ayes (3), Nays (2) Hake, Hosfield. KEN HEROUX 4445 NORIH SHORE DRIVE VARIANCE - RIGHT OF WAY SETBACK AND SETBACK BETWEEN STRUCTURES Hank Muhich stated that this application was similar to the variance request of the Heroux*s. Mr. Muhich felt this addition wcxild be an improvement to the existing conditions. However, he did stress that the non-conforming garage on the property nc^^ should be removed eitiier by resolution or removed before a building peimit is issued for a new garage. Hosfield moved. Hake seconded, to approve this variance provided tlie existing garage is removed prior to the issuance of a building peimit or that the title opinion be approved by the City Attorney requiring removal after construction. ^fotion - Ayes (5), Nays (0). The Zoning Admroistrator explained to the Planning ConroissiOT that the Benedict's were requesting approval of variances to add to the existing dwelling including an attached garage. Mr. Benedict agreed to remove the existing non-confoiming garage and would be willing to remove it before commencing with the proposed addition.
