Mr. Becker is requesting preliminary approval of the subdivision of a 12 acre
parcel adjoining the north property line of thq Wayzata Cotntry Club Golf
Course.
Ihe proposal as submitted consists of 5 parcels with a private road and
cul-dc-sac. The owner has been notified that he would be required to grant
to the City of Orono easements over these private approaches. The survey
includes sane wetlands, but these marsh areas have been deducted in calailat
ing tlie areas of the individual parcels.
I don't believe these 4 additional sites will have much of an impact on the
traffic on Femdale.
Several items to consider on this proposal are:
1.Lot area variances will be required for 2 of the lots.
Ihe 200' lot width requirement will be determined by
properly locating the ilwelling.
5.^linimum setback requirements will have to be met for any
future constiuction.
Mr. Becker has been informed of the Park Dedication Fee requirement. ($250
per lot or $1,250 total.)
Mr. Becker is the applicant, but the assessor's records show a Harold L.
Holden as the owner aild homesteader of the property.
The Planning Comnission should schedule a Public Hearing on this matter.

Mr. \icar is constructing a retail service center at the alcove location. The
structure is near completion.
He is now requesting approval of a Conditional Use Permit to add self service
gas pianps for retail sales in conjunction with the other retail sales services.
Motor fuel stations require a Conditional Use Permit in a B-1 zoned district
(Section 35.022), and if approved must comply with all requirements as listed
under Section 38.500 of our zoning ordinance.
I would recommend we liold a l\iblic Hearing before any action is taken.

1, Copy of Building Peimit #2907 dated 12/5/70 - $15,000. Note that this
penait covers only foundation and exterior wall work - no roof, windows
or finish. No other interior plunt>ing, finishing or sewer or water
hookup permits are on file.
2, There is no complete set of plans on file for this project. Tlie pre-
liminar>' drawings that are in the file indicate no interior finish or
final exit locations. Tlie plans indicate a slab on grade building.
The plans do not bear an ardiitect’s signature as required by State
law for all non-residential buildings with a value greater than 550,000.
3, The actual ccxistruction includes a full basement. The exterior walls
are i^, but the roof has not been started. To date there is no interior
partitioning or plumbing; however, there is sewer and water stubbed into
the southeast comer of the basement. Tlie water is on; there is no
meter (and no permits or inspection reports on the hookups).

REGULAR PLANNING C(»WISSI(»I MEETING HELD AUGUST 16, 1976
The Orono Planning Conmission met on the above date with the
following members present: Acting Chaiiman Gregg Hannah,
Members George Hosfield, John Hake, Gloria McDonald and
Zoning Administrator Hank Muhich. Gene Woolley arrived at
8:25 p.n.
ATIENDANCE - 7:50 P.M.
Acting Chairman Hannah announced that this was the time and
place for a Public Hearing on the petition of Gerald Parten
for a siAdivision of property located at 985 Tonkawa Road.
The toing Administrator presented the Notice of Public
Hearing and the Affadavit of Publication.
Hank Hdiich explained that the original proposal was to
subdivide the 5+ acres into three lots and that the Parten's
had changed this request to two lots both exceeding two
acres. Carl Parten, a brother of the petitioner and neigji-
bor to the south, was concerned about the swan^) area on the
rear lot. He felt that this wild area should not be
destroyed if a new road were built. Mrs. Gerald Parten
explained that the road to their property is already there.
Therefore, no new road is required on the south lot. Another
nei^ibor, Ken Weestrand, was concerned about the lake setbacks
for ffliy new homes that were built. He was concerned about
^ssible obstruction of his view. The Planning Commission
informed him that the lakeshore setback requirements are 75'.
The suggestiOT was made to try and line up the homes. After
all the public were heard the public hearing was closed at 8:05 p.m.
The Acting Chairman announced that this was the time and
place for a Public Hearing on the petition of Robert Niichel
for a subdivision of property located at 3175 Sixth Avenue N.
The Zoning Administrator presented the Notice of Public
Hearing and the Affadavit of Publication.
Hank Muhich stated that this petition is located in a 2
acre zoning district and tiiat Mr. Niichel is requesting
approval of subdividing this parcel into 5 lots, each
exceeding five total acres. Mr. Muhich also informed the
Commission that he had received a letter from Donald Murphy
of Hennepin County regarding the proposed access to this
subdivision. The si^t distance required to safely enter
highway is 845' to the left. The actual sight distance to
the left is 450'. Because of this limited sight distance,
the County has reccminended that the proposed access be
relocated to a more safe location.

Robert Niichel and his attomey, Bob Ntary, were present at
the meeting. They explained that no other property was
available to relocate the access point. Mr. Niichel also
stated that a cliange in the access would destroy his
original plan. They recognized the concern of the County,
and hoped that the County would understand their situation.
After all the public were heard, the public hearing was
closed at 8:20 p.m.

located at 2260 Wayzata Boulevard. The Zoning Administrator
presented the Notice of Public Hearing and the Affadavit of
Publication.
Mr. Wear was present and explained that the service station
would be in the frcHit of the building. This would be self-
service with the customers pa>ing inside the mini mart.
Mr. Todd Fruen, a property owner to the west of this appli
cation, informed the Conmission that a restrictive covenant
had beei. set up by the property owners. Mr. Fruen stated
that he was not opposed to the mini mart; however, he did
feel that there was no need for this 24-hour service as it
would only be a nuisance. The Zoning Administrator
infoimed the Planning Conmission that we were not involved
with restrictive covenants and could address only through
zoning. Mr. Wear then stated that the restrictions had
been removed from the deed. Member McDonald was concerned
about the amount of traffic involved with this service
station. Mr. Michael, attomey for Mr. Ifear, stated that
he felt they would be catering to the traveling public
which would generate the same kind of traffic as the mini
mart. After all the public were heard, the public hearing
was continued until the next Planning Canmission meeting.
Acting Chairman Hannah called to order the Regular Meeting
of the Orono Planning Conmission.

APPROVAL OF MINUTES
MEETING AUGUST 2, 1976
The Planning Commission proceeded to discuss the subdivision
application of Gerald Parten. Member McDonald was concerned
about drainage at the existing road. The Parten's informed
bfejnber McDonald and the Conmission that there is now a
culvert under the gravel road. Hake moved, Hosfield
seconded, to reconmend approval of this subdivision subject
to a park dedication fee and final plat to be submitted,
and on the condition that the County approve of any new
access to the north parcel. Motion - Ayes (5), Nays (0),

The Zoning Administrator again reminded the Coimission of
the 0?imty's concem of the proposed access to this sub
division, After some discussion, Hannah moved, Woolley
seconded, to grant approval of this subdivision subject to
a park dedication fee, approving solely the subdivision as
stated, being cognizant of the letter from Donald Muiphy
of Hennepin County, and that any conceptual approval or
reasonable solution of this condition by the County should
come back to the Planning Comnission. Motion - Ayes (5),
Nays (0).
Member McDonald once again expressed her concem of the
heavy amount of traffic that would be driving in and out
of Ais mini mart. Mr. Wear stated that traffic was his
business. He also told the Planning Comnissicn that he

not feel there would be any traffic problem at this
location. After some discussion, McDonald moved. Hake
seconded, to table this application until the next meeting

Councilman Norman Paunjs was in attendance at this meeting
to inform the Commission of the action that was taking
place on the following items:
Gray*s By Dam - Project was started tlire*^ years ago. A
control dam near the freeway in Minnetonka had been
considered. A major ccaicem was who would control it for
the flood in the spring and the drought in the fall. The
new dam will be located down stream from existing dam.
Tanager Bridro - ^fayor Searles, Dick Benson and Norman
Paurus met with the County. Their plans are for a 36'
bridge which would consist of two 12 ♦ lanes rnd two 6'
bike lanes. The soutlieasterly portion of the bridge
would be m the same location. The northwesterly portion
of the bridge would be moved somewhat which would cause
cutting into the landscape. This would be kept to a
minimum.
^ng Route - The County would like to get into straighten
ing out #110 before tlie City does anything en #19. The
County's plans are north on #110, east cm County Road 6
a year or tivo later. The City would support this.

James Boerhave of Bather, Ringrose, Wolsfeld presented the
revised drainage plans to the Planning Commission. He
^cplained that there wasn’t much of a change in these plans.
There is still ^e same major break. An overflow pipe would
be installed which would carry the drainage toward the swanp.
Mr. Lyman, a neighbor to the south of the proposed subdivision,
was present, ftice again he expressed his concern about the
drainage of this area onto his property. There is a potential
for a runoff problem, and he was concerned about the possible
increased runoff which might be caused by the initial develop
ment and future development. Mr. Boeihave explained to him
that they had developed collection points and drainage ease
ments to take care of this runoff. Mr. Lyman understood that
these easements are shown on the map, but he wanted to be
assured that they are maintained.
nie ^veloper requested that the road to this subdivision be
public. He infoimed the Planning Conmission that banks were
no longer issuing conventional mortgages on homes with private
roads. The Planning Commission requested a written statement
to this effect.
After considerable discussion, Hake moved, Hosfield seconded,

The request is for a public road with a 60' right of
way (conditioned on the review and approval of the

Fbimer Orono Policeman Red Daniels was present at the
meeting tc express his concern and conplaint about the
inconsistency in the hours and days in vhich members
are allo;ved to shoot. No one from the Park Gun Club
was in attendance to present their application. Hake
moved, Woolley seconded, to table this application until
the next meeting and that staff send a letter to the
Park Gun Club requesting a representative appear and
suggesting that it is to their advantage to present
their own case for approval of their conditional use

Hie Zoning Administrator explained to the Commission that the
Heroux*s were relating two variances (front setback and
setback from residence) to build a two-story garage. He felt
the following problems might result from the proposal as
submitted:
(1) Possible ccxmercial use of a garage of this size.
(2) Second stoiy above garage could provide second
residence on a single parcel.
(3) IWo-story structure would obstruct the vision of
the residence on the west.
Gould consider approving if the proposed structure were to
be built smaller and lower with the condition that the
existing garage be removed because it is non-confoiming as
it extends over the property line onto City Row.
Mr. Heroux was present. He explained to the Conmission that
the garage was to be used for several cars he owned. The
second story of the garage would be used for storage as he
does not have a basement . He also stated that the view of
the neighbor to the west would not be obstructed because of
the two-story structure, but by a 6’ fence which he planned

removed before a building peimit is issued for a new garage.
Hosfield moved. Hake seconded, to approve this variance
provided tlie existing garage is removed prior to the issuance
of a building peimit or that the title opinion be approved
by the City Attorney requiring removal after construction.

The Zoning Admroistrator explained to the Planning ConroissiOT
that the Benedict's were requesting approval of variances to

Mr. Benedict agreed to remove the existing non-confoiming garage

proposed addition. Hank also mentioned that he had received
several calls from neighbors concerning the cars that were

Dave Williams, a neighbor, stated that this home has been
under construction for about one year. He understood that
they had some problems, and he did feel that they were
trying to inprove their property. However, he was wonder
ing if they could make some effort to clean up the back
part of the house. Among other things, he mentioned
several cars and boats that weir stored on their property.
Mrs. Benedict was present and explained that they were
stoiing the boats for a friend of their son’s until he
could make arrangements to store them elseidiere. Her
husband does have a couple of cars which he uses for
spare parts. Because of the high cost of having garbage
hauled away, they did accumulate a variety of different
items of trash until they had enough for one load.
Eoke moved, Hosfield seconded, to recemimend approval of
this non-conforming lot size for the proposed addition
based upon the fact that the lot area cannot be expanded,
no setback variance is required, area is sewered, property
owners tear down non-conforming garage prior to obtaining
a building permit and that the owners make an effort to
iifprove the appearance on the outside of the house.

Because this is a renewal of an expired variance, Hake
moved, Hosfield seconded, to reccmimend approval of this
variance based on the same conditions mentioned in the

The Zoning Administrator informed the Planning Commission
that ^dina had decided to cancel the meeting between the
Villages. Someone fran the Medina CcHimission had cone
into the Village Office to pick iq) minutes on our Planning
Comnission and Council meetings. They felt that Orono was
in agreement with Medina on this proposed Vo-Tech School.
The Medina Pluming Comnission will be sending the minutes
of their meetings to Orono. All Planning Commission
menbers present were opposed to the Hennepin County Vo-
Tech proposal.

The Park Gun Club is requesting approval to continue their present operation.
This request requires a Conditional Use Permit.
We’ve recently received several complaints about the operation from nearby
residents so Council might review and reconsider this ret]uest before extend
ing this permit. TTie complaints include maintenance, days and hours of
operation, and extent of operation.
1 am enclosing a copy of the ordinance regulating the operation. Wc might
consider adding a few conditions in order to eliminate any furtlier complaints.

The applicant is requestinR approval of siMividing parcel (2815) into two
lots (1 f» 2). Tliis parcel is located on the N.F. quadrant of the intersection
of County Doad ^15 and I<1^. Tlie area nearest the intersection is r.oncd com
mercial (13-1). Tlie remainder is incliuHne the marsh and is zoned residen
tial (LI\-1B). Ihe proposed subdivision would follow the border line between
the two zones. F.ach parcel would therefore lie in its ov%t» respective zoned
district.
Lot 1 would consist of 710nn square feet of commerciallv zoned land. The major
portion of lot 2 is marsh. No 1-uiIdinn permit could be issued on this lot
unless it qualifies under the ordinance. TIic developer has not indicated any
desire to develop this parcel as vet. h'e might suggest a conservation ease
ment on lot 2.
r would recommend approval of the subdivision as it would divide the two oor-
mitted land uses.
T was not atvare of the filling and grading that has been going on in the
adjoining area in Minnetonka Reach until T made a site inspection. It appears
that some of the grading has extended into the Orono area.
We should resolve this problem while considering this subdivision proposal.
If lot 2 can be considered a buildable residential site a park dedication fee
would also be forthcoming. However, if we do obtain a conseivation easement
we could waive this fee.

is now at the bottom of the slope into the marsh, whereas the C.onBnissiou

Staff was instructed to consult the City F.nginoer to determine and correct if
necessaiv the legal description of the dividing line. Rezoning may be recjuired.

existing home: (1) lot area from 43,560 sq. ft. to 10,000 sq. ft. on exist
ing lot, (2) lot width from 140' to 70', and (3) side setback from 10' to
5*.
They have requested that the Planning Comnission take action on the proposal
as early as j^sible. I did not include this as a work session item on the
last agenda as the application was submitted late Friday, August 13, 1976,
only one work day prior to our Planning Commission meeting of August 16, 1976.
I had no time to investigate and make a report for that meeting, and that is
idiy it is on this agenda as a work session item.
The proposed addition would be set back about S' from the side property line.

Variance - Addition to residence on ncn-conforming lot and
side yard setback
The Farley’s are requesting three variances to build an addition to their
existing home: (1) lot area from 21,780 sq. ft. to 8,300 sq. ft., (2)
lot width from 100* to 50', and (3) side setback from 10' to 8'.
The proposed addition consists of a second story to the existing dwelling.
The neighbor's house to the south is presently located about 20' from this
common property line.

This property i‘i located on the northeast quadrant of the intersection of
County Roads and 19, currently occupied by a Texaco Station. The Planning
Conmission recently conceptually approved a Burger King proposal made hv John
Lambin subiect xo sc\^ral conditions.
One of the condivions was to resolve any problems that might result from the
traffic congestion at tlic intersection of County Roads 15 and 10. 'Ihe sul)ject o'*
ingress and egress will have to be cleared through the County.
Besides the Conditional Use Permit approval, the proposal also requires a
variance from Ordinance Section 08.510 which limits the numJ)er of ser\ucc
stations for an intersection. To remove the existing station and construct a
new facility would constitute a new proposal arul, therefore, require a variance
from Ordinance >*38.510.
