REOJLAR PIAM4ING COM^SSION MEETING HELD AUGUST 2, 1976
The Orcno Planning ConinissiDn met on the above date with
the following members present: Chaiiwoman Diane Dunlap,
Members George Hosfield, Brad Van Nest, John liake, Gregg
Haiu^, Gloria TfeDonald, C. Paul Pesek and Zoning
Administrator Hank Mihich. John Guthrie arrived at
8:00 p.m.
ATTENDANCE - 7:34 P.M.
Chairwoman Dunlap announced that this vtas the time and
the place for a Public Hearing on the petition of
Qiarles Velie for a subdivision of property located at
2905 Fox Street. The Zoning Administrator presented
the Notice of Public Hearing and the Affadavit of
Publication.
James Boerhave of Bather, Ringrose, Ifolsfeld and
itevid Nitz presented a map of the proposed subdivision.
Tms proposal is similar to the one proposed in 1974
vidth the exception that the outlet has been eliminated,
fir. Boerhave explained that an overflow pipe would be
tailed which would carry the drainage toward the
sw^ in the lower area of this property. He felt that
this system would take care of the runoff. Member
Vm Nest expres^d his concern about the drainage to
the south of this property. Mr. Lyman, a neiglibor, was
®iso concerned about the drainage. He presented a map
to the Planning Commission of the area surrounding his
property which would be affected by this proposal,
w. Lyman h^ been living here for 25 years. He explained
that there is a natural flow of water in this area and
there has been no change in the land for the past 60
>^ars. Hay and other natural grasses soak up tlie water
here and if there is any runoff, it is soaked up by the
tose brush ^d trees. Mr. Lyman was interested in
knowing if there would be a change in tlie flow of water
when homes, driveways and tennis courts were to be built.

the drop ofr do^m to the lake. Runoff after a rain now
c^s to the surface of his driveway. Another concern

imch of this drainage as possible should be diverted to
the east to eliminate any hardship to the surrounding

There ms some discussion as to wliether the road to this
subdi^sion should be private or public. The proposal
includes a 50' access easement for a private road.

the next meeting to allow the developer to produce
revised plans for drainage to the south and east and
^e metliod of drainage of the northwest comer down to
tile lake. This wuld be subject to review by the city

Chairwoman Dunlap called to order the Regular Meeting of
the Orono Planning Coitinission.
Pesek moved, Guthrie seconded, that the minutes of the
Planning Comnission meeting of July 19, 1976, be approved.
Motion - Ayes (8), Nays (0).
Mr. Peterson explained to the Planning Conmission that lie
had purdiased this property/ about 1 year ago. He under
stood there were misunderstandings, but felt that the
problems had been solved. The Peterson's purchased this
property in good faith.
Pesek moved. Van Nest seconded, to approve this variance
because it is after the fact and the pool has been there
for the past three years. Pesek felt that this was not a
violation by the Peterson's idio purdiased the property only
one year ago. They were unfortunate to inherit an existing
non-confoiming situation ivhich was never before brought to
the attention of staff. Motion - Ayes (8), Nays (0).
Mr. Curtis was in attendance and presented pictures of his
property. After a short discussion, McDonald moved, Pesek
seconded, to grant appiv>val of this variance because the
proposed addition wuH be replacing the substandard leanto
portion of the house and it would in no way encroach on the
existing setbacks, ^fotion - Ayes (8), Nays (0).
The Zoning Administrator presented the building plans to
the Comnission. Mr. Ryan was present to explain his plans
for this addition. Van Nest moved, Guthrie seconded, to
reamnend a^^roval subject to providing fire separations
as r^uired by the State Code and the combination of all
the individual parcels and vacated street. The subject
of the vacated street should be referred to the at^'>mey
to resolve its actual status.
Mr. 6 Mrs. Smith were in attendance. Mrs. Smith explained
to the Conmission that at the start of the construction
they instructed the contractor not to disturb the trees
that were on the property in order to build the house.
The location of the house was then moved over to avoid
removing the trees. The inspector was never informed
of the diange in location. Larry Shaw, a neighbor to
the north of tlie Smith's was also present at the meeting.
He expressed his disappointment with tlie building of tliis
haiie. He mentioned that he complained several times to
the building inspector regarding the building location.
The present location of the Smitli's home blocks his view
of the lake. The Planning Commission felt that the only
question here was the rear yard setback as the new
location still met all sideyard setback requirements.
Pesek moved, Hake seconded, approval of this variance
because the house is finished. However granting this
approval does not constitute approval for a private dock
on the shoreline strip directly across the street.

Mr. Joe ^bovsky was present and interested in knowing what
this variance was about. The Zoning Administrator informed
the Conmission and ^fr. Labovsky that Mr. Norwood was request
ing an approval of a variance of 176 sq. ft. in area to
build a 42* x 28' garage. This garage i>iould be used for
storing his recreational equipment such as boats, canpers,
snowmobiles, etc. Van Nest moved, (koinah seconded, to
recommend approval on the basis there has been no com
plaint on the proposal and all the individual parcels
have been ccmibined after having paid up all delinquent
taxes. ftotion - Ayes (8), Nays (0).

Mr. Massengale was in attendance. The Zoning Administrator
pointy out tlie dimensions of the area. There is no way
the dimensions can be increased. Hake moved, Pesek
seconded, to approve this variance based on the fact there
is no other land avciilable and the area is sewered and has
v:ater. Motion - Ayes (8), Nays (0).
Mr. IVhitney is requesting approval of a variance to add to
liis existing residence. Van Nest moved, Hosfield seconded,
to recomnend approval in view of tlie fact that this house
alrea^ exists on a non-standard lot and the proposed
addition would not result in any encroachment of the exist
ing setbacks. Ifotion - Ayes (8), Nays (0).
Tlie Planning Commission scheduled a Public Hearing for
September 7, 1976, at 7:30 p.m.
Mr. Ricliards was present and explained to the Commission
that he was planning to remodel his kitchen and add a
second story over that part of his house. Van Nest moved,
McDonald seconded, to recommend approval of this variance
for lot size and width for this addition inasmuch as it is
consistent witli the neighbors and on the condition that no
additional variances will be required. Motion - Ayes (8),
Nays (0).
r-fr. 6 Mrs. Shaw were present. Mr. Shaw explained to the
Planning Conmission tliat he received a building permit
for his garage about tliree years ago, and at tliat time
felt the garage was being built within the required
setbacks. Hcike moved, Pesek seconded, to recommend
approval based on the fact that it was built three years
ago with the understanding that the location met all
setback requirements. Motion - Ayes (8), Nays (0).
The Planning Commission went into work sessions on the
Park Gun Club and Ken Heroux.

SUBJECT: Annual Street Cost
The Street Department does not keep a record of the cost per mile per year for
street maintenance. The reason being that there arc too many areas that are
unpredictable. The only figure that could be used soiild be ^6,500 per mile
per year and that figure is only approximate.

This is an f-xisting non-conforming situation. A.house and garage now occupy
whicii is only about 50 ft. wide and 8,000 so. ft. in area, ihe
existing house is approximately 5 ft. from the east lot line. The garage is
located 1.2 ft. from the street right of wav line and almost directIv on the
west property line.
Mr. Tanke is reetuesting the following variances to add to tlie existing lon-
conforming situation:
1. Area variance of 13,780 sq. ft. fran tlie required
21,780 sq. ft.
2. Lot width variance of 50 ft. from the reiiuiroO 100 ft.
He is also requesting variances for the newly pronose i garage ns follows:
1. Side yard setback variance of 7 ft. from the rcouired
10 ft.
2. Street right of way setback variance of 10 I t. from
tlie required 30 ft.
Mr. rankc has noted in his application that he would remove the existing non
conforming garage. T believe this would be an improvement to tlie existing
conditions, but I also believe we should have more assurance of removil either
by liesolution or removal before a building permit is issued for the new garage.
I lielieve wc could nvike a reconmendation on this proposal without a work session
review.

This pronerty is located on the northea st quadrant of t’le intersection of
Countv Roads 15 and 19, currently ocennied bv a Texaco Station. The Planning
Canmission recently conceptually anproved a Burger'Kinp proposal mad'' 1-y ,Jolir
Lanibin sul)iect to sevci'al conlitieps.
One of the conditions was to resolve any problems tiiat miejjt result from the
traffic congestion at the intersection of County Ronds 15 and 19. 'Hie sul>ject of
ingress and egress will have to be cleared through the County.
Besides the Conditional Use IV'nnit anuro'/al, the proposal also requires a
variance from Ordinance Section *?38.51(i wliich limits tlu* niirfior of service
stations for an intersection. To remove the existing station and construct a
noH' facility would constitute a new pn^posal and, tlierefore, require n variance
from Onlinancc ^58.510.

in this area presents quite a problem in that lots 6, S .md ' arc- all in

the problem by purcha;^ing lots 9 and ID. Lots ti, 7 am ’ D are still imiividua!ly

We should definitely consider combining lots 9, 10 and 11.
Although we could deny tlic request, I believe tlic proposal would be a definite
improvement in tlie area as the existing garage is so !>adly in need of repair.
We might consider reducing the width of the garage, however, so wc would
eliminate the visual obstruction resulting from the e'isting 6' setback from
Grand View Avenue. Appi-oval should be conditioned on the renovated building
meeting all building codes and combining of lots 10 and 11.
