A very similar proposal was made by Dicon in 1974 which was conceptually approved on Septeiri>er 10, 1974. The original proposal included an outlot for lakeshore privileges. This outlot has been eliminated on this pro­ posal, however. This new proposal consists of 19 new lots, plus the exception which now contains a dwelling. All the new parcels exceed the 2 acre (.87,120 sq. ft.) mininum, dry build^le area if the notations by the engineers are correct. Several of the lots are less than the required 200 ft. lot width. The proposal includes a 50' access easement for a private road. The developer has been informed of the requirement of a park dedication fee. I am enclosing copies of some of the Council and PI inning Cemnission minutes regarding the original subdivision proposal in 1974. A public hearing should be scheduled. K7 cm OF ORONO, MINNESOTA REGULAR PLANNING GOM4ISSION MEETING HELD JULY 19, 1976 The Orono Planning Coninission met on the above date vdth the following menbers present: Chaiiwonan Diane Dunlap, Menbers George Hosfield, John Guthrie, Gregg Hannah, Gloria McDonald, C. Paul Pesek and Zoning Administrator Hank Mibich. ATT aciiT.Vit B - 7:35 P.M. ‘X?’! Chairwoman Dunlap announced that this was the time and place for a Piblic Hearing on the petition of Robert ^Vyatt for a subdivision of property located at 4220 Watertown Road. Ihe Zoning Administrator presented the Notice of Piblic Hearing a& the Affadavit of Publication. Tbs. Wyatt's are requesting a stibdivision of their 9.49 acres into 2 parcel:^^ They are also requesting a Conditional Use Permit to move in another house and gar^e onto the south lot \4iich is already occupied by a residence. Mr. wyatt would like a period of IS months to remove the existing residence. He explained to the Goomission that his mother had died recently, and because he works and is a student he does not Iiave the time to remove her belongings before this time. Qiairwoman Dunlap called to order the Regular Meeting of the Orono Planning Commission. PUBLIC HEARING - 7:35 P.M. ROBERT WATT 4220 WATERTOWN ROAD SUBDIVISION CALL TO ORDER - 7:40 P.M. REGULAR MEETING •V4 Hannah moved, Guthrie seconded, that the minutes of the Planning Commission meeting of June 21, 1976, be approved. Motion - Ayes (6) - Nays (0). APPROVAL OF MINUTES MEETING JUNE 21, 1976 Guthrie moved, Hosfield seconded, that the P'* anning Coninission reconmend to the Council approval of this subdivision and to grant the 18 months needed to remove the existing residence. The Zoning Administrator mentioned that this would be subject to the Park Dedication Fee. Motion - Ayes (6) - Nays (0). RCBERT WTATT 4220 WATERTOWN ROAD SUBDIVISION The Zoning Administrator presented the hardshell to the Coninission. Hannah moved, Pesek seconded, to reconmend iqiproval of this final plat subject to the Park Dedication Fee. Motion - Ay^ (6), Nays (0). The Zoning Administrator presented the mylar to the Coninission. Pesek moved, Guthrie seconded, to recommend approval of the final plat subject to the Park Dedica­ tion Fee. This appro>4d does not constitute approval of the proposed P^ development as the necessary plans and data have not as yet been submitted for review. TOM GIERE 350 NORTH ARM LANE SUBDIVISION (FINAL HARDSHELL) DAN LINDSAY (KELLY AVENUE HOLDING CO.) 2505 KELLY AVENUE SUBDIVISION (FINAL HARD­ SHELL) 1 MINUTES OF A PLANNING COMMISSION ^CETING HELD JULY 19, 1976 - PAGE 2 Hank Miihich stated that a meeting had been held earlier today at the Village Offices between John Holmquist of the Minnehaha Creek VKatershed District; Rod Hillstrcm, Ryan Construction; Rick Sathre, City Engineer; Dick Benson and Hai^ Muhich. The Minnehaha Creek Watershed District was concerned that the proposed grading and drainage plan could result in higher rate and lower quality runoff than now exists. At this meeting, it was agreed that a french drain system would eliminate this problem. This system would consist of digging 4-5' trenches and adding a layer of 3” rock through the lower area under the surface grating. Quality would be controlled by grading down to a finer material before going into the storm sewer. Rod Hillstrcm and Frank Zelley of I^^an Construction were present at the meeting. They submitted a statement regarding fulfilling M.C.W.D. requironents for the rate and quality of runoff. They will work with this system and submit for approval. Hillstrcm infoimed the Ccmmission that there would be some water retention on the roof, but only for a short period of time. Pesek moved, Guthrie seconded, to approve site plan and elevation based on the stipulation that it satisfies the Minndiaha Creek Watershed District and our city engineer as an adequate filter system. Dunlap suggested that any erosion pi^lems be corrected as they come up. Tlie Zoning Administrator infoimed Ryan Construction and the Conmission that the unpaid sewer and water unit charges assessed against the property would have to be paid before the building peimit is issued. RYAN CONS'. ?WriON (SUPER VALL) 3333 SHORELINE WOVE BUILDING ELEVATION 6 SITE PLAN APPROVAL i t\ John Lamb in, contractor, and George Hanson were present. Lambin presented the plans to the Conmission for the con­ struction of a new home. They pleaded hardship to the land because of an approximate 25' drop. There was some discussion regarding moving the street. Dunlap moved, Pesek seconded, to approve this variance subject to changes in the plan whereby the two remaining substandard parcels would be eliminated. Two alternative suggestions were made: ^tove location of unplatted street and combine all three parcels, or Grant to the City a conservation easement over the two substandard lots. Motion - Ayes (6), Nays (0). GEORGE HANS(»I BIG ISLAND VARIANCE - LOT AREA, WIDTH § LAKESHORE SETBACKS The Zoning Administrator informed the Commission that because of the cancellation of the July 6tli meeting, he had conducted a telephone poll of the Council and Ccmmission Members to get the necessary approval of this variance. Guthrie moved, Hannah seconded, confirm­ ing the telephone poll vdiich was taken last week by Hank Muhich and approving the request for variance. MRS. WARD PARTEN 1020 TXMCAWA ROAD VARIANCE - LOT WIDTH % IvUNl/TES OF A PLANI4ING CCMvUSSIQN MEETING HELD JULY 19, 1976 - PAGE 3 He also suggested that the Council take steps to prevent future violation of the Long Lake Fire Department such as burning a building without first obtaining a razing permit. Motion - Ayes (6), Nays (0) Mr. § Mrs. Parten were present for their request to sub­ divide a 5 acre parcel into 3 one acre lots. The Zoning Administrator noted to the Planning Conmissibn that this district was rezoned to LR-IB on January 1, 1975. This deteimination was made only affer an extensive study revealed that many of the existing residences with on-site sewage disposal systetiis were having, problems bf seepage and pollution. After ^tbitdning the difficulty in providing an ad^uate private ^waj^e system oh one atr^ lots, the Council agreed that the existing problem definitely jeopardized the healthy safety and welfare of the public. It was deteimined the best solution was to install a ntudcipal s^r system ih the atea. After eliminating this pollution problon, the Council agreed this district could be rozoned to LR-IB (1 acre) residential. The Parten *s were reminded of the Park Dedication Fee related with all subdivisions. They were also informed that one additional sewer unit charge of approximately $3,800 would be assessed against the property as only two units were projected on the property on the original assessment role. This additional unit charge would have to be paid at the tdjie of approval of the subdivision, along with the Park Dedication Fee. The City could not afford the time and expense of adopting a new assessment role. After learning of this, the Parten's requested we withdraw the original proposal and change it by eliminating the third lot on the southeast comer of the property. The Planning Commission scheduled a Public Hearing for August 16, 1976, at 7:30 p.m. MRS. WARD PARTEN (continued) GERALD PARTEN 985 TONKAWA ROAD SUBDIVISI®^ (PRELIMINARY) H Robert Niichel was present. Chairwoman Dunlap explained the procedures involved before a decision could be made on his subdivision. Mr. Niichel expressed his dissatisfaction with the lengthy proceedings. The Planning Conmission scheduled a Public Hearing for August 16, 1976, at 7:45 p.m The Planning Commission scheduled a Public Hearing for August 16, 1976, at 8:00 p.m. Mr. Ifear arrived shortly after this announcement and Chairwoman Dunlap infoimed him of the scheduled Hearing. Mr. Wear also told the ^mmission that he was upset with the amount of time involved for final approval. ROBERT NIICHEL 3175 SIXTH AVENUE N. He mentioned that his plans were not ccnqplete, and the Conmission informed him that they would have to be complete a^ correct by Friday, July 23, in order for the Planning Commission to be able to review before acting on the proposal at their next meeting. Guthrie moved, Hosfield seconded, to a^rove tljiis variance due to the fact that no additional lapd is available for expansion and the area is sewered. > Motion - Ayes (5), Nays (0), Abstain (1 * McDonald). The Zoning Administrator infoimed the Planning Commission that this item had been cancelled. Mr. Johnson decided to move and requested that his $30 application fee be retumed. Hank recommended the refund be denied as staff had completed all reviOw and reports. Ihe Planning Conmission ma<ie the suggestion to Hank ^^uhich that he contact the City Attorney, Bruce Malkerson, before the next meeting as to his recommendations on this variance. Pesek moved, Guthrie seconded, approval of this revised preliminaiy plat subject to determining a Paik Dedication Fee. Motion - Ayes (6), Nays (0). Final approval of the PRD proposal was flayed until detailed plans of the entire concept are submitted. The Planning Commission ivent into work sessions on Wayne Peterson and Michael Curtis. ^i:Donald moved, Pesek seconded, to eliminate the Council’s original referral of Planning Cernmission proposals in order to expedite the proceedings. 'fhe Commission feels this would promote better public relations. ^totion - Ayes (6), Nays (0). Steve Felsenberg of the David C. Bell Company was present r.nd asked the Commission if he could discuss something that was not on the agenda. He informed the Planning Commission that Drs. Zinn and Dale owned 13 acres of land near Watertown Road and County Road 6. He was interested in knowing how they could subdivide this property. After some discussion, the Planning Conmission advised that he could submit a subdivision application for 2 lots of 5+ acres. Althoufj^ I have no building plans yet, he informs me that the setback between the structures would be only 4*. This would require a variance of 6* as our ordinance requires 10' between structures. This would not create a problem as we could treat the garage as an attached garage and require the necessary 1 hr. fire wall in the garage to provide an adequate fire separation between structures. The existing j^rage extends over the lot line onto the vacated Oak Place. Therefore, I would recomnend we include the condition t^t the SH lots and the vacated street be combined into one parcel. A subdivision would then be required before any future proposal for additicmal building sites could be approved by Council. July 27, 1976 Proposed building plans have been submitted. I have only one copy, hovever, and it is too large for duplicating facilities. Mr. Norwood wants to build a 42* x 28* garage (1,176 sq. ft.). This would require a variance of 176*. Mr. Norwood informes me he is making this request for the purpose of storing and screening all his recreational equipment such as boats, campers, snow­ mobiles, etc., as well as his vehicles. This sounds like a re^onable request as it would eliminate open storage and possible complaints fn?m neighbors. Coincil approved a previous street setback variance the required 35* to 5* on November 24, 1976, subject to delinquent taxes being paid and the 1 lots be combined into one parcel. Chapter 80 of the flunicipal Code of Orono is hereby amended as follows: 80,010 Definitions, (a) "Firearms” shall mean any device from which is propelled any projectile or bullet by means of explosions or p.as. (b) Military type weapon" shall mean any firearm or other weapon such as bazookas, machine ^uns, mortars or prenades. (c) "Club" shall mean any p.roup of persons having a rot^ular inenibcrship and improved or permanent facilities for target or trap and skeet shootinf;, 80.020 Possession. No persvTii shall own, keep, carry or have possession of any military type weapon within the Village of Orono except persons on active duty as a member of a United States riilitary unit. 80.021 Transport of Firearms. No person shall transport any firearms within the Villaee of Orono unless such firearm is dismounro«l, broken apart, or carried in a closed case or is othmx'ise incanablc of beim* readily discharged. No nei son shall discharge any firearm within the vrjlage of Orono except (a) as other­ wise provided in tliis Chaiiter, (b) unless dischar.ged in lawful defense of person or property, or (c) be is a duly authorized law enforcement officer in the performance of his duty. 80.040 Permits. Permits authorizing the use of firearms shall be granted by the Village Clerk for the purpose and to the persons stated in this section if he determines that such use is not. contrary to the public safety or welfare and if the use thereof w.onld not constitute a . hazard to persons • nroperty or would not create a nuisance. The Clerk may attain conditions to the exorcise of the permit for the protection of the nubl ic interest or the interests surroundinp landowners if he deems it advisable. (b) for target shooting or trap and skeet shooting to individuals if used at least on a monthly basis. (c) for the training of dogs to clubs or individuals, which permit will allow this activity on land described in the permit by persons with the consent of the owner ox leasee thereof. (d) to clubs or individuals for the operation of a game and fur farm pursuant to Minnesota Statutes Section 99.27, or for the operation of a private shooting preserve nur- suant to Minnesota Statutes, Sections 100.32 to 100.37. (e) for control of nests, varmits, rodents or other animal nuisances, except that no hunting of game animals or game birds shall be allowed. 80.043 Permits, Occasional. Occasional ncrmits for a period of 15 days or less may be granted to clubs or persons as follows: (a) occasional tarpet shooting or trap and skeet shooting. (b) field trials, com'nercial or professional exhibitions or displays, or any similar lawful purpose as determined by the Clerk. 80.044 Permits. Fee. The fee for annual and occasional permits shal1 be $5.OO. 80.045 Revocation of Permit. A violation of any conditions of a permit slialT resul t in revocation of the permit and no permit shall be issued to any club or person for one year after the date of the violation. 80.050 Violation. A violation of any of the sections of this Chapter except Sections fi0,040 to 80.04S shall be a misdemeanor. 80..051 Confiscation. The firearms of an alleged violator of the sections of this Chapter except Sections fi0.040 to 80.045 may be confiscated at the time of arrest, and returned only if the violator is adjudged not guilty of the offense charged and no liability for danapes shall result therefrom. Confiscated fircarpjs may be disposed of as provided by law. Section 2, The prior provisions of Chapter PO arc hereby repealed. Section 3. This ordinance shall be published in the Minnetonka Sun and shall be of foe t i vc Septemlu'i' 1 , 1969.
