HomeMy WebLinkAboutcorrespondence re development of lot MEMORANDUM Date: August 19, 2004 To: Address File From: Janice Gundlach, City Planner RE: Development of 560 Big Island, PID #22-117-23-31-0002 GENERAL INFORMATION Lot Area: 3.33 acres per Hennepin County Tax Records, approximately 1.4 acres of dry Lot Width: >200' (as measured at the 929.4' lake elevation) Setbacks Internal Side & Rear Yards: 50' Right-of-Way: 30' Lake (929.4' Elevation): 75' Building-to-Building: 10' Delineated Wetland: 26' In 1983 the RS, Seasonal Recreational District was established. This is the district which this property is located within. At that time all lots not meeting the 5.0 acre dry buildable requirement were given the option to apply for an automatic lot area variance at no charge. All records on file for this property indicate the lot area variance was never requested and therefore never received, even though the property owner in 1983, Mr. Jim Blomberg and the owner in 1986, Don Henderson were notified of the automatic variance option. Shou/d a building be constructed on the lot a /ot area variance wou/d be required. This process involves P/anning Commission and City Council approval at a fee of$600. SURVEY REQUIREMENTS Any development of this lot would require a survey showing the following: -property boundaries -side and rear yard setback boundaries (noted above) -929.4' elevation and required 75' setback -931.5' 100-year flood elevation -wetland delineation with required 26' wetland setback (Minnehaha Creek Watershed District may impose a greater setback) -proposed building pad location meeting all requirements -Bluff analysis, 30' setback from top of bluff is required SEPTIC ISSUES Two septic sites are required if the structure has plumbing or has a floor area of greater than 800 square feet. City Code Section 78-1286 (b) allows for administrative approval to grade, fill, or excavate less than 10 cubic yards. This requires approval of a permit by the building official and submittal of detailed cross-section views to verify the 10 cubic yard limit. A request for a sand blanket would be subject to the 10 cubic yard limit. 2&3) The City would defer any requests for improvements lake-ward of the 929.4' elevation to the Minnehaha Creek Watershed District. The request for boulders (not rip rap) behind the cattails to separate the lawn from the cattails would be also not be permitted as boulders would be considered hardcover and no hardcover is permitted within 75' of the OHWL of Lake Minnetonka 4) Refer to the response in #1 above. 5) Boulders for a fire-pit constitute hardcover where no hardcover within 75' of Lake Minnetonka is permitted. A fire-pit outside the 75' setback would be permitted so long as the 75'-250' hardcover zone does not exceed 25% total hardcover. 6) The City would welcome the planting of grass seed in an effort to establish some ground cover vegetation. Also, City staff inet with Mr. Palm on the property prior to this permit request. During that on-site meeting Mr. Palm was focused on tree removal, particularly within the adjacent wetland buffer. I mention this only as matter of fact, as no tree removal within the wetland buffer seems to have been requested from you.
