Section 22, Township 117 North, Ran;e 23 West of the 5`�' Principal Meridian, described as follows: Commencinb at the southwest corner of said Lot 4; thence running north 300 feet; thence at right angles East to the easterly boundary line of said Lot 4; thence southwesterly along said line to the shore of Lake Miruzetonlca; thence Northwesterly along said shore to the point of beginning, all on Big Island, Lake Minnetonka, Hennepin County, Minnesota (hereinafter tl:e "property"j; and WHER�AS, the applicant has made application to the City of Orono for a tnt �1Pa �a,-iance to Ornno Municipal 7oi,in� Code S�cti�n 75-568 to allow construction of a seasonal cabin on an existing vacant lot consistin� of 3.�3 acres of total lot area where approlimately l.l acres of dry buildable area e�ists and where � acres of dry buildable arel is nornzally required; and for a side setbacl: variance to allow construction of a covered porch 4b' from the side lot line ��rhere a JO' setbacl: is required. The Plaiuiing Conunission reviewed this application at a public hearin� held on September 1 S, 2006 and recommended approval of the lot area variance but denial of the side setback variance based on the following findings: a. The lot was le�ally created prior to adoption of the cuirent RS, Seasonal Recreational District standards. b. A strticture can be built on the lot meetinQ the required 50' lot line setbacics (to the north aud west) as well as wetland, septic and lal:e setback requirements. c. The property has suitable priiliary and alternate 3-bedroom septic sites available. d. The property contains an adequate buildable envelope in which to construct a conTorniinb struct�tre., and there is no reasonable justification or sufficient hardship to support the grantiug of a side S�t�J���:V"?Tiw:�ce for th? enc?�sP� Y4?'C}l. 4. The City Council has considered this application including the findings and reconunendation of the Plaruzing Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed t__ 7___la}. The City Council finds that the conditions e�istin� on this property are peculiar to it and do not apply generall�- to other property in this zoning district; that grantinQ the lot area variance ���ould not adversely affect traffic conditions, light, air nor pose a fire hazard or other danaer to neiQhborin� property; ���ould not nierely serve as a convenience to the applicants,ybLlt is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping �vith the spirit and intent of the Zonina Code. and Comprehensive Plan of the City. The City Council finds that there is insufficient justification to allow the �rantin� of a side setbacl: variance, and the �ranting of such a variance would merely serve as a convenience to the applicant and would not be in l:ee�ing with the spirit and intent of the ZoninQ Code and Comprehensive Plan. CONCLUSIONS, OItDER AND CONDITI0�1S Based upon one or more of the above findings, the Orono City Council hereby denies a side setback variance for a 4' structure eneroachinent of the required 50' side setback; and grants a lot area variance to Orono Municipal Zonin� Code Section 78-�68 to allow construction of a seasonal cabiu on an existing vacant lot consisting of 3.33 acres of total lot area where appro�imately 1.1 acres of dry buildable area exists and where 5 acres of dry buildable area is nornially required, subject to the follo«�ing conditions: 1. Council approval is based on the site plan submitted by the applicant and annotated by City staff, attached to this Resolution as E�hibit A. Any amendments to the site plan which are not in conformity with City codes will require fui-ther Planning Commission and City Council review. 2. All setbacics; hardcover, structural covera�e, and septic requirements and seibacks must be met. No variances other than lot area shall be �ranted for construction on this lot. 3. Tlus resolution shall also act as a covenant preventing a structure lar�er than 3- bedrooms. In signing this resolution, the applicant agrees to limit the structure to 3-bedrooins in order to comply with the 3-bedroom capacity septic sites available on the lot. The applicant also aQrees to preserve the primar}� and alternate 3- bedroozn septic sites and prevent them from destruction either durina construction of the cabin or filture detirelopment on the lot. 4. Authorities �ranted by this resol�.rtion run ��ith the property not with the applicants, but are perinissive only and must be exercised by obtaining a buildina pei-mit fo•.• tl:e neti�- construction ���ithin one year of the date of Council approval, or the variance will e�pire on that date fOctober 23, 2007). Violation of or non-coizipliance with any of the tenns and conditions of this resolution shall constitute a violation of tl�e zoning code, shall auton�atically tenninate any authority granted herein, and shall be puilishable as a misdemeanor. 6.
