Re: City Code Violation at 510 Big Island

In response to a number of complaints regarding the exterior lighting at 510 Big Island, City staff noted
that the fixtures do not offer any shielding of the light source as required by City Code.. The lighting is
excessively bright and is directed off of the property. This type of fi�ure violates City Code section 78-
1573 (below). Further, the lighting appears to be a nuisance to neighboring property owners.
� City Code Section 78-1573 states:
' "Any use requiring an operation producing an intense heat or light transmission shall be performed with
the necessary shielding to prevent such heat or light from being detectable at the lot line of the site on
' which the use is located. Lighting in all instances shall be diffused or directed away from R districts and
public streets".
This letter will serve as your notice that the lighting on the property must be brought into
conformance with City Code Section 78-1573 on or before December 13, 2010 in order to avoid
legal action by the City. In order to comply with Section 78-1573 new fixtures must be installed or the
existing exterior light fixtures on your property must be modified to direct the light downward, and to
shield the light source so as not to be detected from the property line. Please send photos to me on or
before December 13th illustrating compliance with City Code.
I have attached an information sheet from the International Dark Sky Association (IDSA) regarding
types of acceptable fixtures. A link to acceptable lighting fixtures can be found by accessing IDSA's
website at www.darkskv.orq.
Please be advised, if you fail to correct the violations this matter will be sent to the City Attorney for
consideration of legal action. If you have any questions, please don't hesitate to contact me at
