Enclosed are separate information packets on your two Big Island
lots and their status under the revised zoning ordinance adopted
last December .
I recommend that you consider completing and returning the variance
resolution (Form #2) pravided for the one lot with a cabin on it.
This will ensure that you receive the full "grandfather" benefits
of the ordinance designed to protect building rights on those lots
with existing cabins .
I apologize for the delay in getting this information to you . You
will note that the ordinance and attached forms include a July l ,
1983 , deadline for your response . I would appreciate your response
by that date , but because this notice was delayed, we will extend
the actual deadline to September l , 1983 .

Dear Island Landowner :
The purpose of this letter is to provide you with information regarding
the recent zoning changes on Big Island and what this means for your
property .
The new RS Seasonal Recreational zoning regulations were established
by City Council adoption of Ordinance No . 246 on December 30 , 1982 .
The previous zoning ordinance required two acres or more for any property
to be built on . The new ordinance increased this minimum lot size to
five acres for creating new building sites , but it also "grandfathered"
seasonal building rights for all existing lots having a cabin , and for
vacant lots in common ownership that exceed one-half acre in area .
Your property is one of seven vacant Record Lots that is less than one-
half acre in area . Because of this small size , the City Council has
determined that your 1ot is not automatically buildable without sewer
available , and would need to go through the formal application and review
process to determine whether a variance might be granted or not . This
is exactly the same s"tatus and procedure necessary under the previous
ordinance . The new zoning regulations have thus not affected the
buildability of your property in any way .
The new ordinance does , however , specify that one-family seasonal
recreational use of your land without a cabin is now a permitted use .
This means you may camp overnight , build a barbeque pit , an outhouse ,
or a small screen house or storage building to facilitate temporary use
of the land . The ordinance also provides that if your lot is sold
and/or combined with other similar small lots so that the resulting lot
size exceeds one-half acre , that it may then be large enough to be used
for a seasonal cabin . All construction of any kind remains subject to
building permits and other regulations .
Please review the Record Lot information shown above and notify the City
if there is a problem or if there should be a change .
