The Planning Commission reviewe� this appiication at a pubfic hearing held on fV�arch i 7, 2014 and voted 6 Tor and 0 against on a motion to recommend approvai of tne variances and CUP tc allow the new 2,400 square root seasonal cabin ta be constru�ted on the Property and to allow tne 700 square foot existing cabin to remain. The Planning Commission finds that the rollowing factors support the granting of the requested varianc�s and CUP: a. The Property contains 68,612 square feet in area (1.:,7 acre) and has a deTined width of 321 feet at the lake and 266-r'eet at the 75-foot setback. b. The existing 700 square foot cabin has existed on the Proper"ty since the 1940's. c. Tne new 2,400 square foot seasonal cabin wili meet ail appiicabf� setbacks. c;, The 8ic fsland Record Lot status granted by Resolution No. 2146 gave an assui a�i�e 'to owner of this substandard sized property tr�at their proqerty ,:o�,�id b? developed without variances T�r uses considered to be a basic right of ownership on Big fsfand. �. Recorc: Lot Resolution No. 2146 was adopted in 19�7 and s�ates that the ?roperty can qe used ror tne r'oli�wing uses subiect to stricf :,ompiiance with all building codes; seDtic treatm�nt codes, and zonina codes: i. One{amily seasonal recreational use without a structure (i.e. dock, campsite, etc); or ii. One new seasor�al dweliing may be built; or iii. An existing seasonal dwelling rnay be used, improved, expanded or replaced. f. The Record Lot stat;�s aoes not i:self permi`, an intensification of uses. g. The Appiicants are investigating the feasibility of septic syst�m sites to serve both the exisfing and proposed cabins on the Property. The Applicants have not propose� to construct a �ake access stair. k. With a total of 5% proposed hardcover, th� Property will conTorm to the hard�over limitations of 25% for a Tier 1 lot. Structural coverage limitations will aiso be met with the proposed 4.6% stru�tural coverage fevel. I. The Applicants' proposed 2,400 square foot seasonal cabin or the existing 700 square foot accessory cabin wili not alter the essential charact�r of the neighborhood and will result in minimal or no negative impact on adiacent properti�s. m. The Applicants' reque�t is in Farmony with the purpose and intent of the ordirance. n. ThG F�ppiicants have demonstrated tna� enfor�ing the provisions oT the Zoning Grainance aepriv�s the Appfi�anTs o`the reasorabfe use of th�ir Property. 4. Council approval is based on the survey and buiiding p�ans submitted by the Appficants and anno�ated by City staff, attached to this P.�solution as Exnipits B & C. Any amendments to the appraved plans which are not in conformity with City codes will require further P'�anning Commission and City Council review. 2. Proposed hardcover levels are conforming to the Tier 1 standards; no hardcover variances are granted. 3. The Applicants by agreeing to the provisions of tnis Resolution do hereby covenant that the 700 square Toot a�cessory guest :,abin wil! be used soieiy by the occupants of the new 2,400 seasoral cabin, inciuding th�ir domesti� empioyees, caretakers or nonpaying guests. The 700 square foot accessory cabin shall not be rented or leased for compersation. 4. The Property sral` be subject to strict showing o� compfiance with health and sanitation per�ormance stanGards. 5. The 70G square foot accessory guPst :,abin and the �,400 sauare foot seasonal caain snall all be conne�ted to on-site sewaae treaiment systems in conformance with the reauirements of section 78-574. 6.
