This application was reviewed as Zoning File#13-3613. �' ' 2. 430 Big Island is currently known as Big Island Record Lot#30. It is a vacant lakeshore j property containing 44,537 square feet or 1.02 acres in area. , 3. 440 Big Island is currently known as Big Island Record Lot#24. It is 47,762 square feet I, or 1.11 acres in area. A small cabin,two small sheds and a septic system exist on the ', property. The property straddles the platted nght-of-way Massasoit Avenue/Moslin ! Avenue. I 4. 450 Big Island is known as Big Island Record Lot#27. The property is 46,661 square � ' feet or 1.07 acres in area. A cabin, small shed and septic system currently exist on this property. 5. Following the lot line rearrangement 440 Big island which is shown as Parcel 2 on Exhibit A (the submitted survey dated 07/30/2013)will have 68,776 square feet in area or 1.57 acres in area; and 450 Big Island which is shown as Parcel 1 on Exhibit A will , , have 71,184 square feet or 1.63 acres in area I ' 6. Following the lot line rearrangement 430 Big Island,othetwise known as Record Lot#30, ! will cease to exist. ' 7. Because this is a lot line rearrangement which results in no additional lots,no park fee or stormwater trunk fee will be required. , S. Dedication of drainage and utility easements are not required as this is not a new plat. 9. The proposed lot line rearrangement will not result in making any of the structures on either property non-conforming. 10. The Owner shall file the appropriate deeds reflecting the new legal descriptions for each , property(subject to City Attomey approval) with the Hennepin County Recorder's Office and/or Registrar of Titles Office on or before August 12, 2014, or the approval granted by this resolution shall expire. Thorkelson, a single person, (hereinafter "the applicant") is the owner of the property located at 440 Bi� Island within the City of Orono (hereinafter the "City") and legally described as follows: Lot l, Scriver's Subdivision of Lot E Nlorse Island Park and Lot 6 and the South Half of Lot 7, Morse Island Park Second Addition, Hennepin County, Minnesota (hereinafter the "property"); and `VHEREAS, the applicant has made application to the City of Orono for a conditional use pennit per Orono Municipal Zoning Code Section 78-567 to allo�v private sewer improvements through platted public right-of-way. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FIIVDINGS 1. This application was reviewed as Zoning File #03-2939. 2. The property is located in the RS, Seasonal Recreation Zoning District. 3. The Planning Commission reviewed this application at a public hearing held on September 15, 2003 and recommended approval of the conditional use permit based on the following findings: a. The applicant's property is a non-contiguous lot separated by platted public right-of-way. Due to limited space on the parcel where the home is situated and in order to serve the property with private sewer the drainfield must be located on the inland property. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicant and the public, and the effect of the proposed conditional use permit on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a conditional use permit per Orono Municipal Zoning Code Section 78-567 to allow construction of a private sewer line through platted public right-of-way, subject to the following conditions: 1. Council approval is based on the plan submitted by the applicant and annotated by City staff, attached to this Resolution as Exhibits A and B. Any amendments to the plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. The applicant acknowledges that placement of septic system connection pipes within the right-of-way is at their own risk. The system should be constructed so as to minimize the possibility of damage by vehicular traffic on the right-of-way. 3. Applicant shall, prior to placement of improvements within the right-of-way, execute a hold harmless agreement which releases, indemnifies and holds harmless the City and the public from any and all claims or causes of action arising out of the use or alteration of the platted right-of-way by applicant or their invitees. 4. Authorities �-anted by this resolution run with the property not with the applicant, but are permissive only and must be exercised by obtaining a building permit for the new construction ��ithin one year of the date of Council appro��al, or the conditional use perniit will expire on that date (September 22, 2004). The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of the applicant and the applicant's heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property. Le�al Description - Lot I, Scriver's Subdivision of Lot E, Morse Island Park, and Lot 6 and S %z Of Lot 7, Morse Island Park, Second Di�iision, H�nnepin County, MN. 2. Site Conditions - The lots exist on a r�rnote island within Lake Minnetonka. A cabin, two sheds and an outhouse exist on the site. No well or onsite wastewater treatment system currently exists. A dee� well is planned to be driiled on the lot therefore an onsite sewage treatment will need to be installed. 3. Soil Conditions - The soil within the island is primarily mapped by the Hennepin County Soil Survey as Hayden Loam. Since the last Hennepin County soil survey the Hayden soil has been renamed as Lester Loam. Lester Loam is a deep well drained glacial till soil. On slopes of 6-I 2% the soil is named 106C2 Lester loam. The depth to seasonal high water table for this soil type is greater th?n 6'. Our own soil boring; foand no evide��cc o�seasonai nign water taoie within 68" of the surface. The soil has a permeability of 30-I 00 minutes per inch. The soil sizing factor for this type c.`soil is 2.2 s�uarz feet per gallon. 4. Sizin� of Treatment System — The sewage treatment system is designed for a one-bedroom home. There are no plans for a garbage disposal or whirlpool within the home. The estimated daily flow for a one bedroom home is one hundred and fifty gallons. Description of the Treatment Process — I • Primary Treatment - Sewa e will be ravi dischar ed from the house a I 650 II n g S tY S ga o dual compartment septic tank. Natural biologica; activities taking place inside of the septic tank will separate solids and suspended particles. Solids are reduced to some extent through this process. • Secondary Treatment— Septage from the clear zone of the septic tank out of the septic tank into a lift tank where an Orenco brand biotube screened pump vault will be placed. The screened pump vault will consist of a modified well pump and an array of one polypropylene tubes with I/8" holes to filter out suspended particles larger than I/8". Filtering out the suspended particles reduces the biological loading rate on the drainfield. • Final Treatment—Screened septage will be pumped to the first of two trenches 44' long each. Drop boxes will be used to connect the trenches together in a series. The pump will discharge into the drop box of the highest zrencn, from this point gravity distribution will take place. The drainfield media will consist of Infiltrator brand chambers, High Capacity H-I 0, or equivalent. This model is chamber is equal to 12" of sewer rock below a perforated sewer pipe. As the septage trickles down through the side-walls of the chambers and into the soil biochemical processes remove harmful viruses and bacteria. 5. �2SCf"1(�t;Ofl CFTf���.�ici�i..c.i�j�i.cii� - • Septic Tank— Use a I 5a0 fiberglass septic tank. �lastic tar�� will not work and are specifically eliminated from this design. Inlet and outlet of the tanlcs must have cast in place rubber fittings to create a watertight seal around the inlet and outlet pipes. Extend 4" sch. 40 pvc pipe to lift tan k. • Septic Tank Risers — Use 24" diameter heavy corrugated pvc pipe. A watertight seal must be created between top of tank and the each riser. Top of risers should be at an elevation ��2m�" above finished grade. • Septic Tank Riser Covers — Use 24" diameter fiberglass covers with gasket, Orenco modei # FL24G14 (or equivalent). Do not bury riser covers. 2 • Lift Tank - Use a 1,500 gallon precast septic tank. Plastic tanks will not work and are specifically eliminated from this design. Inlet of the tank must have cast in place rubber fittings to create a watertight seal around the inlet pipe. • Lift Tank Risers— Use a 24" diameter heavy corrugated pvc pipe. A watertight seal must be created between top of tank and the each riser. Top of riser should be at an elevation 2-3" above finished grade. • Lift Tank Riser Cover— Use 24" diameter fiberglass cover with gasket, Orenco model # FL24G14 (or equivalent). Do not bury riser cover. • Screened Pump Vault - Place an Orenco Biotube Screened Pump Vault model #PVU57-18 I 9 into the lift tank. Allow vault to rest on the inside bottom of the tank. No other pump vault will meet the specifications of this design • Lift Pump - Place an Orenco pump model #P20051 I, I 15v, %z hp pump (or equal) into flow inducer of pump vault. Extend a sch. 40 pvc discharge pipe from the pump up into riser within I.5' of ground surface, then glue a 90 degree fitting followed a cam lock, followed by another 90 degree fitting bringing the discharge pipe back down into the tank and then out the outlet of the tank. The discharge pipe/supply line to the drainfield must not have any low points where water will be static in the pipe. Create a water tight seal around the discharge pipe and the opening of the tank. • �li;;h Level Alarm/Float - Use a an Orenco AI Simplex Control Panel/Level Alarm or equivalent, high level alarm. Use Orenco #MFAB float assembly or equivalent to operate pump onloff controls and for high liquid level alarm, and low water/redundant off alarm. Set the float tether to activate the level alarm should the liquid level of the tank reach the inlet invert of the septic tank. Place the level alarm inside of the house in a location where the alarm can be heard. ° Run all wires from the pump and floats through a grommet installed in the riser wall then through plastic conduit from the riser up to the splice box mounted above ground on a permanent pole or post or equivalent. Seal opening in riser where wires pass through. 3 � � � � � � • Drainfield— Use Infiitrator H-I 0 High Capacity Sidewinder brand chambers for the drainfield � media. This model of chamber is equal to I 2" of side-wall when comparing to a standard rock trench configuration. Dig two -44' x 3' wide trenches to the lengths indicted in drawing � detail. Place a drop box at the end of each trench, connecting drop boxes with 4" pvc pipe. Dig the trenches to the elevations given in attached design detail section. Place twelve inches of a sandy to loamy soil material over each of the chambers. This letter is to notify you that the City requires building permits for the construction of buildings. Therefore, the City must require you to remove the building or submit a building permit application along with building plans, a survey showing the location of the building and hardcover calculations. A review will be done and if found to be in compliance with building and zoning codes, a permit can be issued. A deadline of May 3, 1999 has been established for submittals.
