WHEREAS, the C'ity of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of Orono (hereinafter "City Council°) has adopted
subdivision regulations for the orderly, economic and safe development of land within the City;

WHEREAS,Gabriel E.Jabbour,a singie person(hereinafter the°Owne�')is the '
owner of the property located at 430 Big Island within the City of Orono (hereinafter"City")and '
legally described as follows: '

WHEREAS, the Orono City Council reviewed the proposed lot line !
rearrangement at a regular meeting held on August 12, 2013 and makes the folfowing findings
with regards to the proposed lot line rearrangement:
FINDINGS
1. This application was reviewed as Zoning File#13-3613.
' 2. 430 Big Island is currently known as Big Island Record Lot#30. It is a vacant lakeshore j
, property containing 44,537 square feet or 1.02 acres in area. ',
3. 440 Big Island is currently known as Big Island Record Lot#24. It is 47,762 square feet !,
or 1.11 acres in area. A smali cabin,two small sheds and a septic system exist on the ',
property. The property straddles the platted right-of-way Massasolt Avenue/Moslin ',
Avenue. '�
' 4. 450 Big Island is known as Big Island Record Lot#27. The property is 46,661 square i
feet or 1.07 acres in area. A cabin, small shed and septic system currenUy exist on this '

5. Following the lot line rearrangement 440 Big Island which is shown as Parcel 2 on '
Exhibit A (the submitted survey dated 07/30/2013) will have 68,776 square feet in area ;
or 1.57 acres in area; and 450 Big Island which is shown as Parcel 1 on Exhibft A will
have 71,184 square feet or 1.63 acres in area.
6. Following the lot line rearrangement 430 Big island,otherwise known as Record Lot#30, I!
will cease to exist. I
7. Because this is a lot line rearrangement which results in no additional lots,no park fee or '
stormwater trunk fee will be required. ',
8. Dedication of drainage and utility easements are not required as this is not a new plat. ',
9. The proposed lot line rearrangement will not result in making any of the structures on
either property non-conforming.
10.Resolution No. 1548 regarding the establishment�f Record Lot#30 will be extinguished
if necessary. '

CONCLUSIONS,ORDER AND CONDITIONS
NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby grants the lot line
rearrangement of the above referenced properties based on the lot line rearrangement survey
dated 07/30/2013 by Advance Surveying & Engineering Co., attached as 6chibit A, subject to
the following conditions: '
' 1. The Owner shall file the appropriate deeds reflecting the new legal descriptions for each
', property(subject to Ciry Attomey approval) with the Hennepin County Recorder's Office
and/or Registrar of Tdles Office on or before August 12, 2014, or the approval granted
by this resolution shall expire.

Subd. 1 e.Nonconformities.
(a) Except as otherwise provided by law, any nonconformity, including the lawful use or occupation
of land or premises existing at the time of the adoption of an additional control under this chapter, may
be continued, including through repair, replacement, restoration, maintenance, or improvement, but not
including expansion, unless:
(1) the nonconformity or occupancy is discontinued for a period of more than one year; or
(2) any nonconforming use is destroyed by fire or other peril to the extent of greater than 50 percent of its
estimated market value, as indicated in the records of the county assessor at the time of damage, and no
building permit has been applied for within 180 days of when the property is damaged. In this case, a
municipality may impose reasonable conditions upon a zoning or building permit in order to mitigate any newly
created impact on adjacent property or water body. When a nonconforming structure in the shoreland district
with less than 50 percent of the required setback from the water is destroyed by fire or other peril to greater
than 50 percent of its estimated market value, as indicated in the records of the county assessor at the time of
damage, the structure setback may be increased if practicable and reasonable conditions are placed upon a
zoning or building permit to mitigate created impacts on the adjacent property or water body.
(b) Any subsequent use or occupancy of the land or premises shall be a conforming use or occupancy. A
municipality may, by ordinance, permit an expansion or impose upon nonconformities reasonable regulations
to prevent and abate nuisances and to protect the public health, welfare, or safety. This subdivision does not
prohibit a municipality from enforcing an ordinance that applies to adults-only bookstores, adults-only theaters,
or similar adults-only businesses, as defined by ordinance.
(c) Notwithstanding paragraph (a), a municipality shall regulate the repair, replacement, maintenance,
improvement, or expansion of nonconforming uses and structures in floodplain areas to the extent necessary to
maintain eligibility in the National Flood Insurance Program and not increase flood damage potential or
increase the degree of obstruction to flood flows in the floodway.
(d) Paragraphs (d) to (j) apply to shoreland lots of record in the office of the county recorder on the date
of adoption of local shoreland controls that do not meet the requirements for lot size or lot width. A
municipality shall regulate the use of nonconforming lots of record and the repair, replacement,
maintenance, improvement, or expansion of nonconforming uses and structures in shoreland areas according
to paragraphs (d) to (j).
(e) A nonconforming single lot of record located within a shoreland area may be allowed as a building
site without variances from lot size requirements, provided that:
(1) all structure and septic system setback distance requirements can be met;

, (2) a Type 1 sewage treatment system consistent with Minnesota Rules, chapter 7080, can be installed or
the lot is connected to a public sewer; and
(3) the impervious surface coverage does not exceed 25 percent of the lot.
(f) In a group of two or more contiguous lots of record under a common ownership, an individual lot
must be considered as a separate parcel of land for the purpose of sale or development, if it meets the
following requirements:
(1) the lot must be at least 66 percent of the dimensional standard for lot width and lot size for the
shoreland classification consistent with Minnesota Rules, chapter 6120;
(2) the lot must be connected to a public sewer, if available, or must be suitable for the installation of a
Type 1 sewage treatment system consistent with Minnesota Rules, chapter 7080, and local government
controls;
(3) impervious surface coverage must not exceed 25 percent of each lot; and
(4) development of the lot must be consistent with an adopted comprehensive plan.
(g) A lot subject to paragraph (f) not meeting the requirements of paragraph (f) must be combined with
the one or more contiguous lots so they equal one or more conforming lots as much as possible.
(h) Notwithstanding paragraph (f), contiguous nonconforming lots of record in shoreland areas under a
common ownership must be able to be sold or purchased individually if each lot contained a habitable
residential dwelling at the time the lots came under common ownership and the lots are suitable for, or
served by, a sewage treatment system consistent with the requirements of section 115.55 and Minnesota
Rules, chapter 7080, or connected to a public sewer.
(i) In evaluating all variances, zoning and building permit applications, or conditional use requests, the
zoning authority shall require the property owner to address, when appropriate, storm water runoff
management, reducing impervious surfaces, increasing setback, restoration of wetlands, vegetative buffers,
sewage treatment and water supply capabilities, and other conservation-designed actions.
(j) A portion of a conforming lot may be separated from an existing parcel as long as the remainder of
the existing parcel meets the lot size and sewage treatment requirements of the zoning district for a new lot
and the newly created parcel is combined with an adjacent parcel.

Currently these lots are in separate ownership. The owner of 420 wants to purchase 430, keep them as separate lots and construct
cabins on each. Am I reading the below code correctly in that even though they are separate"record lots"today when they are

Sec.78-568. Lot area requirements.

, Within any RS seasonal recreational district, no new lot or parcel shall be created less than 5.0 acres in dry-
buildable lot area exclusive of any wetlands. Within any RS seasonal recreational district, the following provisions shall
govern the buildability, use and/or subdivision of each existing record lot:
(1) Record lot definition. For purposes of the RS seasonal recreational district, a "record lot" shall mean all the
contiguous or abutting land owned in common by the same person or persons as of November 9, 1981,
or at any time such common ownership may occur thereafter, including one or more separately platted
lots or unplatted parcels of land, and/or one or more separately identified tax parcels. Because of the
unique circumstances and actual use patterns existing on the islands, also included within the definition
of a "record lot" is commonly owned land that is contiguous except for being separated only by platted
unopened public right-of-way. Each record lot shall be considered in its entirety to be one lot for zoning
purposes.
a. The effective date for determination of common ownership is November 9, 1981,the date of
adoption of Ordinance No. 238, establishing a moratorium on development, including land
subdivision, on the Lake Minnetonka Islands. Common ownership as of that date has been and
shall be determined by the deeds of record at the county recorder's office.This definition shall
not preclude the city from recognizing or enforcing the common ownership/lot of record
provisions of Ordinance No. 172, or any other similar prior ordinance.
b. The council has identified and establishes 69 record lots on Big Island, Mahpiyata Island and Deering
Island as listed by record lot number in the left-hand column of subsections (4), (5), (6) and (7)
of this section. Each such record lot shall include all land identified by all tax parcel property
identification numbers (PIDs) grouped together following the record lot number.
c. Within 60 days after January 13, 1983, the owner of each record lot shall be notified in writing at his
last recorded address of the classification of each record lot, including all tax parcels determined
to be included in such record lot. All existing uses in the RS district are identified in the record
lot inventory, subsections(4), (5), (6) and (7) of this section, and all such uses have been
deemed to be seasonal in nature.The notice shall provide that in order to receive the benefits
of the automatic lot area variances granted by subsections (6) and (8) of this section, the owner
shall on a form provided by the city acknowledge the record lot and shall apply for combination
of all separate tax parcels pursuant to subsection (2) of this section. Any record lot owner may
appeal the record lot classification or use determination to the council with no application fee
required within six months of the effective date of this division.The record lot inventory shall be
considered accurate and final for all properties except those found on appeal to have a
demonstrable cause for change or adjustment.
d. Notice of record lot establishment shall be filed by the city in the chain of title of each property.
e. Future changes in tax parcel property identification numbers caused by combination of parcels for
tax purposes or for any other reason shall not alter the establishment of record lots. New record
lots shall be created only by council approved subdivisions pursuant to subsection (3) of this
section, or by combination of two or more complete record lots.
(2) Tax parcel combination required. No new building permit,variance or conditional use permit shall be issued
for any purpose on any record lot composed of two or more tax parcels unless the owner of such record
lot shall apply for a formal combination of all commonly owned property into one parcel. If contiguous,
all property shall be combined into one tax parcel. If separated by public right-of-way, a special lot
combination form shall be executed and filed in the chain of title of each separate parcel.

Realizing that the packet you have received is rather extensive, I will attempt to briefly
summarize some key points:
1. Lot area according to City records is approximately 0.86 acres.

2. A lot area variance has been granted to the 5.0 acre standard via Resolution
#1548. �
3. The property owner would generally have the right to construct a new seasonal
dwelling on this vacant parcel subject to compliance with building permit,
setback, hardcover, on-site sewage treatment, shoreland, and other performance
standards. For instance, required setback from the lake would be a minunum of
75', however, you would also have to meet the 30' setback from the "top of
bluff", since City topographic maps indicate this lot likely contains a significant
bluff. Since the lot is 100-200' in width, the side setback requirement is 30'.
Setback from the street right-of-way is 30'.
4. Building construction standards are generally listed in Subd. 11 on pages 323
through 325 of the RS District Code, and septic requirements are in Subd. 12.
You can construct a rather small seasonal dwelling without septic and well but
plumbing is definitely required for all seasonal dwellings over 800 s.f. in floor
area.
5. Access to this property is going to be a major hurdle. The Shoreland Ordinance
will allow you to construct a 4' wide stairway within the 0-75' setback from the
lake, but generally will not allow live tree cutting or extensive vegetation clearing
within 75' of the lake nor within the bluff area. Further, you would not be
allowed to do any grading in that area, so your access to the site for building
materials would have to be via the unimproved roadways or by permission of
neighboring property owners.
6. The property owner to the north has requested he be consulted in site planning
for this property since its well and septic location will impact his potential septic
and well locations.
I encourage you to carefully read Code Section 10.31 as well as the Shoreland Management
Standards of Section 10.56. Any building permit applications submitted to the City will
necessarily need to have detailed topographic survey work included, because we are dealing with
a bluff situation. I would venture a guess that one or more variances will be needed in order
to construct a seasonal dwelling on this property, and that meeting septic system requirements
could be quite difficult. •

then "grandfathers" building rights for these Record Lots by making them

even if your lot is less than five acres (or two acres under the previous

We have been informed by the Minnehaha Creek Watershed District that you intend to install riprap on your
property at 430 Big Island. Because riprap is often part of a larger project we want to alert you to some related
City code provisions so you can avoid the hassle and expense of obtaining an after-the-fact permit or even having
to undo some of the work.
With few exceptions, including riprap and lakeshore steps, City code prohibits the installation of impervious
surfaces within 75 feet of the lake. Any sort of fabric is considered impervious. This means that riprap rock may
be extended farther than allowed by the riprap permit but no fabric may be installed under it.
The following activities require a permit from the City:
• Any earth movement outside the area where the rip rap will be placed
• Replacement of retaining walis and/or installation of new retaining walls within 75 feet of the lake
(regardless of the height of the walis)
• Construction or replacement of lakeshore steps
• Removal of trees (dead or alive) six inches in diameter or larger within 75 feet of the lake
• Removal of vegetation on any slope within 75 feet of the lake that is too steep to easily walk
• Removal of vegetation or trimming of trees larger than six feet to provide a view of the lake from the
house
• Total or near total removal of vegetation within 75 feet of the lake not part of another permit
A tree removal permit can be arranged by calling 952-249-4600. For the other permits your contractor must
submit a permit application and plans for review. Additional information can be found at the City website,

Realizing that the packet you have received is rather extensive, I will attempt to briefly
summarize some key points:
1. Lot area according to City records is approximately 0.86 acres.

2. A lot area variance has been granted to the 5.0 acre standard via Resolution
#1548. �
3. The property owner would generally have the right to construct a new seasonal
dwelling on this vacant parcel subject to compliance with building permit,
setback, hardcover, on-site sewage treatment, shoreland, and other performance
standards. Far instance, required setback from the lake would be a minimum of
75', however, you would also have to meet the 30' setback from the "top of
bluff", since City topographic maps indicate this lot likely contains a significant
bluff. Since the lot is 100-200' in width, the side setback requirement is 30'.
Setback from the street right-of-way is 30'.
4. Building construction standards are generally listed in Subd. 11 on pages 323
through 325 of the RS District Code, and septic requirements are in Subd. 12.
You can construct a rather small seasonal dwelling without septic and well but
plumbing is definitely required for all seasonal dwellings over 800 s.f. in floor
area.
5. Access to this property is going to be a major hurdle. The Shoreland Ordinance
will allow you to construct a 4' wide stairway within the 0-75' setback from the
lake, but generally will not allow live tree cutting or extensive vegetation clearing
within 75' of the lake nor within the bluff area. Further, you would not be
allowed to do any grading in that area, so your access to the site for building
materials would have to be via the unimproved roadways or by permission of
neighboring property owners.
6. The property owner to the north has requested he be consulted in site planning
for this property since its well and septic location will impact his potential septic
and well locations.
I encourage you to carefully read Code Section 10.31 as well as the Shoreland Management
Standards of Section 10.56. Any building permit applications submitted to the City will
necessarily need to have detailed topographic survey work included, because we are dealing with
a bluff situation. I would venture a guess that one or more variances will be needed in order
to construct a seasonal dwelling on this property, and that meeting septic system requirements
could be quite difficult. •
