Sec. 86-67.- Limitations. Sec. 86-68.- Permit application; information repuired. Sec. 86-69. -Contractor licensing repuirements. Sec. 86-70. - Permit exqiration. Sec. 86-66.- Required. It is unlawful for any person to erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish any building or structure, or any part or portion, including but not limited to the general construction, plumbing,water well, on-site sewage treatment system,wood stoves and fireplaces, ventilating, heating or air conditioning systems, or cause such work to be done,without first obtaining a separate building or general permit for each such building, structure or separate component from the city. (Code 1984 § 12 02) Sec. 86-67.- Limitations. The issuance of a permit for any single component shall not imply authority for construction or inclusion of other components. (Code 1984 § 12-02) Sec. 86-68.- Permit application; information required. _ �a) The application for a construction permit shall include such information as may be required by the city, which may vary between types of construction projects. (b) Surveys required: (1) Initial survey. Any building or general permit application for construction of a new structure or expansion of an existing structure shall be accompanied by a certificate of survey prepared by a Minnesota Registered Land Surveyor unless the building official determines the construction project is exempt from this section.The certificate of survey shall conform to the standards on file in the office of the building official. (2) Foundation survey. A foundation survey shall be submitted to the city for review and approval, unless exempted by the building official, upon completion of the foundation work for all buildings and all additions to buildings.The foundation survey, prepared by a Minnesota Registered Land Surveyor, shall certify the lot dimensions;front, side, rear, lakeshore, and wetland setbacks; and foundation elevation. A foundation survey must be submitted before proceeding with framing or further construction. In lieu of a survey a letter prepared by a Minnesota Registered Land Surveyor containing the same information as a foundation survey may be submitted. (3) As-built survey. An as-built survey, prepared by a Minnesota Registered Land Surveyor, shall be submitted to the city for review and approval upon the completion of all buildings and all additions to buildings, unless exempted by the building official. The as-built survey shall certify the final topography of the site; verify drainage patterns; and provide hardcover calculations for lots in the Shoreland Overlay District.An as-built survey must be approved before the issuance of a certificate of occupancy. In the event that weather or other conditions prevent the completion of an as-built survey at the time the Certificate of Occupancy is requested, applicant shall provide a sufficient financial guarantee and establish an escrow agreement to ensure completion of the as- built survey. The permit for any construction work requiring a license under statute or this Code shall be issued only to the licensee upon proof of holding a current license and bonding and insurance as required by statute or this Code. (Code 9984. § 92.03) Sec. 86-70.- Permit expiration. (a� Notwithstanding continuing or ongoing work, any building permit issued by the city shall expire and by limitation be null and void and shall require issuance of a new permit and payment of half the original permit fee if a certificate of occupancy and final completion has not been issued within the following length of time after the date of permit issuance,which new permit and fee shall be necessary to reimburse the city for ongoing and more than normal number and cost of inspection services: (1) Single-family residential dwellings, including new construction, remodeling or additions, 24 months. (2) Accessory buildings on single-family residential properties, 12 months. (3) All multifamily and nonresidential construction, 24 months, except when a longer time is authorized by the council at the time the original permit is issued. (b) Notwithstanding continuing or ongoing work nor issuance of new or extended permits, all exterior work shall be expeditiously brought to completion to protect adjoining and nearby properties as follows: (1) No land shall remain disturbed and exposed without established grass or other ground cover for a period exceeding 12 months, or any lesser period as may be specified in the permit. (2) All exterior construction, including siding, roofing, doors,windows and finish, shall be completed and present a finished appearance within 12 months of the start of construction. (c) Failure to complete such exterior construction shall result in the suspension of the existing permit until payment of 100 percent of the original building permit has been made. Should this not satisfy the time and materials expenditure of staff,the city shall directly bill the amount exceeding the permit with payment required prior to issuance of a final occupancy permit.Any payment under this section does not negate the permit limits of subsection (a)of this section and may not be applied to satisfy payment for a new permit under this section.This does not release the permittee from making appropriate life safety corrections nor negate other building code requirements.
