Subd. 3. Council Discretion. The dwelling units
permitted may be, at the discretion of the Council and subject to
the conditions set forth by the Council, in detached, attached or
multiple family dwelling structures; subject to the limitations
provided for in each zoning district.
Subd. 4. Open Space, Etc. The dedication, ownership,
use and maintenance of open spaces created by the application of
the Planned Residential Development shall be subject to conditions
deemed necessary by the Council to assure the preservation of such
open spaces for their intended purposes.
Su•:)d. 5. Dedication of Open Space. The dedication and
ownership of such open spaces may be through: (1) Homeowners
Association; (20 Landlord -Maintenance; (3) Special Service
District; (4) Municipal Ownership; or (5) any other method deemed
appropriate by the Council to accomplish the purposes of this plan.
Subd. 6. Site Plan. The proposed site plan, including
location, spacing and basic design of proposed buildings, street
and parking plans, water and sewer (public or private) plans, and
plans of open space available for park or recreational purposes,
shall be submitted for approval by the Planning Commission and the
Council.
Subd. 7. Hearings. The Council may direct that a public
hearing be held to review such plans.
Subd. 8. Finai Approval. Final approval shall not be
granted until all conditions set by the Council are met; and,
further the Council shall not approve any such Planned Residential
Development prior to the legally binding establishment of the open
space dedication, ownership and maintenance provisions, such
provisions to be guaranteed by bonding or other means satisfactory
to the Council.
Subd. 9. Subdivision Requirements. All provisions of
subdivision procedure established by the City Code except as
modified hereir, above, shall govern applications under this plan.
