Re: Municipal Code Violations
Dear Ms. Duenow:
During the week of March 7, 1988 the City was advised of a septic
system failure on the property at 1340 Baldur Park Road. City Inspector
Lyle Oman subsquently visited the property and attempted to help the
occupant locate the septic tank, but to no avail. Iie noted that there was
a backup of sewage into the basement, which obviously must be rectified.
He advised the occupant to contact a septic tank pumping f irm to locate and
pump the septic tanks.
The City of Orono has long contended that this property is served by
municipal sewer and must connect to that sewer. Connection of the sewer
was held in abeyance during a number of property redevelopment proposals
during the late 1970's and early 1980'x, none of which came to fruition.
The sewer remains unconnected and is the responsibilty of the property
owner.
Connection to the municipal sewer will undoubtedly be relatively
expensive for this residence due to the extreme distance to the municipal
sewer line and the low, wet ground involved. This situation is exacerbated
by the fact that Mr. William Franklin owns the property between the parcel
on which the house sits and the municipal sewer stub. However at the time
municipal sewer was installed, the parcel you own and the parcels Franklin
owns were considered as a single developed property owned by Fred and
Gladys Olson, hence the city considers the property as being served by
municipal sewer, which must be connected per requirements of the Municipal
Code.
I would point out that your property apparently contains two septic
systems, the first being in the front yard to the east of the garage and
generally out from the midpoint of the house about 10 to 20 feet as I
recall. The second system has never been located but is presumed to extend
to the north or west of the house, exiting the house below the basement
level. It is very likely that your septic tanks are on the adjacent Lot 31
owned by Mr. Franklin. It is also our understanding that the well serving
your house is on Lot 31 and that an easement over Lot 31 exists for that
well.

YOU ARE HEREBY 140TIFIED THAT PER MUNICIPAL CODE SECTION 12.30
SUBDIVISION 4 (B) THE RESIDENCE MUST BE CONNECTED TO THE MUNICIPAL SEWER.
YOU MUST IMMEDIATELY CONTACT CITY STAFF TO DISCUSS THE VARIOUS PERMITS AND
APPROVALS REQUIRED TO ACCOMPLISH THAT CONNECTION.
Secondly, it was brought to our attention that this residence is
possibly being used as a duplex, with Denise L. Duenow occupying the lower
level and a number of rental tenants occupying the upper level. You are
hereby notified that this property is not now and has never been approved
for a duplex type use, and such a use is not allowed in the LR -1C Zoning
District. Please arrange for an inspection of the property so we can
verify whether such a use is occuring. If so, you must arrange to
discontinue the duplex use of this property within 60 days from the date of
this letter.
