I ■ : ' •V »i / y REGULAR PD\I^ING^O»M APRIL 5, 1976 The Orcno Planning Commission met on the above date vdth ATIENDANffi - 7:33 P.M. the following members present: Chairman C. Paul Pesek. ffem- bers Brad Van Nest, Gregg Hannah, Diane Dunlap, Gloria McDonald, John P. Hake and Zoning Administrator, Hank MUhich. Qiairman Pesek announced that this was the time and place for a Piiblic Hearing on the petition of A. T. csco for the vacation of Hill Street. The Notice of Public Hearing and Affadavit of Publication were presented. The Zoning Admini­ strator plained that the Council had previously denied the same petition due to Hill Street being the only access to vacant property to the East of the Esco property and if va­ cated it would result in land locking those properties. Jerry Snyder, attorney representing the applicant, requested the Comnission to review the survey showing that the garage and a portion of the existing house, including the well, pro­ trudes into Hill Street. The attorney stated that the only way the Esco's could obtain marketable title for their pro­ perty was by vacation of that portion of the street where the house is located. It was noted that Lots 7 and 18, the East­ erly properties, had not yet been developed and so access problems still existed for these tracts. Van Nest noted that tremendous ravines existed on these lands making it impract­ ical to build an access except thru Hill Street. Mr. Snyder explained that the Esco's had retreated in their request for a complete vacation but were only asking for 3.8 ft. so that the house will be completely on Esco owned property. Me ex­ plained that this was an existing situation when the Esco's purchased the property and they were presently in a law suit with the former owner concerning the issue. After all the piiblic present were afforded opportunity to be heard, the hearing was closed. Chairman Pesek called to order the Public Hearing on the re­ zoning application of the Kelly Avenue Holding Company. The Zoning Administrator presented the Notice of Public Hearing, Affadavit of Pii)iication and proceeded to explain that the purpose of the application was to rezone to residential a 20 ft. conmercially zoned strip which is presently located in a parcel residentially zoned. Daniel T. Lindsay, representing the Kelly Avenue Holding Company, explained that they wished downgrading of the commercial area to residential ^ part of a Planned Residential Development and felt that this could be an important factor in the upcoming subdivision. The Zoning Administrator expressed his feelings that this would be bene- fical due to the topography of the land, consisting of hills and ravines, requiring filling and grading in order to be utilized for commercial purposes. Commercial use would re­ sult in additional hardcover and the problems of stoim water runoff and pollution of the lake and ground water. He noted that the re zoning would create a more natural line between zoning districts. The Ccmmission inquired concerning wetlands and were told that there were some, but less than was orgin- ally thought. The petitioner stated that more facti:al data would be forthcoming. After all the public were heard, the hearing was closed, PUBLIC HEARING - 7:33 P.M. A. T. Espn VACATION OF HILL STREET PUBLIC HEARING - 7:45 P.M. KELLY AVENUE HOLDING 00. 2505 KELLY AVENUE REZONING MINUTES OF A PLANNING OOM^SSICN MEETING HELD APRIL 5, 1976 - PAGE 2. Chaiiman Pesek called to order the Regular Meeting of the Orono Planning Goninission. Hdce moved, Hannah seconded, that the Minutes of the Plan ning Gonnission Meeting held March 15, 1976, be approved. Motion, Ayes (6) - Nays (0). CALL TO ORDER - 7:55 P.M. REGULAR MEETING APPROVAL OF MINUTES MEETING OF 3/15/76 The Gonnission proceeded to discuss the A. T. Esco street vacation request. McDonald felt that no road vrould ever be constructed but saw a possible future need for it's existence. Pesek felt that 3.8 ft. would not be haxmful and the balance could still service the lands to the east. The Zoning Adndni* strator disagreed stating that the City would need the full road for future utilities and maintenance. Van Nest noted that in order to vacate land a public interest must be served. The menbers, in turn, felt that the Esco's were public and the situation created a hardship to them. It was agreed that the City Attorney and Street Department be consulted as to idiat constitutes piblic interest and what maintenance problems mi^t result from the vacation. Hann^ moved, Du^ap seconded, that the A. T. Esco application for vacation of Hill Street be tabled until the Gonnission had receipt of reconmendations from the City Attorney and Street Department. Motion, Ayes (6) - Nays (0). A. T. ESCO 300 CRESTVIEW AVENUE VACATION OF HILL STREET 5 P.M. GO. Chaiiman Pesek announced that this was the time and place for a Public Hearing on the subdivision request of Thomas Giere for 350 North Arm Lane. The Notice of Public Hearing and Af- fadcvit of Publication were presented. Mr. Giere explained tliat he would like to sibdivide a parcel consisting of 9.6 acres into two lots, one of 5.4 acres having .4 acre of wet­ lands and the other 4.1 acres and that both were located on a man made channel in a two acre zoned district. He noted that the tivo lots would be about 176 ft. wide and so would need a vailance of 24 ft. from the required 200 ft. After all the public were heard, the hearing was closed. PUBLIC HEARING - 8:04 P.M. THDMAS GIERE 350 NORTH ARM LANE SUBDIVISION Qiairman reopened the Regular Meetiig. Dunlap moved, Hannah seconded, that the Planning Comnission recomn^ to the Council approval of the Thomas Giere subdivision and variance request as submitted. Motion, Ayes (6) - Nays (0), SUBDIVISION Nfr and Mrs. Everett J. Schroeder of 2565 Kelly Avenue arrived too late for the Piblic Hearing on the Kelly Avenue Holding Comncny rezoning proposal. The Comnission noted the possi­ bility of Mr. Lindsay's return when the Comnission planned to review his PRD proposal later in the evening. They agreed with Mr. Schroder to discuss together the two proposals of rczoning and subdivision later in the evening. Oien for his property at 2980 Casco Point Road and the Zoning AdmiJl- istrator t^tesented the Notice of Pii>lic Hearing and Affadavit of M>liCation» Mr* Oien explained that he would like to di­ vide his 51,000 sq. ft. tract into t»lo lots both exceeding 1/2 acre and the 100 ft. lot width requirement. The Zoning Admin­ istrator called attention to a map he had drafted after receiving survey information from the heis^ritig. property owner, Haidltoh Moran. It shiiwed that the present existing Casco Point Road, which did not fbllow the line of the platted road, and right- of-way would nn through the Oien property, thus reducing the available area necessarty to meet the Zoning Code, the Zoning Adninistrator stated that State statutes provide for the righ^ of fliaiicipalities to aquire 33 ft of property on both sides of any road used and maintained for more than six years. Mr. Oien stated that his property was Torrens and felt that it was not likely. Hanilton Moran, idio was in attendance, also expressed interest in the road situation because it would place his ex­ isting house rifi^t in the middle of the road. After all the public were heard, the hearing was closed. PUBLIC HEARING - 8:15 P.M. KENNETH W. OIEN 2980 CASOO POINT MAD SUBDtVISIGN P.M. The Chairman reopened the regular meeting. Van Nest moved. Hake seconded, that the subdivision aDolication of X^eth W. Oien be tabled until the next meeting in order that a sur­ vey showing the existing roadwi^ and right-of-way in relation to the Oien property be presented and to include an accurate coaputation of tiie dry buildable area excluding the roadway and right-of-way. Motion, Ayes (6) - Nays (0). V ETH W. OIEN 2980 CASCO POINT ROAD SUBDIVISION The GoBmission reviewed the application of Ronald Ross to place an accessory building on a thru lot located at 1960 Lakeview Terrace. As the Comwission began to reconmend ap­ proval with a condition requiring Mr. Ross to combine his homestead property with his vacant adjoining lot, Mr. Ross <^jected and requested *diat his adjoining property not be a consideration in the petition. The Commission pointed out that presently his honesite was located in a two acre zone and his existing homesite consisted on one acre. Combina­ tion with the adjoining lot would bring his pr^rty up to present zoning requirements. The Zoning Administrator ad­ vised Mr. Ross that a Building Permit could not be issued for the vacant lot because it consisted of about 751 wet­ lands. He also advised the Planning Commission that a combination now would prevent problems that might result from any new owner purchasing tiie property with intentions to build on a parcel consisting mostly of wetlands. He felt that as long as the two parcels are not conbined, the City would have no control over the sale of each individual parcel. Althou^ Mr. Ross persisted in objecting to this condition. Van Nest pointed out that it was well within the Commission jurisdiction to make recommendation having stipulated conditions. Van Nest moved. Hake seconded, that the Planning Comnission reconmend to the Council approval of the Conditional Use Permit application of Ronald Ross subject to the combination of ^ots 1 and 2, Block 1, long Lake Gomtry Club Addition. Church boulevard. Mr. Lambin then presented a redrawn plan that would place tiie entrance to the restaurant on County Road 15, fiirtiier east of the Shell Station driveway. The plan proposed would increase the paiicing spaces to 67 cars. "Hie Conmission inquired concerning the ippearance of the building and sug^sted that a landscape plan be prepared. Mr. Lanbin stat^ that the restaurant would be esthetically pleasing on four sides and that no fill would be needed for the construction. Becruse the Burger King would have a drive-up window, the Comtdssion discussed the classification status of it being a drive-in or a restaurant. Several members felt that nay traffic problems would be eased by a vacation of Navarre Lane that is now barracaded at Couity Road 19 to the Calvary Manorial Church. This would permit church motbers to park at their lot to the rear of the church instead of #19 and would relieve an immediate problem. It was suggested to Mr. Lanbin that he contact the church concerning this possibility and that he come to an agreement with them to use the upper portion of the road as access way for his restau­ rant proposal. Although several Comnission meihbers felt strongly that the traffic was a detrimental factor, it was suggested to Mr. Lanbin that he contact Calvary Manorial Church about poss­ ible vacation of Navarre Lane, prepare a landscape plan and give a square foot bre^down on the restaurant s food preparation area and the dining area. The Conmission directed that a Public Hearing be scheduled on the petition for ^fey 3, 1976, at 7:45 P.M. in 5ie Coincil Chanbers. The Conmission, as part of their work session, reviewed the Kenneth Oien request for filling and grading the driveway area at his tract located at 2980 Casco Point Road. The Commission called attention to a memo from the City Street Superintendent vbich read as follows: (Dated 26 March 1976) There is at this location a tile line from the outlet end of a ailvert to the lake. This culvert and tile drains the southwest side of Casco Point Roat at this point. If this property is to be filled the outlet end of the culvert should be located by the own3r and a catch bas­ in and cover should be constructed by him. Also, a swale should be provided for the mnoff of water from the south side of the road at this point so as not to direct runoff directly to the house at 2980 Casco Point Road or the structures at 2946 Casco Point Road. IVhen the tile line is exposed, it should be inspected by the City to determine wliether it meets the legal requirements of a storm sewer. If it does not, the owner nust install a system that meets all legal requirements. He ex­plained that the addition of 36' x 28' would consist of a dining room and a garage. The proposed lakeshore setback would be 66 ft. and 23 ft. from the street property line. He stated that there was no other place on the lot to do this ex­ cept as presented. As a compensation to the City, he volunte­ er^ to remove an existing 20' x 20' concrete patio facing the lakeshore and replace it with an open redwood deck. The Zoning Administrator estimated that this would result in a net decrease of 200 sq. ft. of hardcover. Hake moved, McDonald seconded, that the Planning Comnission recomnend to the Council approval of the lakeshore and stT^et setback variance request of Richard Rowlette conditional upon removal of the 20' x 20' concrete deck being replaced by a non-pcrvious type deck because the City would gain a 200 sq. ft. decrease in hardcover. !btion. Ayes (6) - Nays (0).' • . r RICHARD ROWLETT 3775 BAYSIDE ROAD VARIANCE - LAKESHORE AND STREET SETBACK Van Nest moved, Dunlap seconded, that the Planning Coirmission recommend to the Council approval of the Final Plat of the Registered Land Survey of Pfdllip Dykstra with stipulation added to the Plat that no easement be granted from Lot B to the lake, if this procedure is found to be correct by the City legal staff, or any other procedure advised by the legal staff that would ensure this provision and also, thr.t approval be subject to payment of the Paik Dedication Fee. Motion, Ayes (6) - Nays (0). He explained that John Bergley had a family emergency earlier in the day and was unable to at­ tend. The Commission tabled the review until their next regu­ lar meeting. MULTI-FAMILY ORDINANCE At the Planning Comnission's request, John Lanbin appeared at the woik session review of his application for a Conditional Use Peimit for the purpose of constructing a Burger King Restau­ rant at the present site of the Martins Texaco Station in Navarre. The Zoning Administrator related, from his meetings with Hennepin County personnel, that they would not permit any egiess or ingress onto Couity Road No. 19. Van Nest moved, IXmlap se­ conded, ^at the Pliuining Goninission recomnend to the Council that they draft a reply to the City of Plymouth stating that the City of Orono has no future plans to service that part of Orono and that the City's long range plans, if the area is sewered in the future, would be throu^ the Long Lake-Orono Interceptor. CITY OF PLY^fXm^ UTILITY SERVICE - FERNDALB Because Mr. Danield Lindsay did not return for the woik ses­ sion part of subdivision/ITO application, the Commission tabled the matter until the Public Hearing on April 19th so that both the rezoning and subdivision/PRD matters could be considered as a idiole. However, they did brief Mr. and Mrs. Everett Schroeder concerning the proposal. Legal description of Lots 1, 2 and 3, Block 9, Minnetonka Stnmit Park. The 1975 tax book lists these lots as three separate parcels and shows that 1974 taxes were delinquent. The mininaim lot area for this zone is one acre. The three lots confined ^ual approximately 19,000 SF or .43 acre. L./ \ (-J p (j}- Q i >( j p.j^ ) City of Orono Box 66 Crystal Bay, Minnesota 553?3 Re: Mooney Lake Study (Project No. 514) Gentlemen: The City of Plymouth has recently submitted a petition to the Minnehaha Creek Watershed District requesting that a study be made of the Mooney Lake Drainage Basin. This study would be necessary to determine the feasibility of an outlet for Mooney Lake. This petition was the result of a meeting with the Watershed's engineers prompted by high lake level complaints from residents in Plymouth, Orono, and Medina. .1 In submitting said petition, the City Council's resolution indicated that they felt the City should not pay the entire cost of the report inasmuch as other communities have area within the drainage basin. In accordance with the Watershed's attorney, the interpretation of the watershed law indicates that the petitioner will assume all cost of the preliminary report in the event the project is not ordered. When advised of this situation, the City Council did not feel that this was an equitable way of handling the costs of the report that they had petitioned for. In reviewing the total acreage within the Mooney Lake Drainage Basin, it appears that the City of Plymouth has about 37%, Orono 46% and Medina 17%. The City of Plymouth is willing to pay their proportionate share of the cost of the report. In a recent letter to the Watershed District, the City suggested that if the Watershed District fund 1/3 of the cost, the other 2/3 could be spread among the municipalities based on the percentages outlined above. We would appreciate it if you would review this proposal and would solicit your comments. The City of Plymouth is willing to share in the funding of the report, but does not feel it is equitable to have to fund lOO^ of the cost.
