We are in the process of reviewing the sewer and water requirements for this area.If in the event that there is any desire by the City of Orono to be serviced by these proposed utilities, we must.know at this time In order to properly size and locate said utilities.Since this area will be served by a sanitary sewer lift station and force main it is imperative that if Orono is Interested In any future connections their desires be made known at this time. Benson, Clerk/Administrator of the City of Orono, being first duly sworn,, on oath states the following in answer to the interrogatories of the plaintiffs: 1, Give the full name, address, and title or position of the individual or individuals on the Orono Planning Commission, Council, or otherwise employed by or involved with the Village of Orono in the zoning process, who first proposed the idea of changing the zoning of the plaintiffs* properties from commercial to residential and the date, as closely as possible of this proposal. A.It is not known who first proposed the idea of changing the zoning of the plaintiffs' properties from commercial to resi­ dential. The answer to the interrogatory generally may be derived as ascertained from the business records of the city or the examination, audit or inspection of such business f burden of deriving or ascertaining the answers is substantially the same for the parties serving the interrogatory as fo: ^he part/ served. The city will afford a reasonable opportunity to plain-^ tiffs to examine, audit or inspect such records and to make copies,• compilations, abstracts or summaries, all as more fua.ly set lortn in Rule 33.03 of Minnesota Rules of Civil Procedure. 2.Give the full name, address, and title or position of the individual or individuals employed by or involved with the orono administrative staff. A.City Engineer, Bill Mill, 200 Leaf Street, Long Lake, Minnesota 55356, drafted a preliminary map at the direction of the council and the Planning Commission. The official Zoning Map as adopted was drawn by McCombs*>Knutson & Associates, Inc., 12805 Olson Memorial Highway, Minneapolis, Minnesota 55441, under the direction of the council and the Planning Commission. (b)Drafted and wrote the Guide Pxan, Report #3. A.The council and Planning Commission drafted the Guide Plan, Report #3. (c)Made recommendations, suggestions or otherwise sub­ mitted input into the determination of what properties in the Navarre area were to be proposed for down-zoning from their previous! commercial classifications to the newly proposed residential classifications per the amended ordinance. A.The answer to 3(c) may be derived or ascertained from the business records of the city or from an examination, audit, or inspection of such business records, and the burden of deriving or ascertaining the answers is substantially the same for the parties serving.the interrogatory as for the party served. Plain­ tiffs may have a reasonable opportunity to examine, audit or inspect such records and to make copies, compilations, abstracts or summaries thereof. 4.Give the full name, address, and title or position of the individual or individuals, who physically drafted and wrote the amendments to the zoning ordinance. A.Bruce D. Malkcrson, City Attorney, of the firm Popham, Haik, Schnobrich, Kaufman & Doty, Ltd., 4344 IDS Center, Minneapolis, Minnesota 55402. 5.State why it was that Brauer & Associates, the firm hired to prepare the initial two reports of three of the Guide Plan did not also prepare the Final Report Three of the Guide Plan? (a)If they resigned or were discharged, please state the reasons for such resignation or discharge. A.Brauer & Associates, Inc., city staff planning commis­ sion and council prepared and gathered the data for first and second reports and the council and planning commission decided to complete the third report with city staff. A.The staff was increased to include a professional planner, a new city administrator conversant in land use planning, and a full time planning clerk. The city had already spent approx imately $20,000 in the preparation of the data for council and planning commission review. The council and planning commission concluded also that from their constant public contacts, the reports and studies from various other states and local agencies, and from their knowledge of the services available to the city in land use planning trom those agencies, that the new staff, planning commission and council were able to use the raw data prepared by planning commission and Brauer & Associates, Inc. to complete the final guide plans. * 6. Give the dates and places of all public hearing held by the Council and Commission in regard to both the adoption of the Guide Plan, and the amended zoning ordinance, which changed the zoning classification of the plaintiffs from commercial to resi­ dential. Attach all minutes of all such meetings. A.See answer to interrogatory number 1.•(I ii 7.State the form, time and manner of publication of any and all notices of those public meetings mentioned in Paragraph 6 supra and the name of the publication printing such notices. Attach copies of such notices and proof of publication. A.See answer to interrogatory number 1. 8.State whether or not any member of the Planning Commis­ sion, Council or city administrative staff owned property in the Navarre area which was down-zoned from commercial to residential. (a)If there is any such individual or individuals, state the full name, address, dates of service on the Commission or Council or employment and address and legal description of that property which he or they owned which was so down-zoned. A.No. 9.State whether it is true that in 1971 the properties owned by plaintiffs were assessed subject to an assessment deter­ mined on the basis of one lateral unit per half acre. (a)If so, state why such half acre denominations were employed instead of, say, 1/4 acre or 1 acre denominations. A.The question is unintelligible. City states that all properties were assessed a lateral assessment of $8 per running foot. In addition, all vacant property was assessed on the basis of one unit charge per half acre. If the property were developed, there was one unit charge per property regardless of size. 10.State the reasons that Ronnie's Dry Cleaners was not do;^m-zoned from commercial to residential. (a)State whether it is true that Orono officials or Commission or Council members at some time planned to dov;n-zons Ronnie's Dry Cleaners to residential, and if so, state v/hy the plan was changed. (b)If this is not true, give the correct history of the zoning decisions regarding Frank Wagner's property, and the reason it was not down-zoned to residential and detail all formal and informal actions by both the Commission and Council relative theret<|». A.See answer to interrogatory number 1. 12.State the reasons why those properties lying east of Navarre Avenue on the north side of Shoreline Drive, and west of the B-1 section on the same north side of Shoreline Drive which begins at the junction of Shadywood Road and Shoreline Drive wore selected out from among its neighbors to be down-zoned from commercial to residential. A.See answer to interrogatory number 1. 13.State whether it is not true that the Navarre Community and Commerce Association was denied representation on the ”Task Force”. (a)State the reasons why the Navarre Community and Commercf Association was not represented on the "Task Force". (b)Give the names, addresses, and title of all the members of the "Navarre Task Force". (c)Give the names of all members of this "Task Force” who own businesses in Navarre. (d)Attach copies of all correspondence, memoranda, or documents of any kind exchanged between the "Navarre Task Force" and the Commission or Council. A.See answer to interrogatory number 1. 14.State whether it is true that no member of the "Task Force” owns or owned properties which were down-zone'l from commer­ cial to residential by the new 1975 amendment to the joning ordinance. A.Believes it is true. 15.In the Orono Planning Commission minutes for September 20, 1971, it is stated on page 2 that "The general need for a professional planner was discussed. The shortcomings in capability on zoning matters of the present staff were pointed out by Ralph Martin." (c)State what differences, if any, exist between the composition of that 1971 staff and the staff which prepared the amended zoning ordinance. (b)Give the full names of the Planning Commission or Council members and/or other city officj.als who made such determination, when and how it was made and the formal action, if any, taken in his regard.
