Variance Request' To permit a front yard setback of 42' for an addition where 100' is required. 2. Section 10.27, Subd. 5(B): Side Yard Setback: The minimum requirement for side yard setback in RR-1A is 50'. Variance Request: To ptermit a side yard setback of 24.2' for an addition where 50' is required. Application Summary: The applicant is proposing to construct an addition to the south side of the residence. The proposal involves tearing down an existing dining room that currently does not have a foundation under it. In the same location, construct a foundation and above it a dining room and 3 season porch. The dining room will be in the same location and the 3 season porch is where the deck is currently located. The addition will be slightly larger than what currently exists because the walls are bumped out to be in alignment with the existing residence. The residence was built in 1963 and the section to be removed was added on in 1968, both before current zoning standards were adopted. Structural coverage is not an issue with this application. The property is served with a septic system and well. Neither the well or septic system are located in the area of the addition. No neighboring residences will be impacted by the 24.2' side setback. The adjacent property to the south is vacant property. The applicants should also be ask^ for their testimony regarding this issue. iMues for Consideration ; 1. The addition will be in the same location as the existing part of the house that is being removed. 2. The south side of the house is currently located 27.5' from the side lot line where 50' is required. The additio'i '*ill encroach 3.3' further into.the side setback. 3. The structural coverage in the lot will increase slightly, but still well below what is allowed. 4. The residence was built prior to adoption of current zoning standards. 5. Variance Request: To permit a lakeshore setback of 80' for a 12' x 16' addition where 100' is required. Application Summary: The applicants are proposing to construct a 12' x 16' addition to the residence. The addition is on the lakeside of the residence and is located 80' from the lakeshore. Mooney Lake is classified as a Recreational Development (RD) Lake therefore a 100' setback is required for the structure. The RD classification for Mooney Lake was adopted by the City in 1992. The existing lot was platted as part of the Underhill Farms Addition in 1976. A pond is located on proposed Lot 2. A Flowagc and Conservation Easement was granted at the time the Underhill Farms Addition was recorded. Lot Standards Lot 1 would be the new building site and would meet the minimum lot size and width for lots in the RR-IB Zoning Disihct. The site plans submitted by Mark Gronberg indicate the building pad is located within required setbacks and all setbacks are met to the drainfield sites as depicted on the survey. The lot would share a driveway with Lot 2. An easement would be granted in favor of Lot 2 for access over Lot 1. The minimum setbacks for the property would be 50' from the road right-of-way, 30' from interior lot lines. Please note the site plan indicating the building pad on the property, attached Exhibit G. There is an existing storage building that would be located on Lot 1. The building should be given a reasonable term to remain standing without a principal building. Lot 2 would not have direct access to Tamarack and would not be permitted access to County Road 6. The property owners would prefer to use the existing driveway that would be on Lot 2. A second driveway would require removal of mature trees along the road. The existing driveway was designed with the orientation of the existing house. A separate driveway for proposed Lot 2 would make maneuvering a vehicle to access the garage difficult. Both properties shall enter .to a Maintenance Agreement that would describe each lot owners responsibility for maintenance. It is possible Hennepin County may have additional requirements for that portion of property located along County Road 6. Previously, sites could only have a 6% slope. The lots have both demonstrated two sites on each lot that would permit the land to subdivide with the new standards. The designs have been approved by Chris Pence, On-Site Systems Manager. Easements 1.Standard drainage and utility easements shall be dedicated on the final plat 1 O' along exterior property lines and 5’ along interior property lines. 2.An easement and maintenance agreement shall be recorded with the final plat for the shared driveway access. The easement shall describe the area required to accommodate both lots. 3.A certified list of all easements recorded on the property shall be submitted prior to final plat application. Park Dedication Fee Staff recommends the property owner pay a Park Dedication fee for one new lot rather than offer land for a park dedication. Before Preliminary Plat approval the City Assessor will calculate the market value of the property. The Park Dedication fee is equivalent to 8% of the value of the lot, with a minimum fee of $2,900 and a maximum fee of $4,900. The Park Commission will review the preliminary plat application on August 7,2000, prior to City Council review. Staff Recommendation Both lots meet the requirements for subdivision and have demonstrated suitable septic sites. Staff reconunends approval of the Preliminary Plat. RR-IB ONE FAMILY RURAL RESIDENTIAL DISTRICT. Subd. 1. Purpose. The "RR-lB" One Fanily Rural Residential District is intended to provide a district which will allow a combination of low density residential development and limited agricultural activity. Subd. 2. Permitted Uses. Within any "RR-IB" One Family Rural Residential District, no land or structures shall be used except for one or more of the following uses: A. Any permitted use as regulated in the "R-1 A” District. B. Personal Wireless Service Antennas and Towers. 1. Purpose and Intent. The purpose of this section is to establish predictable, balanced regulations for the siting and screening of wireless communications equipment in order to accommodate the growth of wireless communication systems within the City of Orono while protecting the public against any adverse impacts on the City's aesthetic resources and the public welfare. 2. Personal Wireless Service Antennas. Personal wireless service antennas erected on a municipal structure may be allowed as a secondary use by administrative permit, provided they comply with the City policy regarding the use of City-owned property for wireless telecommunication antennas and provided they meet the following conditions: a. The antenna shall be in compliance with the Minnesota State Building Code and all other applicable federal and state regulations and permits. b. Structural design, mounting and installation of the antenna shall be in compliance with manufacturers specifications and shall be verified and reproved by a registered professional engineer. c. No advertising mesage shall be affixed to the antenna. d. Antennas shall not be artificially illuminated unless required by law or by the Federal Aviation Administration (FAA) to protect the public's health and si^ety. e. When applicable, proposals to erect new antenna shall be accompanied by any required federal, state, or local agency licenses. f. Transmitting, receiving, and switc!/i-.g 5v, ^ipment shall be housed within the existing structure. If a new equipment building is neces?;ir> for transmitting, receiving and switching equipment, it shall be situated in the rear yard of the principal use and shall be screened from view by landscaping. All obsolete and unused antennas shall be removed within twelve (12) months of cessation of operation at the site, unless an exemption is granted by the City Administrator or designate. The removal shall be the responsibility of the communication provider. h. Antennas shall utilize camouflaging techniques or shall be side mounted to an antenna support structure in order that such facilities are compatible with the character and environment of the area in which they are located. i. The applicant shall demonstrate by providing a coverage/interference analysis and capacity analysis prepared by a registered professional engineer that the location of the antenna as proposed is necessary to meet the frequency spacing needs of the personal wireless service system and to provide adequate portable personal wireless service coverage and capacity to the area. Within any "RR-IB" One Family Rural Resident!^ District, no structure or land shall be used for the following uses except by conditional use permit. A. Uses. Any conditional use as regulated in the "R-l A" District except for "Duplex Credit" and "Animals". B. Farms (Stock). Provided that the area is ten or more acres. C. Hospitals, Etc. Hospitals for human care, sanitariums, rest homes, iiursing homes, provided that all buildings are located 100 feet or more from the lot line of any abutting lot in an "R" District. This septic site will also need to be a mound, it can be used in the event of the primary mound failing Certain precautions wilt need to be made to protect the area in which the above referenced septic systems are proposed. It is critical that the soil is not disturbed before, during, and after construction of the system. The^ptic area should be staked off with visible fencing prior to construction. This system should treat the septic efnuent effectively if the system is installed properly and is maintained properly. It is recommenced that the septic tanks be pumped every two years. Grading/Drainage Staffhas requested the applicant provide a grading and drainage plan indicating the new house would not adversely effect adjacent properties. As of the date of this memo, the City of Orono has not received the grading plan. The grading plan shall be approved by Staff prior to the issuance of a building permit should the Council approve the variances as requested. Staff Recommendation Staff makes the following recommendations: To approve the variance application for lot area and lot width based on the fact the lot is developed as a single family dwelling, has been provided sanitary sewer service and it would not be possible to acquire additional land to create a conforming lot. To approve the average lakeshore setback variance to permit a 12' encroachment into the average lakeshore setback based on the following findings: Construction of the house in the proposed location places the house 100' from the lakeshore. The proposed location of the house best utilizes the topography of the lot. Using the flat area of the property would permit a house to constructed without requiring additional gradmg beyond what would normally be pennitted with new home construction. Review of Proposal The proposed pole bam is 400 s.f. greater than what is allowed for an oversized accessory building on a property. The applicant has stated he would like to use the larger building to store snowmobiles, automobiles and house a workshop. Mr. Kerber also owns a seeding service and would store his tmck and trailer within the building. The property is located in the 5 acre “rural” area of the City along County Road 6 and Orchard Park Road. There are two adjacent residential properties. Neither of the buildings would be fully visible to adjacent properties, and would not be visible to the property to the south based on the mature trees between the lots. The house, across Orchard Park Road, is blocked from view to much of the applicant ’s property by mature trees along the road. Reducing the size of the pole bam to 2,000 s.f would allow the applicant to build the structure without the need for a variance. Relocating the structure to another portion of the property would not be possible without replacing the septic system, which is depicted on the site survey. The existing system has been determined to be non-compliant due to the 3' separation to the water table, however it is not required to be replaced until 20 10. Additional testing has been completed to locate a future primary and secondary site on the west side of the property. The proposed location of the bam would best utilize the driveway. The garage is located approximately 88' to the side (County Road 6) property line. Mr. Kerber would like to relocate the building to accommodate the pole bam location. The only concern by Staff is the garage should be staked to ensure a 26* wetland setback. Review of Hardship The applicant has submitted a project summary and Statement of Hardship attached as Exhibits A (Application Fonn) and B. 12600 Brian J. Kerber 740 Orchard Park Road Variances July 17,2000 (• Staff has confirmed the location of the septic tanks and drainfield restrict the property from allowing construction of a pole bam behind the house. South of the drainfield, the property drops off and is very low, the water table and drainage would be a concern. This would also require extensive regrading and construction of a verj' long driveway to the rear of the property. Using the existing drive for access to the pole bam would be the preferred alternative. This does require the removal of a two stall garage v'hich has recently been renovated with a new roof. To relocate the shed elsewhere on the property would not be practical as the garage would remain with access to the driveway and out of the septic areas. The entire east half of the property cannot be developed because it is a designated wetland. A primary issue is the size of the pole bam. To grant a variance a hardship must be demonstrated. Brian Kerber 740 Orchard Park Rd Orono We were retained by Brian Kerber to provide criteria for the on-site sewage system for the property located at 740 Orchard Park Rd. In the City of Orono There were a total of 6 soil borings and 4 percolation tests done on this site and it appears that there is room for a new primary arxi alternate sites for septic systems on this property. This is based on a three bedroom, type one, single family home with maximum flow of 450 gallons per day. This house exists on this lot at this time. From these tests it was determined that a high water table exists at a depth of 16 to 24 inches below the ground surface. The high vrater table determines that only a mound type drainfleld may be installed, to meet with code. Percolation tests range from 6 to 12 minutes per inch on the two sites tested. All neighboring wells are located greater than 100 feet from the proposed drianfield site. See attached sketch for locations. These areas must be protected from any traffic to be used for any future septic sites. If they are not protected the data collected herein will become Void and new testing shall have to take plac«. This design is in compliance with local codes and Minnesota Pollution Control Chapter 7i of the date listed above. Section 10.03, Subd. 14(D): Rear Setback: Tennis courts - when such accessory structures exceed 1,000 s.f. footprint area shall be subject to the following special setback restrictions: Rear yard-30' minimum and not within the required rear yard area. 2. The PRD creating Sugar Woods, Resolution #2653 adopted July 10, 1989, establishes performance standards for each lot. It defines an allowable building pad for principal and accessory structures by establishing specific setbacks (50* front and rear, 30' sides). It also limits the hardcover to 80% of the building pad and lot coverage to 15% of the entire lot. The only hardcover allowed outside the defined building pad is a narrow driveway to the road. Application Summary: The applicants are proposing to construct a 29' x 55' sport court in the rear of their property. The proposed sport court will be located 1 O' from the rear property line where 50’ is required. Resolution #2653 was adopted in July 1989 creating Sugar Woods as a Planned Residential Development (PRD). The resolution states approval was based on limiting the development and future use of property within Sugar Woods (See Exhibit C). It specifically defines building setbacks and limits hardcover improvements. »260l John and Karen Blank 2100 Sugar Wood Drive yariance 7/17/2000 Page / These standards were established not only to provide buffers but to protect the wooded character of the unique Sugar Woods property. These standards are one of the primary reasons this area was rezoned and the plat approved a decade ago. As stated in the Supplemental Sheet to Building Permit Application (Exhibit E), the applicant’s are required to present their proposal to the Sugar Woods Homeowners Association. The applicant’s presented their proposed plan to the Board of Directors of the Sugar Woods Homeowners Association at their May, 2000 meeting. The Board of Directors unanimously approved the plan (Exhibit D). Abbreviated Review Process Not Applicable The Supplemental Sheet in Attachment B also defines an abbreviated review process for applicants unable to meet the special requirements for residential development in Sugar Woods. This abbreviated process was established to allow Planning Commission to deal efficiently with the expected requests for driveway location problems, without involving the Council. In staffs opinion this process was not intended to apply to accessory structure setback variances, especially when such structures would not only be in violation of the special more restrictive standards for Sugar Woods, but would also not meet the less restrictive general zoning standards or the standards for the underlying R-1A zoning district. This item will, therefore, be sent to Council for final action. Statement of Hardship: The applicants have included their statement of hardship in Exhibit B. The applicants should also be asked for their testimony regarding this issue. Issues for Consideration: 1. 2. 3. Total property hardcover including the sport court and existing driveway, will be an area equivalent to just under 57% of the building pad area, meeting the 80% limitation. Will moving the sport court further away from the rear property line require less trees to be removed? Is there another location on the property for the sport court? Could it be located meeting the required setbacks? Applicant should be asked to provide a tree inventory map to assist in reviewing this issue. Outlot A was intended to provide an additional 50' buffer and protected area around the perimeter of the Sugar Woods plat. The expectation was that accessory structures would be buffered from the adjacent 2-acre lots by both the 50* outlot and the 50' setback requirement. There have been a small number of requests under the supplemental rules for driveway encroachment at the time of home construction. Driveways going straight in from the street are the only allowed hardcover encroachment of protected Sugar Woods yard areas; a few have been granted variances to angle in to protect specified trees. 5. Does Planning Commission have any additional issues or concerns with this proposal? Options for Action: 1.Recommend approval of variance to allow the sport court to be constructed on the property as shown on the survey. 2. A« ‘'“'Hy “f reviewed this -------19 9/ • . . .^J ___ r SUPPLEMENTAL SHEET TO BUILDING PERMIT APPLICATION FOR RESIDENTIAL CONSTRUCTION WITHIN THE PLANNED RESIDENTIAL DEVELOPMENT OF SUGAR WOODS SUBDIVISION In Addition to the plans, specifications and information requested in the Orono Building Permit Application packet, the following is required by special resolution of the Orono City Council of all applicants seeking to obtain a building permit within the Sugar Woods subdivision; 1. 2. 3. Your site plan must designate the Specific Building Setback Area for your lot. A) front 50', rear 50' and side 40' for Lots 1 through 4, Block 1; and B) front 50', rear 50' and side 30* for all other lots in Blocks 1, 2, 3 and 4. Per Orono resolution #2652, each lot shall be served by a single driveway/one curb cut at a 20* maximum allowed width. The driveway width shall be measured parallel to the loop road, Sugarwood Drive. The portion of the drive located within the front/street setback area shall be placed in a straight alignment from the loop road and shall not be curved. An inventory of all hardcover on the lot must accompany each application (see worksheet attached. Attachment A). All hardcover improvements on each lot shall be within the building pad defined as that portion of the lot that is not within the building setback area (exception; the driveway leading to Sugarwoods Drive located within the front building setback area, retaining walls and similar land ­ scaping structures that may be built within the front building setback area). The hardcover improvements for each lot shall not exceed 80% of the area of the building pad for each lot. The hardcover areas of each lot shall include the surface area on the ground of each of the following improvements on the lot (the inventory shall include allowed improvements within the front/street setback area); A) Footprint of each and every structural improvement on the lot, including each house, garage, accessory building, porch and covered walkway; B) All wooden decks and boardwalks regardless of the spacing between the planks on the surface; C) All driveways and parking areas that are paved or graveled; E) All walkways and patios that are covered with asphalt, concrete, paving blocks (regardless of the space in between the blocks), or covered with gravel, rock or woodchips upon an underliner (whether the underliner is impervious or not), but not those walkways that are dirt, grass or gravel, rock or woodchips without an underliner; J F) Each and every landscaped area with an underliner (whether the underliner is impervious or not), regardless of whetrher the area is covered with woodchips, stones, dirt or plants; Any swimming pool or wading pool; H) Any tennis court covered with concrete, asphalt or clay, but not any tennis court covered with grass. 4.Lot Coverage. Per Ordinance 80, 2nd Series adopted February 26,1990, the total combined footprint areas of all principal and accessory structures shall not exceed 15% of lot area. The following shall be included in calculation of lot coverage by structures: a) b) all roofed structures which extend more than 6* above grade level; tennis courts, patios, decks and all similar open structures when partially or fully enclosed by fences, railings or walls which extend more than 6* above grade level (if any portion of such structure extends more than 6' above grade level, the entire structure shall count towards lot coverage); pools, including pool basin and associated deck or patio areas, regardless of whether such pool basin, deck or patio is enclosed with a fence. 5. 6. 7. All lots shall be provided with a functional means or method of backing out. The City will not approve the backing out of motorued vehicles onto Sugarwood Drive. For all applicants who find they cannot meet the required standards for development within the Sugar Woods Planned Residential Development, please refer to Attachment B for special directions. Written confirmation from Rebers Construction that the building plans and site plan have been approved by the Architectural Review Committee for Sugar Woods. At the time a Certificate of Occupancy is issued for a new dwelling within the subdivision of Sufjar Woods, the City has agreed to execute and deliver to the owner of each lot a partial release of suMivider's agreement for that lot. Upon the recordation of such partial release of subdivider's agreement, the Registrar of Titles is authorized and instructed to remove from the Certificate of Title for the lot, the memorial of this instrument and the memorial of the partial release of subdivider’s agreement. Please contact the Building and Zoning Department (473-7357) if you have any questions concerning the directives listed above. Prior to any site preparation, tree cutting, land alterations or construction, the Building Setback Area must be defined on the site with plastic or wooden snow fencing. X 80%s.f. 1 1 •d Attachment B REVIEW PROCEDURE FOR ALL APPLICANTS UNABLE TO MEET SPECIAL REQUIREMENTS FOR RESIDENTIAL DEVELOPMENT WITHIN SUGAR WOODS PLAT All owners' or builders' seeking special consideration must submit a written request to the Zoning Administrator 7 days before the official Planning Commission meeting for the month (third Monday of the month). The City Council of Orono has approved an abbreviated review process for all such request whereby the Planning Commission shall assume the sole responsibility for the review and final recommendation regarding these special requests. Each applicant shall have the right of appeal before the Council of all decisions of the Planning Commission. All appeals to the Council shall be placed on the Council agendas for the following Monday (fourth Monday of the month). Applicants may find that the strict enforcement of these special requirements for residential development to not be practical nor functional when certain site conditions are found within a building lot. The following site conditions are listed below as examples to assist applicants in the preparation of their specific request: 1. the shape or limited area of a building envelope; 2. unique or mature trees within a building envelope or front/street setback area; 3. the topography of a building envelope; 4. desire to place house within a building pad so as to minimize impact on adjacent properties.
