2000 Assessment Local Board of Review
The 2000 Orono Local Board of Review has been scheduled for Wednesday, April 26^. As
preparation for the upcoming Local Board of Review, please find the enclosed data to hdp
you. A chart listing the amount of assessment growth for Lake Minnetonka communities,
an assessment fact sheet, and a book of sales with photos and characteristics from a sample
of sales throughout the city.
Summary of the 2000 Assessment
Each year estimated market values are analyzed along with data from the market.
Adjustments, as appropriate for each type of property, are made. The results of those
adjustments for the 2000 assessment are as fellows:
• Residential + 12.8%
• Commercial + 8.1%
• Industrial + 2.1%
There are 4,074 parcels in the city with a total market value of approximately
$1,239,977,800. This value includes $21,094,300 in new construction improvements. The
overall value increase for the City of Orono is 13.7%.

The purpose of this local board meeting is to review the Estimated Market Value and Classification for the 2000 assessment,
which will be reflected in taxes payable for 2001.
An> questions regarding the taxes pa> able in 2000 cannot be addressed at this meeting because the>' are based on the
assessment made in 1999. This Board has no authority to act on the 2000 taxes as per MN statute. Sec. 274.01.
While we realize the MN Propertx Tax sxstem is rather complicated and, at tunes, difTicult to understand, it is hoped that the
following information will help \ou when tr\ ing to communicate >our questions and concerns with regards to >our property's
market value.
State law requires that the value and classification of real estate be established as of January 2nd of each year. Market values
arc based on sales of properties w ithin your market area. The MN Department of Revenue requires tlic overall level of
assessment to be between 90% and 105% of market value If the overall level of assessment is not at least 90%, the state may
impose an aggregate increase on all properties w ithin a cit> or classification If sales indicated the market v alues hav e
changed, the assessor must follow tlic trend indicated, whether it is to increase or decrease property values.
Mass appraisal is the method used by assessors to estimate the market value of properties. Each property is physically viewed
cvciy four vears. In addition, all new construction, alterations, or improvements will be appraised annually.
COMMONLY ASKED QUESTIONS AT BOARD OF REVIEW MEETINGS
1. ISITILLEGAL FOR THE ASSESSOR TO INCREASE MY VALVE SO MUCHIN ONE YEAR?
No. The assessor must value property at market value each vear. Propertv v alues change continuously with
changing economic conditions. Tlicrc is no limit as to the amount of increase or decrease in propert) values in a

2. WHEN WILL THE VALVE INCREASES STOP?

estimated market values w ill increase. If sale prices are falling, then our estimated market v alues must follow
that trend
3. WHA T IX)ES THE ASSESSOR LOOK A T TO DETERMINE A PROPERITS MARKET VAL VE?
Each propertv is v lewed to gather information on all characteristics that affect its market value such as location, size,
age. quulitv of construction, amenities (i.e walkout basements, fireplaces, and extra baths), and site characteristics.

LOCAL BOARD OF REVIEW SUMMARY
• The valuation notices shall be in writing and be sent by ordinary mail at
least ten calendar days before the meeting of the local board of review.
The local board of review statutory requirements covered under M.S.
274.01.
• The meetings must be held between April 1 and May 31 each year. The
board of review must complete its work and adjourn within 20 days from
the time of convening stated in the notice of the clerk. Calendar days,
original night is day one.
• Local Boards of Review must see that all taxable property is properly
assessed, valued, and classified for all current assessments. The board
may consider both real and personal property.
• If any property has been omitted, the board must correct the assessment
by adding it to the list of assessments along with its market value.
• The board may not increase or decrease by percentage all assessments in
a district of a given class of property. Changes in the aggregate
assessments by classes are made by the county board of equalization.
• Although the local board has the authority to increase or decrease
individual assessments, the total of such adjustments must not reduce the
aggregate assessment by more than one percent. If the changes exceed
one percent of the aggregate assessments, none of the adjustments will be
allowed.
• The local board does not have the authority to reopen former assessments
on which ta.xes are due and payable. The board only considers
assessments in the current vear.
• The board may find instances of undervalued properties. The board must
notify the owner of the property that the value is going to be raised. The
property owner may then appear before the board if they so wish.
The board must have a majority of its members in attendance (quorum) to
validate any action that may be taken. In addition to the local assessor
the county assessor or one of his/her assistants is required to attend.
It is the primary duty of each board of review to examine the assessment
record to see that all taxable property in the assessment district has been
properly placed upon the list and valued by the assessor. The local
boards of review do not have the authority to address exemption issues.
Only the county assessor has the authority to exempt property.
A taxpayer may appear in person, by council, or written communication
to present his or her-objection to the board.
All changes will be entered into the assessment books by the county •
assessor ’s office.
• Before adjourning, the board of review should prepare an official list of
the changes. The law requires that the changes be listed on a separate
form. All assessments that have been increased or decreased should be
shown as prescribed on the form along with their market values. The
record must be signed and dated by the members of the board of review.
• The Hennepin County Board of Equalization will meet for two weeks
beginning June 19, 2000.
• All appointments must be scheduled before June 12, 2000 by calling

Per my earlier voicemail, I wanted to challenge the estimated market value of my home. The
market value is estimated to be S641,000, which I feel is vety high for my home.
I’m assuming that the definition that’s u^ed for market value is what my house would sell for if I
sold it today. If I were forced to sell my house it would certainly not be able to be sold for
$641,000 based on the current situation that I will detail below.
I live at the end of a point or peninsula and therefore, have only one neighbor. In order to get to
my house you must drive on a shared driveway right in front of my neighbor’s house. See
attached plot map for reference.
In 1999, the neighboring hou.se was sold to an individual, Tom Randgaard, who resides in
Minneapolis. Tom does not reside in the home and uses it almost e.xclusively for entertainment
purposes.
This home was the site, in 1999, of appro.ximately 10 major parties. A Upical party started on
Friday afternoon and continued until Sunday afternoon or evening. Parties were usually
attended by 20-50 people and many parties had 10-20 cars parked multiple days, filling up the
driveway and front yard.
Over the course of 1999, this house became notorious, since police were called on a number of
occasions due to blaring music, obscenities being shouted off the docks and other problems that
generally occurred between midnight and the early morning hours. Because of the numerous
police calls and severe problems, Orono has actually cited this house as a Disorderly House. I
don’t know how many homes in Orono arc cited as Disorderly Hous''s, but I have to believe
there are few, if any, others.
The notoriety of this house is so great in the community that I have been called for comment by
a local newspaper reporter doing a feature sloiy on the situation. When I have talked to a
number of Lake Minnetonka realtors and tell them where I live, their response is, “Oh, you live
ne.xt to the ‘parly’ house." Evciyone in the immediate neighborhood knows of this house and
many people that I’v e talked to that live around the lake are also aware of this house.
Since no one lives in this house on a regular basis and it’s used only for parties and entertaming,
little or no maintenance and upkeep has been done on the hou.se. Paint is peeling oft the house,
weeds in the flowerbeds are 3 to 4 feet tall, and storm damage from two years ago has left part of
a roof hanging off the liouse. I he house clearly has the l<K)k of a disorderly house and a house
who.se primaiy purpose is large, loud parties. The furnishings of the hou.se consist of
substantial electronic audio video ec|uipment, a pool table and electronic games and a large
number of mattresses strewn about the house on the floor.
In terms of what a situation like this does to property values, I suspect, as related to Orono,
there’s not substantial precedent to draw on. Particularly as relates to a situation where there is
only one neighbor and this is the neighbor. The reason people pay a premium plus ver>' high
property taxes to live in Orono is so they never have to face a situation like this.
I’m sure in calculating the market value of my home, you were unaware of the situation and
therefore didn’t factor it in to your market value. The market value for the year 2000 showed a
significant increase in value from 1999. Obviously given the situation I face now, the market
value of my home has not gone up.
If I’m correct in understanding that market value is defined as what I could sell my home for
now, the $641,000 figure is completely unrealistic. People spending that tvpe of money would
certainly not buy a home where your only neighbor was a disorderly house.
As indicated earlier, the situation I face with the disorderly party house is very well known in
Orono and the lake. Realtors that do business on the lake are well aware of the situation and I’m
sure that if my house were for sale and a realtor showed it, they ’d feel obligated to disclose the
disorderly house situation. It also would be a serious negative to have someone showing my
house have to drive a prospective buyer past my only neighbor with a front yard full or cars, loud
music blaring and the house in a total state of disrepair.
There may be other instances where there is a nuisance neighbor or disorderly house in a
neighborhood, but in that situation any individual house that bordered the disorderly property
would have other contiguous properties that could mitigate the negative effect and damage. I
doubt, however, there are many or any precedents that deal with a situation like mine, and
unfortunately the damage to my property value is greatly magnified because I have only one
neighboring property.
In my mind, given the circumstances outlii\ed above, I don’t believe the market value of my
house is half a million dollars or more. I believe if I had to sell today my house could be sold for
no more than $475,000-$499,000. I, therefore, strongly feel that for my appraised market
value to be consistent v\ith the true market value it needs to be lowered to this range.
Please advise what I need to do for next steps. Thanks much for your help in this matter.

In accordance with the process set forth in the Valuation Notice for 2000 taxes payable
in 2001, the following appeal is made regarding the Estimated Market Value and Market
Value for Taxation for tlie referenced property:
Background: I purchased The properly in June of I99S for $725,000, The property' had
been listed in 1997 without an offer and I made the only offer during the listing period in
1998. The home is in good repair and no remodeling has been done since it was
constructed in 1984, however, the design is not optimal from a layout standpoint. For
e.vample, the living room faces away from the lake and the master bedroom is a loft style
that IS without doors and is partially open to the Ih'ing room, kitchen, dining room and an
open stairwell. These issues, coupled with an abundance of stairs in the deign, served to
limit the market for the property.
The tax at the point of purchase was the highest on Casco Point- even though larger
houses with larger lots and greater lakcshore frontage were in the area. The following is

In short, my contention is this: The EMV for the property for 1998 was 100.7% of the
sale price and MVT was 98.6%. Other sales and subsequent sales and listings for the area
run in the 75-85% range of MVT. An equitable MVT for 1998/99 would therefore be
80% of the 725,000 sales price or $580,000.
At an increase of 7% per year, the 1999/2000 and 2000/2001 MVT's would be
5620,600 and $664,042 respectively. The 2000/2001 EM\’ would be $830,050 at a .50
ratio or 5749,652 at the proposed .8858 ratio in this years Notice.
I believe that tins proposed valuation is consistent with other properties of a like kind and
reflects the unique nature of the house.
