The following members were present: Mayor Jabbour, Council Members Barbara Peterson, Charles Kelley, Richard Flint and Bob Sansevere. The following represented City staff: City Administrator Ron Moorse and Recorder Alissa Wintemheimer. Mayor Jabbour called the meeting to order at 6:56 p.m. Council members were given results of the November 7,2000 General Hlection. Council Member Kelley moved, Council Member Sansevere seconded, to declare Barbara Peterson as Mayor for a 2-year term beginning in January of 2001, to declare Jay T. Nygard and Jim White as Council Members for 4-year terms beginning in January of 2001, and to certify the results of the November 7,2000 municipal election as follows: Mayor - Elect one for 2-year term Barbara Peterson William “Frenchy” Dampier Write-in receiving 2,751 votes receiving 1,310 votes receiving 37 votes Council Members - Elect two for 4-year terms JayT. Mayor Jabbour called the meeting to order at 7:02 p.m. CONSENT AGENDA 1.Approve/Amend Items 6,1 1,12,15, 16,17, and 19 were added to the Consent Agenda. Items 10 and 22, the Home Occupation Licenses, were removed from the Consent Agenda. Sansevere moved, and Peterson seconded, to approve the consent agenda as amended. Vote: Ayes 5, Nays 0. APPROVAL OF MINUTES *2. Regular Council Meeting of October 23,2000 Sansevere moved, and Peterson seconded, to approve the Minutes of the Regular Council Meeting of October 23,2000 as presented. Vote: Ayes 5, Nays 0. *3. Council Work Session of October 26,2000 Sansevere moved, and Peterson seconded, to approve the Minutes of the Council Work Session of October 26,2000 as presented. Vote: Ayes 5, Nays 0. RECOGNITION City Council Meeting November 13, 2000 4.Recognition of Officer Mark Tomezyk—Ucanlution No. 4560 Moorse read the Resolution recognizing Officer Mark Tomezyk for twenty years of dedicated service to the City of Orono on the Orono Police Department. Kelley moved, and Peterson seconded, to adopt Resolution No. 4560 recognizing Officer Mark Tomezyk for tiventy years of dedicated serv ice to the City of Orono on the Orono Police Department. Vote: Ayes 5, Nays 0. Mayor Jabbour stated that the Council would like to thank Officer Tomezyk for his dedicated service to the City. PRESENTATION 5.Melanie Deluca—Orono Area Sports Alliance Ms. Deluca stated that the Orono Area Sports Alliance was designed to strengthen community youth sports organizations, including the School District, volunteer youth sports associations, and the Cities in the School District. The Alliance works to make sports participation a positive experience for kids. They have invited all of the cities to become members. She saw two benefits to cities: 1) the organization supports good things for kids, and is therefore philosophically important, 2) it provides a forum to bring groups to one place at one time to discuss and resolve issues. The Alliance supports good standards for kids in all of the joining organizations, encourage training for youth coaches on safety and ethics issues, and they provide community outreach. Flint stated he supports the organization, but did not agree with their voting policy, especially the fact that the school district has 2 votes, and all other groups have 1. Ms. Deluca stated that the voting is not intended to bind the owners of facilities to the wishes of the Alliance. The goal is to help groups work to a consensus. She also stated that it looks like the school has an extra vote, but in reality, one vote is for the school district and the other is for volunteer sports programs that are not separate 501C3’s, like basketball, that are organized through the school district. Flint stated he felt the document would be better without the provision for voting. Kelley and Mayor Jabbour stated they aereed with Flint. Ms. Deluca stated that the Alliance is working with surrounding school districts by inviting anyone who wants to participate to come to their training sessions. Recently they attended a session in Wayzata, and the Alliance is open to other groups attending their functions. Kelley asked if Orono is the first city that she’s talked to about the program. Deluca stated that two other cities have signed off on the Orono Area Sports Alliance Agreement. Because of that, they can’t remove the voting provision after the fact. She i: I r City Council Meeting November 13, 2U00 5, Melanie Deluca—Orono Area Sports Alliance—Continued stated that Orono maychoose not to endorse the document, or to rescind support later if the Council doesn’t approve of the way the group functions. She also stated she would raise the voting issue to the group, and once it is functioning, they can change the voting provision. The group is supposed to consist of reprcsentati\ es from each participating organization or city, so it would be consistent. Flint suggested that Orono could support the Alliance, and send a representative who would not vote on any issues. Mayor Jabbour stated that he fears if the Alliance members vote on something, the City would then feel obligated to follow through. Ms. Deluca stated the Alliance will vote on internal issues that govern the running of the organization, but would never infringe upon another group s rights. Mayor Jabbour stated that although the Council disagreed with the voting provision and would not have a voting representative, they support the Orono Area Sports Alliance enthusiastically. No action was taken. PARK COMMISSION COMMENTS—PAULINE BOUCHARD, REPRESENTATIVE Ms. Bouchard stated that the Park Commission is making progress in Navarre Parle T^e equipment should be completely installed this year. The paving will probably not begin until spring. They have inventoried 38 or 39 lake access sites owned by the City. They will be able to report to the Council in January or February. Some of the access points were impenetra’ le from vegetation, the Commission will be returning to those sites to photograph them in the winter, without the vegetation coverage. At some sites they questioned the actual width of the access road. At other sites, adjacent property owners have encroached on the access. Mavor Jabbour stated that the Dakota Line has some opponents. Minnetonka Beach went to the Lafayette Club and the Lafayette Club passed a resolution against it. Mayor Jabbour stated he is grateful to the mayors of Minnetonka. Deephayen, and Minnetrista for their support. He stated he was bothered that State Representative Tom Workman took sides without discussing the issue with Orono. Mayor Jabbour has sent a letter to the Commissioner of Transportation explaining the issue. He asked that the Park Commission members also send letters in support of the Dakota Line project. Flint asked Mayor Jabbour to continue working with the Cit> on the Dakota Lineker he leaves office because of his background experience with it. Mayor Jabbour stated he would definitely continue his involvement in some capacit>. IiPkn a City Council Meeting November 13,2000 PLANNING COMMISSION COMMENTS—DAN KLUTH, REPRESENTATIVE Kluth stated that the Commission has been working with Long Lake on a process to develop a master plan and design standards for the downtown area and the commercial area along Highway 12. Kelley asked about the relationship with Long Lake. Kluth stated that Long L,.ke is currently fact-finding and polling citizens about the project. Most of the citizens who attend the meetings own businesses along Highway 12 and are in favor of a unified look, but are concerned about costs. Mayor Jabbour stated that the current Highway 12 will be turned back to the County ’, and Orono should be working with the County. The Planning Commission has also been working on the new residential planned unit development o.dinance. The ordinance is to provide guidelines for a senior housing development proposed for a piece of commercially zoned property. The ordinance would allow the Council flexibility when discussing special housing plans. Mayor Jabbour stated that the density of a development cannot affect height limits, thereby opening the door on high-rise housing. Kluth stated that the Planning Commission has seen a number of split votes on after-the- fact variances because the Commission is tom between weighing individual issues, versus sending a message to people who ignore building codes. The Commission requested direction from the Council. He was concerned that if too many after-the-fact variances go through, it would encourage people to ignore the codes. PUBLIC COMMENTS No;,'-. ZONING ADMINISTRATOR’S REPORT *6. #2594 Jim Johnson, 2240 Fox Street—Preliminar}’ Plat —Resolution No. 4561 Sansevere moved, and Peterson seconded, to adopt Resolution No. 4561 granting preliminary' approval for a two lot subdivision of property located at 2240 Fox Street, owned by Jim Johnson, PID 03-117-23-32-0009. Vote: Ayes 5, Nays 0. *7. #2605 John Doleman, 1680 Shady'wood Road —Variances Sansevere moved, and Peterson seconded, to send the application back to the Planning Commission for review. Vote: Ayes 5, Nays 0. ___..ouA. f-' ‘f ' 1*: City Council Meeting November 13,2000 8.#2626 William and Lynn Peterson, 420 Orchard Park Road—Variance and Right-oPiVay Vacation—Resolution No. 4562 Weinberger stated that William Peterson was present. The application requested a variance to the 5 acre lot area requirement to permit construction ot a new residence on the property. The property is a vacant parcel without direct access to a road. Access to the property would be via a 33 foot platted right-of-way that would be used for driveway access to the property. Applicants also requested vacation of a portion of the platted right-of-way that would not be used for driveway purposes. Weinberger explained that staff recommended approval of the variance to permit the lot to be considered a buildable lot that does not meet the 5 acre minimum lot size for the RR-1A zoning district. The lot would meet the 5 acre minimum, except that the public right-of-way reduces the lot size to 4.34 acres. Recommendation for appro\al is subject to the following conditions: 1.Applicant shall receive approval from MCVtT) for the land alteration within a wetland. Final Grading Plan for the driveway shall be approved by the City of Orono, "s Septic Sites shall be enclosed with a four foot orange snow fence prior to land alteration and grading on the lots as required by the On-Site Systems Manager. 4.Applicant shall enter into a Hold Harmless .Agreement with the City of Orono for the private driveway within the public right-of-way and agree that others requesting use of the public land ca.-. share a driveway if required. Staff recommended denial of the application for vacation until the property to the north is developed and legal access is secured to all properties. Mr. Peterson stated that lot 7, which is adjacent to his lot, would have nowhere to locate a driveway if the public right-of-way is vacated. He has spoken to his neighbor and offered an easement through his property for his neighbor's driveway. His neighbor is not opposed to vacating the roads. He stated that they had held a public hearing and the only person who showed up was his neighbor to the north, who is in favor of vacation. Mayor Jabbour stated that granting his neighbor an easement may not be possible because once a number of lots are serv'ed by a common driveway, they are required to be serviced by a cul-de-sac. Kelley stated he was in favor of keeping the City s options open as to future road development in that area. Mr. Peterson asked that condition 4 in the resolution, page 3 of 5, be reworded to read that he agree to share driveway access in the public land, and not the portion of his driveway on his private property, because he felt the current wording did not differentiate .«<(-■ihM-i-i -I viarr-rri I ^i-itr-r 1C.T: City Council Meeting November 13,2000 8.U2626 William and Lynn Peterson, 420 Orchard Park Road—Variance and Right-of-Way Vacation—Resolution No. 4562 —Continued between the public and private land. Flint moved, and Peterson seconded, to adopt Resolution No. 4562 granting a variance to Municipal Zoning Code Section 10.27, Subdivision 5(B) to permit the property to be a buildable lot where 4.3 acres exist and 5 acres are required for residential use and denying vacation of platted right-of-way, with the change to condition 4 stating that the right of the public to share his driveway shall only exist in the portion of the driveway on land currently owned by the City. Vote: Ayes 5, Nays 0. *9. #2627 WillmarThorkelson, 440 Big Island—Aftcr-the-Fact Variance Resolution No. 4563 Sansevere moved, and Peterson seconded, to adopt Resolution No. 4563 granting a variance to Municipal Zoning Code Section 10.31, Subdivision 8(C) to allow an accessory structure to be located 23 feet from the platted street right-of-way where 30 feet is required. Vote: Ayes 5, Nays 0. 10.#2628 Roger Anderson, 2200 Shadjwood Road—Variances—Resolution No 4564 Flint requested this item be removed from the Consent Agenda because he had a question about the letter from the City Engineer suggestion plantings along the lake front, which was not mentioned in the resolution. Gaffron stated that the letter was asking for a buffer on the land consisting of 15 - 20 feet of unmowed vegetation along the shoreline. Mr. Anderson stated that they will take proper erosion control measures during construction, including a silt fence and a swale just outside the 0 - 75 foot zone. Kelley stated he was not in favor of the vegetation, and that if the City wanted to encourage that form of erosion control, it should be done city-wide as an ordinance. Flint stated he was concerned that the recommendation was made, but not incorporated into the resolution. Gaffron stated that was because there was no ordinance to support the recommendation. Flint moved, and Kelley se<'onded, to adopt Resolution No. 4564 granting a variance to Municipal Zoning Code Section 10.25, Subdivision 6(B) to allow new residential construction on a 0.38 acre lot where 0.5 acre is required and having a lot width of 52 feet where 100 feet is required. Vote: Ayes 5, Nays 0. 13.Edward and Carol Callahan, 2545 North Shore Drive—Appeal of Administrative Decision Weinberger explained that Mr. Callahan contacted the City to explain he would not be able to attend the City Council meeting and requested that the applicaiion be tabled and placed on the agenda for the November 27*’’ meeting. Mayor Jabbour moved, and Peterson seconded, to table the item until the next City Council meeting on November 27, 2000. Vote: Ayes 5, Nays 0. MAYOR/COUNCIL REPORT Mayor Jabbour stated that when City Hall is allowed to be used for a meeting hosted by an applicant, people tend to conclude the City is supportive of the application, when in fact the City has not taken a stand on the issue. Mayor Jabbour suggested that a sign should be posted as a disclaimer to the public, stating that use of the meeting room does not indicate that the City supports the organizer ’s project or viewpoints. Kluih asked why private developers don ’t use school meeting rooms for their neignborhood meetings. They use the City Hall for their meetings because it looks official and gives people the impression that the City is already in support of their project. Sansevere stated he doesn t mind allowing every one to use the room, as long there is a disclaimer made that the City does not necessarily endorse their project. Mayor Jabbour stated that he is concerned about the Highway 12 project in Long Lake, because the Long Lake Mayor, City Council, and City Administrator will be changing. The new Mayor, Council, and Administrator will not be aware of the history of the project. .-----..................------------------------------------ilirnMi Wt\n m rarntfifTifW- iiiaan^ jtmrarw^t i ..J City Council Meeting November 13, 2000 8 PUBLIC SERVICE DIRECTOR’S REPORT 14.Old Crystal Bay Road (Orono Schools) Traffic Solution Gappa stated that Shelley Johnson from Bonestroo Engineering was present to answer questions. He explained that they conducted a peak hour study from 7:15-8:15 a.m. Tlicy found that daily traffic does not warrant putting in a signal. The middle school loop works well, as does the four-way stop sign, which keeps traffic moving, although slowly. They considered a temporary' stop sign, however State Statute 169.06 states that temporary stop signs are onlj' allowed for emergency purposes. He stated the school district and the police approve of the four-way stop sign and have received no complaints abou t it. They considered using a signal that flashes during non-peak hours, however, those aren ’t used anymore, and a regula.’’ signal is not warranted by the amount of traffic along the road. Gappa concluded that they are currently using the best solution, and Mr. Joh nson agreed. Mayor Jabbour stated that the school district is in favor of changing the road to a cul-de- sac. He feels that is a poor solution, and noted that all of the engineers present nodded agreement. Kelley stated he is concerned the traffic will increase with the size of the schools. He favored adding turn lanes to the road as shown in “Turn Lane Option 2," in the packet. He suggested directing the school board to install the turn lanes. Flint stated he feels the current system works well for the present. Mayor Jabbour recommended sending a letter to the school district reminding them that the four-way stop sign is currently functioning well to regulate traffic, but the City will continue to monitor traffic and the effectiveness of the stop sign. Based on their conditional use permit, the school district may be called on to install the turn lane system recommended in the future. Sansevere moved, and Peterson seconded, to approve installation of a four-way stop sign on Old Crystal Bay Road at the south middle/high school driveway, pedestrian crosswalk, based on Stop Sign Warrant 2B-5 No. 1 in the Minnesota Manual on Uniform Traffic Control Devices Manual, to approve installation of “No Passenger Loa ding and Unloading" signs in the no parking area along Old Crystal Bay Road in the vicinity of the Orono school ’s campus, and to instruct stall to send a letter to the school district informing them that they may be required to install turn lanes in the future per their conditional use permit. Vote: Ayes 4, Nays 1 (Kelley). *15. Request for Payment #6—2000 Lift Stations Project Sansevere moved, and Peterson seconded, to approve Request for Payment #6,2000 Lift Stations Project to Ford Construction Inc. in the amount of $16,671.87. Request for Purchase of Gasoline Dispensing Pump • Sansevere moved, and Peterson seconded, to approve purchase of replacement gasoline dispensing pump from Westside Equipment Company, Medina, Minnesota for S3,375 to be funded from the 2000 Capital Outlay Fund with the appropriate budget adjustment approved. Hennepin County Agreement for Property Information Data Resolution No. 4567 Sansevere moved, and Peterson seconded, to adopt Resolution No. 4567 authorizing Ihc City of Orono to execute an agreement for the use of Hennepin County s Property Information Data Base. CITY ADMINISTRATOR’S REPORT 18.Year 2001 Non-Union Employee Cafeteria Benefit Plan Contribution Flint stated that he kept this item off the Consent Agenda so that Council was aware of it. Moorse stated that every benefit earning City employee receives the same dollar amount, whether they have individual or family coverage, that can be used as the employee sees fit. Flint moved, and Kelley seconded, to approve a cafeteria benefit plan contribution maximum of S410 per month for the year 2001. Vote: Ayes 5, Nays 0. *19. Renewal of the City ’s Participation in the Livable Communities Program Resolution No. 4568 Sansevere moved, and Peterson seconded, to adopt Resolution No. 4568 electing to continue participation in the local Housing Incentives Account Program under the Metropolitan Livable Communities Act. Vote: Ayes 5, Nays 0. 20.Robert Erickson Request for Full Turning Movement Access at Highw ay 12 West of Willow Drive Kelley stated that he spoke to Walter Rockenstein to inform him that the Council would support a left turn access on the south side of Highway 12 west of Willow Dri\ e. Mr. Rockenstein hired an engineer to study the proposed left turn lane. His engineer said there was enough room for a turn lane at Industrial Boulevard. The other option was to r‘ Ll W-. City Council Meeting November 13,2000 20.Robert Erickson Request for Full Turning Movement Access at Highway 12 West of Willow Drive—Continued put a frontage road in across the golf dome to Washington Scientific. Kelley stated the frontage road would take a lot of cooperation from Long Lake. Orono would pass a preliminary resolution indicating their support. Mayor Jabbour stated that the City requires a letter stating that based on their support, Mr. Rockenstein and his client will cease and desist efforts in opposition to the new Highway 12 project. Mayor Jabbour directed staff to draft a b-ttcr for Mr. Rockenstein ’s signature, and to prepare a resolution indicating the City’s ’vpport for the concept of providing a full turning movement access on Highway 12 \'cst of Willow Drive that would serve Mr. Erickson ’s property. 21.Scheduling of Council Work Session The Council scheduled Work Sessions to be held at 5:30 p.m. on Monday November 27.2000, at 7:30 a.m. on Thursday December 7,2000, and at 7:30 a.m. on December 14.2000. Kelley suggested calling in the applicants in question. Flint stated they were all renewals, and he questioned how many employees they had in the past. Gaffron stated that none of the applicants had generated complaints. Flint stated that passing the renewals sets a precedent. Mayor Jabbour suggested making a conditional use permit to amend the code so the City can decide who can have outside employees and who can’t. He suggested sending a letter to the applicants indicating they are in violation of the Home Occupation licensing requirements. Flint moved, and Kelley seconded, to approve the Home Occupation License renewals of numbers 4. Jennifer L’Allier, 5. Ginger Scott, 7. Charles and Ann Anderson, and 8. John Waldron. Barrett stated that the City should set up two tiers of Home Occupation where those applicants with all employees living on the premises receive a license, and those with outside employees require a conditional use permit. BILLS Sansevere moved, and Peterson seconded, to approve payment of the All Funds Account. Vote: Ayes 5, Nays 0. MAYOR/COUNCIL REPORT—Continued Mayor Jabbour stated that all the Exit signs in City Hall should be replaced with LED lights because the current lights run hot enough to start fires. Mayor Jabbour stated that he had several parents tell him they were offended that their children could not hear the National Anthem because the DARE car was firing too loudly. A long-time advocate for Lake Minnetonka, Bob died peacefully this past month at the age of 82. We are grateful for the dedication Bob has given to a lake that was so dear to him. As another boating season concludes, the Save the Lake Advisory Committee continues Bob’s legacy of maintaining the recreational needs and environmental integrity of Lake Minnetonka. A key concern of the Committee is preventing the introduction of a second exotic, zebra mussels, into Lake Minnetonka. Unlike our native mussels, zebra mussels attach themselves to any hard surface in the water creating a nuisance affecting boat hulls, dock ladders, rocky beaches, etc. Recently, the MN DNR identified Lake Zumbro near Rochester as the first inland lake infested with zebra mussels. During the 2000 boating season, a billboard and poster campaign project was funded through the Save the Lake Committee to increase public awareness of zebra mussels. Additionally, Save the Lake funding was committed to the Lake Minnetonka Citizens Monitoring Program to check whether veligers, the microscopic immature form of a zebra mussel, are present in Lake Minnetonka. At this time, we are happy to report that veligers were not found in the lake. Other Save the Lake projects funded for the 2000 boating season included: •On-going monitoring of water quality. Hennepin Parks has concluded its sixth season of water quality sampling in various bays on Lake Minnetonka. This is becoming a valuable database v/ith past results available at the District office. •Complementing the efforts of the Hennepin County Sheriff’s Water Patrol. The purchase of public safety equipment to enhance the rescue efforts of the Water Patrol has been an annual project. A new project under consideration of the Save the Lake Committee is to partially fund an increase in Water Patrol presence for the 2001 boating season. •Promoting shoreline planting to prevent erosion and Improve water quality. An on-site demonstration workshop was held at Long Lake on September 9'*’. This workshop highlighted shoreline restoration techniques that are beneficial in preventing erosion and improving water quality. •Promoting boat safety. In April, the Minnetonka Power Squadron conducted a community education class titled “BoatsmarT. Those youth that successfully completed this safety course, v/hich was designed for 12-17 year olds, satisfied the MN DNR’s education requirements for a watercraft operator's permit. You can make a difference now with a year-end tax deductible to the Save the Lake fund. The Save the Lake Committee continues to work with other agencies to combine resources and expertise to best suit the needs of Lake Minnetonka. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicants and the effect of the proposed variance on tlie health, safety and welfare of the community. The applicants have submitted an application to Minnehaha Creek Watershed District for wetland alteration. The proposal is scheduled for the MCWD Board of Managers review meeting on November 28, 2000. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicants and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.55, Subdivision 8 to permit the construction of a private driveway through a wetland where no fill is normally allowed. Lot 2, Block 1 and Lot 3, Block 2 require a variance because they do not contain the required 200' lot width as measured at the 50' front setback line from the cul-de-sac, but do meet the 200' width standard if private road Outlot B is considered as part of the front lot line. Lot 3, Block 1 requires a variance because it does not have 200' of frontage abutting road Outlot B, but does exceed 200' in all dimensions. 6.The private road intended to serve the plat shall be constructed subject to the conditions of a developers agreement to be executed between the City and the developer. Standards for this road are as follows: Right-of-way Minimum Width: 50' Minimum Paved Width: 24' Base: 8" Class 5 100% Crushed Surface; 3" 2341 Bituminous Surface Cul-de-sac; 50' Minimum .Right-of-way Radius 40' Minimum Paved Radius 7.It is intended that the private road be privately owned and maintained. The City will require that the developer execute the standard road and utility easement over the private road, and shall execute the standard Declaration of Private Road Easement and Declaration for Maintenance of Same. It is intended that Outlot A be developed as a private road now, and that Outlot B shall be developed at such time that Lot 3, Block 1 is divided into 2 or more lots. Lot 3, Block ^ acres in area and is not required to be tested for drainfield sites. 13.Single family residences can be constructed on each of the new lots without the need for further variances. The Callahans have stated the building had suffered damages during the May, 1998 storm that they have requested to repair by applying for a building permit. The building permit was received on October 23,2000. Due to the follow ing observations the building permit was denied: 1.Repair to the existing structure would require replacement of the entire building. The intent is to save the concrete slab. A final determination regarding the structural integrity of the slab could not be made until the structure is removed. r \ h . i 2.The entire roof and rafters have rotted and shingles are damaged or missing. 3.Based on the existing condition of the building, the structure has extended beyond its useful life and the rotting of the comer posts and entire roof would require full replacement absent any damage that may have resulted from the storm. 4.The building is located approximately 2.5’ from the west property line. 5.The building is located approximately 12' from the existing shoreline of Lake Minnetonka. 6.The building is 12.5’ X 7.6’ in area (95 s.f.). The City of Orono had established an interim Building Permit Procedure for properties damaged during the storms in the Spring of 1998. A copy of the memo establishing the interim permit procedures has been attached. Structures with 75% or less damage were permitted to be replaced without meeting zoning standards (setbacks, hardcover, etc.) But did require a building permit review. The gazebo building owned by the Callahan’s would require, as has been proposed, the replacement of the entire structure which is beyond the 75% damage that would have been permitted under the interim permit procedures. »0 iT ' » Request for Council Action continued Page 2 November 13,2000 Callahan Appeal________________ Because over 2 years have passed since the storm and the entire building requires replacement it is Staff s position a variance would be required to replace the building. Unfortunately the City of Orono does not have any records relating to the condition of the building at the time of the May, 1998 storm. It is not known when the deterioration occurred, since the building has not been in use for more than 2 years. COUNCIL OPTIONS FOR ACTION 1.Approve the appeal to permit Staff to issue a building permit based on the procedures established for repairs/replacement to storm damaged structures. Making a finding the building had not extended its useful life at the time of the storm and not more than 75% of the building received damage. 2.Deny the appeal based on the condition of building after the May, 1998 storm. (Because a site inspection was not completed after the storm more than 2 years ago the condition of the structure at that time is not known.) A variance application would be required under this option if replacement is requested. I Residents wishing to make changes beyond the repair requires building and zoning review. Downed trees may be removed without inspection and approval. User is granted a perpetual, none.xclusive right to have and use the GI5 Data, provided User is complying with the terms and conditions of this License Agreement. User may use the GIS Data in the form provided by the Council for User’s own internal business or organizational purposes and for no other purpose, except upon prior written consent of the Council. User may modify* the GIS Data or merge the GIS Data into other data bases for User’s own use. User may incorporate the GIS Data into the User’s own User Products and may market, disclose or othenvise distribute such User Products provided the GIS Data are not duplicated or disclosed in the form provided to User by the Council. User may have and use the GIS Data on a corporate-wide basis and may use the GIS Dau on an unlimited number of User sites, provided the central processing units on which the GIS Data are maintained support only equipment operated by User and the GIS Data are used only for the conduct of the User’s own internal business purposes. User may make a reasonable number of copies, including backup copies, for User’s own internal business purposes. 2.02 Unauthorized Uses. User shall not use the GIS Data on behalf of any other inciyidual, organiz^ion, corporation, government entity, or any other third party, and shall not duplicate or disclose the GIS Data to any third parties unless such use, duplication or disclosure is expressly auihc.'ized in writing by the Council. User acknowledges and understands the Council is permitted by Minncioia law (Minnesota Statutes section 13.03, subdivision 3) to recover expenditures of public funds associated with the development of the GIS Data. User further acknowledges and understands the Council will be deprived of the opportunity to recover public funds used to develop'the GIS Data if a potential licensee obtains a copy of the GIS Data from User or from any source other than the Council. 2.03 Third Party Access. If • is necessary for User to make the GIS Data available to agents, contractors, consultants or other third parties for User’s business purposes. User must obtain from each agent, contractor, consultant or other third party a signed copy of the confidentiality agreerr.ent (GIS Data Bose Third Parly Confidentiality Agreement) which is attached to this License Agreement as Attachment A. 2.04 GIS Data Security. User agrees to take all necessarx' and reisonable steps to ensure the GIS Data are not disclosed, duplicated or made accessible in whole or in part for the use of others, e.xcept as provided in paragraph 2.03 of this License Agreement. User »grees it will not knowingly or negligently allow its employees, agents or independent contractors to couy, sell, disclose or otherwise make the GIS Page 2 of 5 Pages Data available to others. User agrees to immediately notify the Council by telephone ar.i in writing if User becomes aware of any unauthorized duplication, sale or other disclosure. The Council shall retain all rights, title and interest ir. the GIS Data, including the right to license to other users the GIS Data covered by this License Agreer.e.-t. III.License Agreement Term and Termination 3.01 Indefinite Term. The term of this License Agreement shall commence upon execution of this License Agreement by both parties and shall be indefinite, unless terminated according paragraph L - of this License Agreement. If this License Agreement is terminated by the Council, all rights to the GIS Data granted to User under this License Agreement revert to the Council. 3.02 Termination. This License Agreement may be terminated by the Council at any tirr.e upon ^rinen notice to User if User fails to comply w ith the terms and conditions of this License rtirsemen.. Unless terminated, this License Agreement shall remain in effect as long as User uses the GIS pita and complies with the terms and conditions of this License Agreement. When User no longer has tr.e right to use t e GIS Data, User either must destroy the GIS Data and provide written certification of tr.e dest^wtion, or return the GIS Data to the Council. The Council may terminate this License Agreer.ent if User has dissolved, liquidated or permanently terminated its operations. IV.Limited Warranty and Disclaimers 4.01 Limited Warranty. User’s sole and exclusive remedy for breach of these limited warranties shall be to return the GIS Data to the Council within sixw (60) days of receipt. The Council shall, at its own discretion, retain the returned GIS Data and refund the fee for the license, or replace or repair the GIS Data and return the GIS Data to User. 4.03 Liability. Subject to the warranty disclaimers in paragraph 4.01 of this License Agreement, each party agrees that it will be responsible for its own acts and omissions under this License Agreement and the results thereof to the extent authorized by law and shall not be responsible for the acts or omissions of the other party under this License Agreement and the results thereof. The Council’s liability for claims based on alleged or actual inaccuracies in the GIS Data arising from the use of the GIS Data is governed by Minnesota Statutes section 466.03, subdivision 21. Nothing in this License Agreement shall be construed as a waiver on the part of the Council, or any Public User, of any immunities or limits on liability* provided by Minnesota Statutes Chapters 3 or 466, or other applicable state or federal law. V.General Terms and Conditions 5.01 Invalidity and Severability. If any term or provision of this License Agreement or the application of this License Agreement or its provisions to any person or circumstance shall to any e.xtent be declared or found invalid or unenforceable, the remainder of this License Agreement shall not be affected by that invalidity or unenforceability. Each term and provision of this License Agreement shall be valid and ‘ enforced as w-ritten to the e.xtent permitted by applicable law. 5.02 Amendment. The terms and provisions of this License Agreement may be changed or modified only by mutual agreement of the Council and User. Such amendment, changes or modifications shall be effective only on the e.xecution of written amer.dment(s) signed by the authorized representatives of the Council and User. 5.03 Governing Law. This License Agreement shall be governed by and interpreted pursuant to the laws of the State of Minnesota, excluding its choice of laws rules, and applicable fede.ral law. 5.04 Waiver. No waiver of any breach or violation of this License Agreement shall constitute a waiver of any subsequent breach or violation, whether of the same or any other covenant, term or condition. Subsequent performance of any of the terms, covenants or conditions of this License .Agreement shall not constitute a waiver of any preceding breach or violation, regardless of the other party's knowledge of the preceding breach or violation at the time of subsequent performance. The delay or omission of any party’s exercise of any right arising from any default shall no: affect or impair the party’s rights regarding the same or future default. 5.05 Assignment. User shall not assign, sublet or transfer this License Agreement in whole or in part, without the prior written consent of the Council. The positions are the chair, and citizen members representing Commission District A (Metropolitan Council Districts 1 and 2), District B (3 and 4), District C (5 and 6) and District D (7 and 8) (see enclosed map). Parks and Open Space Commission appointments are governed under the Minnesota Open Appointments process administered by the Secretary of State; therefore, interested individuals should contact the Secretary of State’s office at 651/297-5845 for an application form. Completed applications are to be returned to the Secretary of State. The deadline for persons applying for these appointments is Dec. 22,2000. After receipt by the Secretary of State, the applications are forwarded to the Metropolitan Council. Applicants will be asked to appear for an interview at a public meeting conducted by a Metropolitan Council appointments committee. The public meeting(s) will be held in January, llie Metropolitan Council will also notify legislators in the affected district of the names and backgrounds of the applicants and solicit their recommendations. Following the public meeting, the appointments committee will meet to review the information received and develop an appointment recommendation. It is expected that appointments will be made by the Metropolitan Council in February. The Metropolitan Council invites local units of government to participate in this appointment process by encouraging citizens who have an interest in the woric of the Metropolitan Parks and Open Space Commission to become applicants. Qualifications for membership include: applicant must be a resident of the commission district for which they are seeking appointment, and shall not during the term of office hold the office of Metropolitan Council member, be a member of the Metropolitan Airports Commission or Sports Facilities Commission, or hold any judicial office.
