Representing staff were City Administrator Ron Moorse, City Attorney Tom Barrett, Senior Planning Coordinator Michael Gaffron, Zoning Administrator Paul Weinberger, Assistant Zoning Administrator Wendy Botlenberg, City Engineer Glenn Cook, Public Services Director Greg Gappa, and Recorder Alissa Wintemheimer. Mayor Jabbour called the meeting to order at 7:02 p.m. CONSENT AGENDA # 1.Approve/Amend Items 7,9, 10, and 13 were added to the Consent Agenda. Kelley moved, and Peterson seconded, to approve the consent agenda as amended. Vote: Ayes 5, Nays 0. 2.ASSESSMENT HEARING—EAST LONG LAKE SANITARY SEWER PROJECT —Resolution No. 4491 and 4492 Cook gave an overview of the project, explaining that a pi assure sewer system will be installed and connected to the City of Long Lake sewer system. The total project cost will be $194,607 divided among 11 units at a cost of $17,700 per unit including the grinder pump. Gappa explained that the assessment is $12,700 to get a sewer stub to the property. The property owner can choose to be assessed for an extra $5000 which will be provided by the City to use for the purchase and installation of the grinder pump. The assessments are for 15 years, the Council will adopt at 8% and sell bonds. He stated that the assessment hearing was the last chance to appeal the assessment, and that if the resolution passed, construction would begin next month. Dick Rinehart of 985 Old Long Lake Road asked when he would owe the City $12,700. Gappa explained that they levy the final assessment in October and property owners will have the option to prepay for 30 days. If it is not paid during that period, interest will begin to accrue and the assessment will be included with their 2001 taxes. Mayor Jabbour closed the Assessment Hearing at 7:10. A.Kelley moved, and Flint seconded to approve Resolution No. 4491 adopting the East Long Lake Area sanitary sewer improvements assessment roll. ORONO CITY COUNCIL MEETING MONDAY, JULY 10, 2000 2.ASSESSMENT HEARING—EAST LONG LAKE SANITARY SEWER PROJECT—Resolution No. 4491 and 4492 — Continued Vote: Ayes 5, Nays 0. B.Kelley moved, and Flint seconded to approve Resolution No. 4492 awarding the contract for the installation of sanitary sewer improvements in the East Long Lake Area to MinnComm Utility Construction Company, Mora, Minnesota in the amount of S90,760.00. Vote: Ayes 5, Nays 0. 3.ASSESSMENT HEARING—FOX RIDGE SANITARY SEWER PROJECT Resolution No. 4493 and 4494 Cook gave an overview of the project, explaining that a pressure sewer system will be installed and connected to the City of Long Lake system. The total project cost will be $242,430 divided between 11 units at a cost of $21,000 per unit including the grinder pump. Gappa explained that there are 9 properties in the Fox Ridge expansion area. Ten properties along South Brown Road were offered sewer and 2 property owners opted to connect to the sewer. He reminded people that the hearing was their last chance to appeal the assessment. Dave Phelps of 1950 Fox Ridge Road asked when property owners need to decide whether or not to take the $5,000 assessment for the grinder pump. Gappa stated they should decide in October when the City sends out notices for the prepay period. Bonnie Ease of 15 South Brown Road asked why the assessment has gone up since the public hearing. Gappa explained that at that time, they were not sure how many units along South Brown Road would join the sewer so they estimated 3 would join. Only 2 joined so the total cost was divided among 11 units instead of 12. Ease asked if the cost would decrease if more people joined later. Mayor Jabbour stated that if more people sign up, they will not be able to continue with the project because every unit that hooks up to the Long Lake sewer takes a unit away from Long Lake and there is a finite number of units that can connect to the sewer. Adrian Kiemey of 265 South Brown Road asked where the hook up would enter his lot. Gappa explained that they would work with each property owner to place their hook up. Mayor Jabbour closed the assessment hearing at 7:20. A.Sansevere moved, and Peterson seconded, to approve Resolution No. 4493 adopting the Fox Ridge Area sanitary sewer improvements assessment roll. ORONO CITY COUNCIL MEETING MONDAY, JULY 10,2000 3.ASSESSMENT HEARING—FOX RIDGE SANITAR YSEWER PROJECT Resolution No. 4493 and 4494—Continued B.Sansevere moved, and Kelley seconded, to approve Resolution No. 4494 awarding the contract for the installation of sanitary sewer improvements in the Fox Ridge Area to MinnComm Utility Construction Company, Mora, Minnesota in the amount of $127,970.00. Vote: Ayes 5, Nays 0. Dave Phelps thanked the Council and City staff for working diligently and patiently with the Fox Ridge neighbors on the sewer project. APPROVAL OF MINUTES *4. Regular Council Meeting of June 26,2000 Kelley moved, and Peterson seconded, to approve the Minutes of the Regular Council Meeting of June 26,2000 as presented. Vote: Ayes 5, Nays 0. PARK COMMISSION COMMENTS—RICK MEYERS, REPRESENTATIVE Meyers stated that at the July 5,2000 meeting the Park Commission reviewed bids on Navarre Park and unanimously approved the low bid. They are trying to acquire the property in Hackberry Park and are working with the property owner. They feel it would be to their advantage to work with the current property owner. They also discussed the plat maps of Saga Hill. Mayor Jabbour stated that the City is very close to getting the Dakota Line issue behind them. He also mentioned the Saga Hill parking lot. Meyers stated that if they decide to increase the parking lot size, as previously planned, he hopes the neighbors will not be upset. The size increase would correspond to development plans for the future. PLANNING COMMISSION COMMENTS—DALE LINDQUIST, REPRESENTATIVE None. M'm. ZONING ADMINISTRATOR’S REPORT 5.#2550 Charles Van Eeckhout, II ) Brown Road South—Subdivision for Planned Residential Development —Referral Back to Planning Commission Weinberger staled that he had received a written extension to August 31,2000 from the applicant. Kelley moved, and Peterson seconded, to refer the application back to the Planning Commission for review of a re\ised plan with alternative access via Apple Glen Road. Vote: Ayes 5, Nays 0. 6.#2574 Tom Micheletti, 519 Femdale Road North—Variance Moorse stated that the applicant had waived his 120-day statutor>' review period and asked that the application be continued. Flint moved, and Peterson seconded, to table item 6. Vote: Ayes 5, Nays 0. *7. #2588 Robert Pieper, 3995 North Shore Drive —Preliminar> Plat—Resolution No. 4495 Kelley moved, and Peterson seconded, to approve Resolution No. 4495 granting preliminary approval of a plat at 3995 North Shore Drive, owner Robert Pieper. 8.#2589 Woodhill Country Club, 200 Woodhill Road—Conditional Use Permit Resolution No. 4496 Weinberger explained that the applicant wants to amend a conditional use permit from 1968 to permit a 19-foot by 52-fooi addition to an existing bam structure on the property. The structure has been used primarily for parties in the winter. The proposed expansion would increase the structure size by 988 s.f. and would improve the kitchen and restroom facilities, as well as provide more usable space. They also want to connect the bam and potentially the maintenance building to sewer on a property outside of the MUSA. In 1996 the City was granted the ability to connect up ORONO CITY COUNCIL MEETING MONDAY, JULY 10,2000 I I J3 ‘ 8.U2589 Woodhill Country Club, 200 Woodhill Road—Conditional Use Permit Resolution No. 4496 —Continued to 50 existing residences with a failing system and no replacement possibilities to existing sewer lines outside the MUSA. The Woodhill bam is not a residence, but does have a non-conforming system due to the 3-foot separation issue and is a quasi­ commercial use that should be connected to sewer. The City has permitted other similar uses, like churches, to connect. The Planning Commission voted 2-2 (failed motion) to recommend approval of the application. Two members of the Planning Commission did not vote in favor of the application because of unresolved issues with the Woodhill Avenue access to the property. Staff recommends approval of the conditional use permit to allow expansion of the building by 988 s.f subject to the following conditions: 1. 2. 3. 4. Access for all contractors and equipment shall use the County Road 15 entrance to the Country Club. The building shall meet Fire Code protection standards. The building shall meet the minimum 10-foot setback to the septic tanks. Evidence of a standard septic system to accommodate the proposed use of the building or connection to sanitary sewer only if approved by the City Council. Mr. Edge Jackson, President of Woodhill Country Club, stated that they do not intend to expand parking. The building was last updated in 1965. The use of the bam is not expected to change. They have about 40 parties per year in the facility, 88% ot them are in the winter months, party size tends to be at 35 - 40 people, and most occur in the afternoon. Mayor Jabbour stated that the Planning Commission had not approved the conditional use p>em«it because of unresolved issues with a conditional use permit granted last year allowing use of the back access road. He asked Jackson to explain what measures the Club has taken to address these issues. Jackson stated that in the July issue of the Club newsletter, and every issue since, they have printed reminders and warnings to Club members to not use the road except as designated by the conditional use permit. They have posted 4 signs along the road. They have irregularly posted a guard along the road. They posted a sign near the time cards saying that illegal employee use of the road is cause for termination. They have started a logbook to record the times the gate is opened and closed. They conducted 2-week long traffic studies to record road usage in April and June 2000. The data showed that incoming traffic follows their estimated projections, averaging 30 cars per day. On any given day, 4-5 cars use the road per hour. r » I ORONO CITY COUNCIL MEETING MONDAY, JULY 10,2000 8.H2589 Woodhill Country Club, 200 WoodhiU Road—Conditional Use Permit Resolution No. 4496—Continued Shelly Storch of 1245 Woodhill Avenue stated that the Planning Commission denied the motion to approve the conditional use permit because they weren ’t comfortable with expanding the use of the bam, which would increase use of the back entrance. She stated that neighbors offered several solutions to the road use issue to Mr. Jackson and Mr. Albrecht and that the suggestions were rejected without discussion. She stated that she gave Jackson her phone number to further discuss the issue and he never called. She claimed that since the Planning Commission met, misuse of the road has continued and the neighborhood has experienced its first case of vandalism, possibly due to the increased use of the road. She stated that the road is being used in the wrong direction, commercial vehicles use the road, and the gates are not closed on time. When Storch calls the police they do not respond, saying they are unaware of the specific regulations on the road. Storch stated that the Club considers their addition a maintenance issue with an existing building, but that it is clearly a sizable expansion that is intended to increase the use of the facility. She believes the expansion would directly and adversely affect use of Woodhill Avenue and would overstep the Club’s right to operate in a residential neighborhood. She stated she believes any expansion of the Club’s use when they are not in compliance with the existing conditional use permit regarding the road would be irresponsible. She stated she and her neighbors have complained to the police and City Council members and have been ignored. She stated based on the reported problems, the City has a responsibility to review the Club’s conditional use permit in its entirety and to refrain from expanding the Club’s use, to do otherwise puts the City at risk for liability for selective enforcement. The Club is dependent on special zoning for its very existence and it adversely affects a residential neighborhood. The only reason the Club wants to expand the bam facility is so that they can throw bigger parties—it is not a compelling reason, or a necessity, according to Storch. Mayor Jabbour stated that he offered to host a meeting between the two parties to discuss the issue, and he publicly extended the offer again. He stated that he has no problem with the Club expanding their business and that the proposed expansion is not unreasonable. He felt the Club has an enforcement issue related to use of the Woodhill driveway, but that it is a distinct issue from the bam expansion. Storch stated that she would be happy to discuss with the Club how they can enforce their rules, but that she would not be happy to discuss how they can further compromise her lifestyle to the benefit of the Country Club. She stated she is being held hostage by the Club’s fraud and the City Council ’s inactivity —her children can ’t safely use the road they live on because of traffic from the Club’s drivewaj; She stated she was sold her property with the understanding it was located on a cul-de-sac. ORONO CITY COUNCIL MEETING MONDAY, JULY 10,2000 t 8.#2589 Woodhill Country Club, 200 WoodhUl Road—Conditional Use Permit Resolution No. 4496—Continued Mayor Jabbour stated he simply wanted to distinguish between the bam expansion application u.id the road use issue. Storch stated she has been ignored and abused by the City and the Club and has spoken to an attorney about a selective enforcement suit. She has been looking at homes in other cities because of the issue. She stated the City does not take her complaint seriously. Mayor Jabbour stated they would continue to do what they can to help both sides find a resolution to the issue. Storch stated the City was vsTong to open the driveway in the first place. She said the City could expect a call from her lawyer and exited the Council Chambers. Sansevere asked Jackson if there was anything more they could do about traffic exiting on Woodhill Avenue. Jackson stated there is not. They have had a good response to the last newsletter. He stated they could not find the blue Omega Storch claims comes out of the drive at 3:15 every day. Short of hiring a police officer, he does not feel there is more they can do to enforce the rules. Jane Delaney of 1315 Woodhill Road stated that she has not seen City representatives monitoring the road traffic. She has literally stepped in front of cars coming out of the drive to stop them, and they have been driven by Club employees. She feels there should be a mechanical gate at the drive entrance to stop cars from exiting onto Woodhill Avenue. She stated she is not concerned about the Club adding on to the bam facility, except that it will increase traffic on Woodhill Avenue. She stated that when she has called the police, they claim they are unaware of the ordinance and won ’t respond to her call. She stated that the laws regarding use of the drive have been in place for a year, people are violating the laws, and it is the City’s job to enforce them. Sansevere stated that the Club is being proactive in their efforts to stop outgoing traffic from using the road. He stated that the road issue should not prevent the Club from receiving a conditional use permit for the bam expansion. Flint stated he has faith in Jackson to resolve the road issue. Peterson stated that she agreed the bam expansion is a separate issue from the road issue. Flint moved, and Peterson seconded, to approve Resolution No. 4496 approving a Conditional Use Permit Amendment per Municipal Zoning Code Section 10.28, Subdivision 3 to permit a 19-foot by 52-foot addition to the barn structures r.nd to permit sanitary sewer connection to the property for the portion of the property not within the MUSA boundary. t • ORONO CITY COUNCIL MEETING MONDAY, JULY 10,2000 8.#2589 Woodhill Country Club, 200 Woodhill Road—Conditional Use Permit Resolution No. 4496—Continued Vote: Ayes 4, Nays 0 (Kelley removed himself from the discussion of and vote on item 8). *9. #2591 Gina Hansen, 583 Park Lane—^Variance—Resolution No. 4497 Kelley moved, and Peterson seconded, to adopt Resolution No. 4497 granting a Variance to Municipal Zoning Code Section 10.24, Subdivision 5(B) to allow a side yard setback of 3-feet where 10-feet is required to permit construction of a second story to the existing residence. Vote: Ayes 5, Nays 0. *10. #2592 Mike Hilbelink and John Vogt, 350 Stubbs Bay Road North Preliminary Plat—Resolution No. 4498 Kelley moved, and Peterson seconded, to adopt Resolution No. 4498 granting preliminary approval of a plat at 350 Stubbs Bay Road North, owners John Vogt and Mike Hilbelink. Vote: Ayes 5, Nays 0. 11.#2595 Erotas Building Corporation for Sharon Tapani, 781 Ferndale Road North—Conditional Use Permit—Resolution No. 4499 Bottenberg stated that the applicant has applied for a conditional use permit to allow plumbing in an accessory building that will function as a pool house. It will be located next to the pool and behind the existing residence. It will include a changing room with a sink, toilet, and shower. The applicant had nothing to add. Mayor Jabbour moved, and Peterson seconded, to approve Resolution No. 4499 granting a Conditional Use Permit per Municipal Zoning Code Section 10.20, Subdivision 3(Q) to allow plumbing in an accessory structure to include a toilet, sink, and shower. Vote: Ayes 5, Nays 0. MAYOR/COUNCIL REPORT Mayor Jabbour stated he had attended a mayor’s meeting where they unanimously supported adding officers to the lake to better enable the sheriff to enforce water safety laws. The Council discussed the process for arresting a boater for Boating While 8 ORONO CITY COUNCIL MEETING MONDAY, JULY 10,2000 MAYOR/COUNCIL REPORT—Continued Intoxicated and how the process removes an officer from patrolling the lake for an extended period of time. Mayor Jabbour passed out a sheet detailing what it cost the City in legal defense against a minor claim. Staff time not included, the City spent $96,000 defending a claim that never went to trial because the City won in summaiy judgment. Mayor Jabbour stated he has spoken with the head of firm interested in the Washington Scientific property. Sansevere stated there is a problem with boating traffic near the North Shore Drive boat launch. People taking the boat to pick up the person who parked their car are cutting across boat traffic and nearly causing accidents. Mayor Jabbour suggested sending a letter to the DNR asking them to enforce boating rules. Flint stated that if the City wants to do anything with the Minnehaha Creek Watershed District next year they should act quickly to get it approved in their budget. PUBLIC SERVICE DIRECTOR ’S REPORT 12.Award Contract—Navarre Park Improvements Gappa stated that they have removed everything from the plan except the play equipment and the handicapped accessible paths. They had planned to spend $80,000, but the low bid came in at $95,000 for the equipment, curbing, special wood chips, and path. The Park Commission would like to have a hydrant in the park, which adds $5,000 to the cost, bringing the total cost to $100,000. He stated the Park Fund has $170,000 at its disposal after paying for the Larson property (half from the General Fund and half from the Park Fund). Flint stated that he hates to spend that much money, but he feels that the park and neighborhood improvements are a priority. Kelley and Peterson agreed. Kelley questioned if the City should wait and spend the money on a play area on the larger Larson property. He pointed out that the Larson property is in close proximity to the Navarre Park and once developed, it could draw users away from the Navarre Park, leaving the park underused. Meyers stated that due to the topography and condition of the area, it would cost at least $500,000 to get a usable park on the Larson property. He stated that area would not be developed into a park for approximately 5 years, and it would be easy to move the play equipment from the Navarre Park to the Larson property in the future, and turn the Navarre Park into a village green type area. ORONO CITY COUNCIL MEETING MONDAY, JULY 10,2000 12.Award Contract—Navarre Park Improvements —Continued Sansevcre moved, and Flint seconded, to award a contract for Navarre Park Improvements that includes a contract change order to install water service in the park to Kolmo Construction, Andover, Minnesota in the amount of $100329. Extension of Due Date for Comprehensive Plan Update—^Resolution No. 4500 Kelley moved, and Peterson seconded, to adopt Resolution No. 4500 requesting extension of the due date to August 31,2000 for review of the City of Orono Comprehensive Plan for consistency with amended Metropolitan Council Policy Plans. Vote; Ayes 5, Nays 0. 14.Promotions to Police Sergeant Positions Moorse explained that PDI conducted testing to determine 4 finalists. Candidates were evaluated using 4 instruments: a promotability index, a panel interv iew, a written test, and an experience ranking. Based on PDFs test results, 4 finalists were presented to Moorse and the Police Chief, who interviewed the finalists and selected the 2 candidates to be promoted. Peterson stated that she personally called PDI to get the testing results. Sansevere stated that there was a glaring disparity in promotabil-'y index scores between the top two and bottom two candidates, but that scores on the other tests were very similar. He also stated that he would not vote because he felt the decision to promote should be made by the new Chief of Police. Mayor Jabbour stated that the Council voted to hire PDI and handle the promotions before the new Chief arrives and that they should continue the process now. He also stated that the City has professional people managing the promotion process and the Council should support their decision. Flint moved, and Kelley seconded, to appoint Correy Famiok and Jay Dembouski to the position of sergeant at the current Level 5, Step III pay rate of $25.16 per hour, effective July 11,2000. Council Member Bob Sansevere was absent. Representing staff was City Administrator Ron Moorse. Mayor Jabbour called the meeting to order at 7:30 a.m. CITY ADMINISTRATOR’S REPORT 1.Approval of Ballot Question for Consolidation Referendum Moorse explained that the language of the ballot question regarding the consolidation of Long Lake and Orono needs to be provided to the County Elections Office by Tuesday, July 18 in order to be on the ballot for the September 12 primary election. Kelley moved, Peterson seconded, the adoption of a resolution approving the language of the ballot question for the consolidation referendum. Vote: Ayes 4, Nays 0. Flint questioned the need to include in the ballot question the phrase "to be legally named Orono". It was discussed that the ballot question references the "Plan for Merger and Implementation", which sets out all of the details of the consolidation, including the name of the city. It was also discussed that everyone who votes on the question will know the proposed name of the new city. Jabbour asked whether the consolidation statute requires the ballot question to include the name of the new city. Moorse indicated he did not know but would find out. Jabbour moved, Flint seconded, an amendment to the previous motion to eliminate the phrase "to be legally named Orono" from the language of the ballot question if it is not legally required to be on the ballot. The proposal involves tearing down an existing dining room that currently does not have a foundation under it. In the same location, construct a foundation and above it a dining room and 3 season porch. The dining room will be in the same location and the 3 season porch is where the deck is currently located. The addition will be slightly larger than what currently exists because the walls tire bumped out to be in alignment with the existing residence. The residence was built in 1 963 and the section to be removed was added on in 1968, both before current zoning standards were adopted. COUNCIL ACTION REQUESTED: To adopt or amend the enclosed resolution. A RESOLUTION GRANTING A VARIANCE TO MUNICIPAL ZONING CODE SECTION 10.27. SUBDIVISION 5(B), FILE NO. 2597 WHEREAS, Dennis M. Krump, (hereinafter "the applicant") is the owner of the property located at 25 Stubbs Bay Road North within the City of Orono (hereinafter "the City") and legally described as follows: That part of the Southwest quarter of Section 32, Township 118 North, Range 23 West of the Fifth Principal Meridian described as follows: Beginning at a point on the East line of said Southwest quarter distant 264 feet North of the Southeast comer of said Southwest quarter; thence North along said east line a distance of 66 feet; therce deflecting to the left 103 degrees a distance of 90 feet; thence reflecting to the left 56 degrees to a line drawn parallel with the South line of said Southwest quarter from the point of beginning; thence Easterly along said line to the point of beginning, Hennepin County, Minnesota (hereinafter "the property"); and WHEREAS, the applicant has applied to the City for a variance to Municipal Zoning Code Section 10.27, Subdivision 5 (B) to allow a front yard setback of 42' where 100' is required and a side yard setback of 24.2' where 50' is required to permit an addition to the existing residence. WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on July 17,2000, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1 .This application was reviewed as Zoning File #2597. 2.This property is located in the RR-1A Zoning District, where 5 acres is the minimum lot area. The property consists of approximately 1.195 acres or 52,050 s.f. Page 1 of6 ( I ii'i II I a'lariiiiri ri III •inTn-nrTn -■t i niw rw^ 3.The Orono Planning Commission reviewed this application on July 17, 2000 and recommended approval by a vote of 5 to 0. 4.The Planning Commission made the following findings of fact: A.The structural coverage on the lot will increase slightly, but still well below what is allowed. B. C. D. The addition within the side yard setback will not adversely affect the neighboring property. The addition will be in the same location as the existing part of the house that is being removed. The south side of the residence is currently located 27.5' from the side lot line where 50' is required. The addition will encroach 3.3' further into the side setback. 5. 6. E.The residence was built prior to adoption of current zoning standards. F.The lot is extremely undersized and ntirrow for the RR-1A zoning district. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance will not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. Page 2 of 6 CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.27, Subdivision 5 (B) to allow a front yard setback of 42' where 100' is required and a side yard setback of 24.2' where 50' is required to permit an addition to the existing residence. Approval is subject to the following conditions; 1.Council approval is based on the site plan submitted by the applicant attached to this resolution as Exhibit A. Any amendments to the site plan may require further Planning Commission and City Council review. Applicant is advised that if this project ultimately results in substantial removal of the existing residence due to unforeseen circumstances, the City Council shall have the right to reconsider this approval to determine whether the conditions of this resolution remain applicable. 3.Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or these variances will expire on that date (July 24, 2001). 4.Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5.The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, his successors and assigns, hereby agrees to tlie recording of this resolution in the Chain of Title of the property. SUBDIVISION 16(C), FILE NO. 2598 WHEREAS, Douglas J. Dayton, (hereinafter "the applicant") is the o\vner of the property located at 300 Sixth Avenue North within the City of Orono (hereinafter "the City") and legally described as follows: That part of northwest 1/4 of southeast 1/4 lying northerly of County Road Number 6 and commencing at a point in east line of government lot 3 distance 1082 2/10 feet north from southeast comer thereof then west 100 feet then south to northerly line of County Road North 6 then northerly along said northerly road line to west line of government lot 3 then north to northwest comer thereof then east to shore of Kegan Lake then southerly and easterly along said lake shore to east line of government lot 3 then south to beginning except road, Hennepin County, Minnesota (hereinafter "the property"); and WHEREAS, the applicant has applied to the City for a variance to Municipal Zoning Code Section 10.56, Subdivision 16 (C) to allow a lakeshore setback of 80' where 100' is required to permit an addition to the existing residence. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1.This application was reviewed as Zoning File #2598. The Orono Planning Commission reviewed this application on July 17, 2000 and recommended approval by a vote of 5 to 0. 4.The Planning Commission made the following findings of fact: A.The structural coverage on the lot is not a concern, nor are hardcover or average lakeshore setback. B.The existing residence is currently located 83' from the lakeshore where 100 ’ is required. C.The residence was built prior to current zoning standards. D.Granting of the variance will have no impact on neighboring residences. E.Due to the location of the ’nouse and its interior layout, there is no practical way to locate the proposed closet addition in a conforming location. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance will not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.56, Subdivision 16 (C) to allow a lakeshore setback Page 2 of 5 ___ V • Ff ;■ li i- of 80' where 100' is required to permit an addition to the existing residence. The applicant has stated he would like to use the larger building to store snowmobiles, automobiles and house a workshop. Mr. Kerber also owns a seeding service and would store his truck and trailer within the building. The property is located in the 5 acre “rural” area of the City along County Road 6 and Orchard Park Road. There are two adjacent residential properties. Neither of the buildings would be’fully visible to adjacent properties, and would not be visible to the property to the south based pn the mature trees between the lots. The house, across Orchard Park Road, is blocked from view to much of the applicant ’s property by mature trees along the road. Reducing the size of the pole bam to 2,000 s.f would allow the applicant to build the structure without the need for a.varijmce. Relocating the stmeture to another portion of the property would not be possible .without replacing the septic system, which is depicted on the site survey. The existing system has been determined to be non-compliant due to the 3' separation to the water table, however it is not required to be replaced until2010. Additionjl'testing has been completed to locate a future primary and secondary site on the west side of the* property. The proposed location of the bam would best utilize the driveway. The garage is located approximately 88' to the side (County Road 6) property line. Mr. Kerber would like to relocate the building to accommodate the pole barn location. Brian Kertjer 740 Orchard Park Rd Orono We were retained by Brian Kerber to provide criteria for the on-site sevrage system for the property located at 740 Orchard Park Rd. In the Ciiy of Orono There vrere a total of 6 soil borings and 4 percolation tests done on this site and it appears that there is room for a new primary and alternate sites for septic systems on this property. This is based on a three bedroom, type one, single family home with maximum flow of 450 gallons pe.' day. This house exists on this lot at this time. From these tests it was determined that a high water table exists at a depth of 16 to 24 inches below the ground surface. The high water table determines that only a mound type dralnfield may be installed, to meet with code. Percolation tests range from 6 to 12 minutes per inch on the two sites tested. All neighboring wells are located greater than 100 feet from the proposed drianfield site. See attached sketch for locations. These areas must be protected from any traffic to be used for any future septic sites. If they are not protected the data collected herein will become Void and new testing shall have to take place. This design is in compliance with local codes and Minnesota Pollution Control Chapter ''080 as of the date listed above. Location Map Property Survey Building Plan Standards for B-l Retail Sales Business District Background: The City of Orono has issued a building to allow additional remodeling of the Narrows Saloon which includes expanding the bar into the former Minnetonka Photo space, now vacated. The property is located in the B-l Retail Sales Business District in which a Class II Restaurant is defined as a restaurant which serves intoxicating liquor or has live entertainment. Expansion of the building requires the owner to obtain a conditional use permit since Class II Restaurants are allowed by CUP. Mr. Anderst has met w ith Staff and has made a formal application for a Conditional Use Permit to be reviewed by the Planning Commission on August 21,2000. However, he would like to continue the remodeling under the existing building permit that has been issued even though a conditional use permit should have been required before the building expansion began. City files indicate no CUP has ever been issued for a restaurant on this property. The use has required a CUP in the B-l zone since, at least 1967. Expansion of the facility into the former Miimetonka Photo space and a 4' addition to the bathrooms now requires a conditional use permit. Also, the B-l district requires a commercial site plan review before a building permit can be issued. Normally a commercial site plan review has not been required for minor interior space remodeling, but this application involves expansion of the building envolope. Mr. Anderst has requested approval to proceed with the interior remodeling and restroom addition, which have been started. The restrooms are being expanded for handicapped accessibility. The Narrows Saloon would be required to obtain a conditional use permit which has been applied for, but will not be reviewed by the Planning Commission until August 21,2000. The conditional use permit would permit live entertainment and expansion of the floor area. B-1 RETAIL SALES BUSINESS DISTRICT. Subd. 1. Purpose. The "B-l" Retail Sales Business (District) is intended to provide a district for businesses that supply commodities or perform a service primarily for residents in the surrounding neighborhood. TTie district may adjoin residenti-il districts or other business districts which are subject to more restrictive controls. The district shall have immediate access to adequate highways and public sanitary sewer. Subd. 2. Application. All applic?tions for a building permit in any "B-l" Retail Sales Business District shall be reviewed by the Council and may be referred to the Planning Commission for review. Subd. 3. Permitted Uses Within any "B-l:" Retail Sales Business District, no structure or land shall be used except for one of the following uses or uses deemed similar by the Council: A.Retail and Ser/ice Businesses. The following neighborhood retail sales and service businesses supplying commodities or performing a service primarily for residents in the surrounding neighborhood: 1.Arts and school supplies store. 2.Banks and insurance companies. 3.Barber and beauty shops. 4.Bicycle sales and repair. 5.Books, magazines, record shop. 6.Drugs, candy, ice cream, soft drinks, cosmetics and other usual drug store merchandise. 7.Dry cleaning and laundry pick-up stations including incidental pressing and repam. 8.Garden supplies, florist shop. 9.Gift ot antique shops. 10.Hardware store, paint store. 1 1.Hobby shops, camera and photographic supply stores. 12.Jewelry shops and repair. 13.Laundromats. 14.Locksmith. 15.Music, radio, TV, appliance sales and repair stores. 16.Newsstands. 17.Office supply store, office machine store. 18.Pet shop. 19.Pipe and tobacco shops. 20.Plumbing, electrical, heating, housewares, furniture, carpet store. 21.Postal substation. 22.Real estate sales. Within the "B-1" Retail Sales Business District no structure or land shall be used for one of the following uses except by conditional use permit: A.Garages. For the servicing and repair of automobiles provided repair functions are totally enclosed in a building. B.Motor Fuel Stations. Subject to the provisions set forth in Section 10.61, Subdivision 18. C.Restaurants (Class I). Food is served to customer while seated at counter or table. Cafeteria - Food is selected by a customer while going through a line and taken to a table for consumption. Fast Food, Convenience, Dnve-in, and Liquor Store Restaurants. G.Public Telephone Booths. Source: Ordinance No. 172 Effective Date: 1-1-75 H.Communication Reception/Transmission Devices. 1 .Accessory Antennas. Accessory antennas shall be limited to radio and television receiving antennas, satellite dishes, TVRO's, and amateur short-wave radio transmitting and receiving antennas. Accessory antennas that are accessory to the principal use of the property are permitted accessory uses in all zoning districts provided they meet the following conditions: a.Height. A ground mounted accessory antenna shall not exceed twenty (20) feet in height from ground level. b.Yards. Accessory antennas shall not be located within the required front yard setback, comer side yard setback or side yard setback abutting a street. c.Roofs. If vegetation or obstructions interfere wdth satellite signals at a location in any allowable placement area, the accessory antenna may be placed on the roof of any authorized stmcture on the premises. d.Accessory antennas shall not be located writhin a required yard or setback area or within drainage or utility easements. Antenna towers shall be set back from adjacent property lines a horizontal distance no less than the maximum height of the antenna. e.Building Permits. A building permit shall be required for the installation of any accessory antenna requiring a conditional use permit. Building permit applications shall be accompanied by a site plan and structural component data for the accessory antenna, including details of anchoring. 'Each accessory antenna shall be grounded to protect against natural lightning strikes in conformance with the National Electrical Code as adopted by the City of Orono. g.Electrical Code. Accessory antenna electrical equipment and connections shall be designed and installed in conformance with the National Electrical Code as adopted by the City of Orono. h.Color/Content. Accessory antennas shall be of a neutral color and shall not be used as signage. 2.Amateur Short-Wave Radio Antennas and Towers which do not meet the conditions for accessory antennas, may be allowed with a conditional use permit in all zoning districts provided they meet the following conditions: a.Height. When an amateur short-wave radio antenna is mounted on an antenna tower, the total height of the antenna and tower shall not exceed 65 feet. b.Yards. Amateur short-wave radio antennas and towers shall not be located within a front, comer side or side yard. c.Setbacks. Amateur short-wave radio antennas and towers shall not be located within any required setback area and shall be located no less than the height of the antenna and tower from the property line. The minimum rear yard shall be 30 feet; side yard adjacent to "R” District shall be 15 feet; side yard adjacent to street shall be 10 feet. E.Setback Requirements. No building shall be nearer than 35 feet to any front lot line, 35 feet from any rear lot line, 15 feet from any side lot line, 35 feet to side lot line adjacent to street; except abutting or across the street from an "R" District, no building shall be less than 35 feet from such lot line. Wherever a "B-1" Retail Sales Business District abuts an "R" District, along the side or rear lot line, a fence or compact evergreen hedge no less than 50% opaque nor less than six feet in height shall be erected along the abutting lines except within the required front yard. G.Building Design and Construction. In addition to other restrictions of this Chapter, the use, construction, alteration or enlargements to any building or structure within the district shall meet the following standards: 1.All exterior wall finishes on any building shall be: (a)Face brick, or, (b)Natural stone, or, (c)Specially designed precast concrete units if the surfaces have been integrally treated with an applied decorative material or texture, or, (d)Factory fabricated and finished metal framed panel construction, if the panel materials be of any of those noted in Items (a), (b) and (c) above. (e)Other materials as may be approved by the Council. Combinations of such materials shall be permitted. 2.All subsequent additions and outbuildings constructed after the erection of an original building or buildings shall be constructed of materials comparable to those used in the origin^ construction and shall be designed in a manner conforming with the original architectural design and general appearance. 3.No building or structure of a temporary character, trailer, basement, tent or shack shall be constructed, placed or maintained upon the property except as accessory to and during the construction of permanent buildings. H.Drainage. No land shall be developed and no use shall be permitted that results in water runoff caus. g floods, erosion, or deposits on adjacent properties. Site and drainage plans shall be submitted b, the applicant in such detail as required by the Council and those plans shall be reviewed by the City Engineer before submission to the Planning Commission and Council for approval. Such runoff rray be required to be properly channeled into a natural water course, ponding area, storm drain or other public facilities. The existing oil furnace was installed in 1959, and the above ground fuel oil tank, behind the building, is rusting and does not meet current code requirements. A new natural gas furnace will be installed. The existing window unit air conditioner will be replaced with a more energy efficient central air conditioner. REQUEST FOR COUNCIL ACTION C^n^^o^r h/ipeTING .mi ^4 DATE: July 20,2000 ITEM NO: ^ Department Approval: Name Ron Moorse Title City Administrator Administrator Reviewed:Agenda Section: City Administrator’s Report Item Description: Purchase of Sewer Vacuum Truck to Replace Sewer Jet Rodding Truck Background The City currently has a 1975 sewer jet rodding truck used to clean sewer lines. This truck is in poor mechanical condition, and replacement parts for the jet rodding equipment are becoming increasingly difficult to find. Also, the existing jet rodding equipment does not have any method to remove debris from the sewer system. The debris is either flushed downstream or manually removed by personnel entering manholes and lift stations, which is hazardous and time-consuming. To address these problems, staff is recommending replacement of the jet rodding truck with a sewer vacuum truck. The vacuum truck will allow for removal of debris without personnel entering the sewer structures. The new equipment can also be used for trench de-watering during water main and sewer repairs, and for the cleaning of storm sewer facilities. Funding During the year 2000 budget discussions. Council indicated support for the replacement of the City’s sewer jet rodder truck with a sewer vacuum truck at a cost of approximately $250,000. At that time, staff did not include the purchase in the 2000 budget because it wanted to ensure the Sewer Fund reserves were adequate to fund the vacuum truck in addition to other capital needs, including interim sewer capacity expansion for the Highway 12 area. The Highway 12 interim sewer capacity issue is currently being addressed through a lift station project, with a cost of approximately $120,000. The cash balance in the Sewer Fund at year-end 1999 was $1,570,000. To-date in 2000, the City has collected $276,000 in sewer connection charges related to new development. Based on the financial status of the Sewer Fund, staff is now recommending moving forward with the purchase of the vacuum truck. Vacuum Truck Alternatives The Public Works staff has, over the past months, reviewed its needs in relation to several types of vacuum trucks. Based on this review process, the Public Works staff has selected the Vactor Series sewer vacuum truck as the preferred alternative. The key factor in this decision was the type of vacuum. The Vactor Series vacuum truck has a positive displacement (PD) blower/pump that is r ► Request for Council Action continued Page 2 July 20.2000 Purchase of Sewer Vacuum Truck to Replace Sewer Jet Rodding Truck designed to perform in heavy and wet material, and to pull material a long distance. PD units can pull material from 0-100 feet +. It works as well in the short catch basins as in deep lift stations. It can vacuum material underwater with some restrictions, as well as dry material. The other type of vacuum is a centrifugal fan machine. These are designed for shorter pulls such as 0-50 feet. They also always require vacuuming from the top down; in other words, they cannot work underwater. The City has many deep lift stations (10-40 feet +) that must be cleaned. These always have water standing above the material, and the PD unit will allow removal of the material without draining down the water. The service technician has indicated that the memory board needs to be replaced at a cost of approximately $1,200. Since the fax machine was originally purchased in 1996 for approximately $2,000, it does not seem reasonable to invest $1,200 in a machine that is almost five years old. After researching several alternative fax machines, staff recommends purchasing the Xerox Document WorkCentre Pro 657. The Pro 657 has features which are similar to the Lanier machine, with the following enhancements: •Modem speed of 33.6 Kbps as opposed to 14,4 Kbps. •Fast scan at 2 seconds per page. Print speed of 8 pages per minute. Additional paper tray. Option to connect to the City’s computer network for use as a printer. The changes will provide you with higher reliability, better picture quality' and more channel options. This new fiber optic system will give our customers the best cable has to offer today, with options for advanced communication services in the future. The upgrade in your system will include replacing the electronics in the system, upgrading the satellite and antenna receiver site, upgrading the coaxial trunk system with fi^r optic technology and the replacement of all cable that does not meet the standards of the upgrade. Prior to performing any w ork, a member of our construction group will contact each utility company to check for unmarked underground facilities. Authorized representatives from those companies will mark utilities such as gas and electric. Upon completion of the work at each location, properties will be restored to their original condition. We are excited about the choices and services our new cable technology will bring to our customers in Orono. I' »;i. r ^■\r- ■■■ CITY OF THE VILLAGE OF MINNETONKA BEACH COUNTY OF HENNEPIN STATE OF MINNESOTA RESOLUTION 2000-18 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of the Village of Minnetonka Beach, Minnesota was held on the 10*** day of July 2000. The following members were present: Mayor Bloom, Council Members Breon, Gasch, Mathews, Leff and Treasurer Salvog. Council Member Mathews introduced the following resolution and moved its adoption: WHEREAS, the Dakota Rail Railroad runs through the heart of Minnetonka Beach, and WHEREAS, Minnetonka Beach has been advised of the intent to convert the interim use of the Dakota Rail corridor to a regional recreational trail, and WHEREAS, the conversion of the rail corridor to a regional recreational trail would adversely impact Minnetonka Beach as well as it’s residents, and WHEREAS, the City of Minnetonka Beach additionally questions the need for this multimillion-dollar public expenditure when two nearly identical length east-west trails exist within five miles of proposed trail, and WHEREAS, Hennepin Parks has indicated that only if the cities along the rail corridor are supportive of the conversion would Hennepin Parks support the conversion of the Dakota Rail corridor to a regional recreation trail. NOW, THEREFORE, BE IT RESOLVED that the City of the Village of Minnetonka Beach does not support the conversion of the Dakota Rail corridor in Minnetonka Beach to a regional recreation trail and is unalterably opposed to the conversion of the rail corridor to a regional recreation trail in Minnetonka Beach. The motion for adoption of the foregoing resolution was duly sec onded by Council Member Gasch and, upon vote being taken thereon, the following voted in favor thereof Breon, Gasch, Leff, and Mathews. The following voted against or abstained: NONE. Whereupon the resolution '■•2' duly passed unanimously and adopted this 10*** day of July 2000.
