Ar. Coakley stated that the only way he could create a double garaga and also improve the safety of his entry and exit point was to receive a variance. t•1r. Coakley claimed that the County had inspected his property and expressed no concern about plans to further encroach on the road easement, and that the Village should have a letter expressing this in a short time. Kullberg moved, Ryerse seconded, that approval of the variance be granted as long as the garage does not encroach any farth.r than the existing garage on the side lot line and that it does not extend beyond existing garages toward the road. 14otion, Ayes (6) - Mays (0). Acting Chairman Searles noted that this property was in the projected path of future Highway 112. Since no official action has been taken declaring where #12 will be, it was felt tilat approval of tais "simple division" was in order. Ryerse moved, Guthrie seconded, that the division of Parcel 3100 be approved in accordance with Section 39.021 of the ordinance. Motion, Ayes (6) - Nays (0). The required setback for a stable is 1S0' and Acting Chairman Searles explained that the obvious intent is to protect the surrounding property owners. Mr. Benhardus explained that his stable would be encroaching on the Park Reserve which is heavily wooded and as a result would probably never be intensly used. In order to construct a stable to adequately house his four horses and their feed, Nr. Benhardus would require a variance no matter where on the lot it would be located. Air. Benhardus felt that the proposed location was the most reasonable because the encroachment was on the Park Reserve, and that the natural terrain and vegetation would reduce the visibility of the stable.
