SUBJECT: Variance - Walter Benhardus •- 4760 ;3ayside Road
14r. Benhardus is asking for a variance from two sections of the
ordinance. When Mr. Benhardus was applying for a variance from
Section 30.040, which requires that a stable be 1S0' from a property
line, he war informed that he was in violation of Section 34.037,
which requires two acres for the first horse and one acre for each
additional horse. Nr. Benhardus has two horses and two ponies on
3.62 acres, although an inspection seemed to indicate that the
grounds are clean and the animals well care(' for. I will contact
the newly created horse owners association fcr their comments
regarding this matter.
The applicant would also like a 7S' variance from his rear property
line setback requirement for a stable. The proposed stable site
was chosen because the topography and natural vegetation would at
least partially shield the stable from those pa!,sing by and the
surrounding neighbors. The accompanying map indicates that the
encroachment would be on Village park property .:o the north of the
Benhardus' property. Although a variance for'a stable setback
requirement from an adjoining residential site might not be des,—cable,
this problem would not exist with park property.
