Dear Mr. McAuliffe:
We are in receipt of your correspondence regarding an alternate layout
for the above referenced Record Lots. The "RS" zoning district currently
designates Lots 1-5, Morse Island Park, as Record Lot 127, and designates
Lot 1 of Scrivers Subdivision of Lot E and Lot 6 and part of Lot 7 of Morse
Island Park Second Addition as Record Lot 124. It is my understanding that
you would propose to split Lot 6 of Morse Island Park 2nd Addition and
combine the southern half with Lots 1 and 2 Morse Island and Lot 1 of
Scrivers Subdivision of Lot E, Morse Island Park.
The proposed division and recombination would leave about 150' of
shoreline for Record Lot 27 and about 200' of shoreline, albeit split by a
33' public access right-of-way, for Record Lot i24. This would not
appreciably change the total area of each Record Lot, while still keeping
the existing cabins well within the boundaries of each Record Lot. In my
opinion, the only drawback is that under your proposal, both lots will now
be divided by right-of-way, and in fact Record Lot 124 would consist of
three parcels separated by platted roads. The county will not legally
combine property across platted roadways, so that for tax purposes you
:Mould still end up with multiple tax statements. Note that the City cannot
vacate platted lake access rights-of-way (i.e. "Massasolt Ave".), but there
may be a potential to vacate portions of " Moslin Ave" between the two
adjacent sets of parcels.
In order to revise the current designations of Record Lot 24 and 27 as
you propose, you would first have to apply for a "lot line rearrangement"
subdivision to split Lot 6. At the same time, you might consider applying
for a vacation of the portion of Moslin Avenue that separates the various
parcels of your property, although this is not mandatory. Presuming that
the City Council would agree with your proposel and would grant subdivision
approval with recombination as you propose, a "Special Lot Combination" and
Lot Area Variance resolution would be filed in the chain of title of each
property. You would have to legally combine for tax purposes the
appropriate parcels that are not separated by road right-of-way.

rearrangements and re -designation of the Record Lots. There will be some
cost involved in the subdivision and vacation applications and you will
have to provide a survey of the property. I wi11 be pleased to discuss the
