SUBJECT: Variance - Thomas Betz - Building Setback
A problem has arisen regarding the setback on the Betz property. I
suggested Mr. Betz meet me this morning along with his surveyor. On
measuring the front setback, the surveyor came up with 24' instead
of the 35' submitted on the site survey. The question came up as
to fault, whether the surveyor erred or the stakes were moved after
the surveyor had set them, both of them denying the guilt for the
discrepancy. I believe both of them to be men of integrity, and it
probably was a human error.
Since this house is already framed and partially sided, it would be
very costly to tear it down and move it back; but on the other hand,
Mr. Betz is in violation.
I asked him to apply for a variance and leave it to the discretion
of the Village Council. There will not be any more houses on that
side of the street, so the problem is not as acute as if future houses
were to be constructed and aligned with this one.
