There is nothinq explicit in the zoning code regarding authority to build docks on property located across the street or road from homestead property. As you know this situation is quite common in Orono. Sometimes the lakeside property is part of the same tax parcel, some- times it is a separate parcel as in your case. The code does prohibit docks on vacant properties without a house. B,,L ;n situations like yours, the interpretation has been that a dock can be built on the separate lakeside property provided: 1. The lakeside property is directly across the street from a homestead property with a house; and 2. The lakeside property is owned in common by owners of the homestead property; and 3. The dock is used by the homeowners for their private lake access and is not rented -out. In situa- tions like yours where there is a marsh and/or shallow shoreline, the dock can be up to 100 ft. long over the water, with additional dock length over the wetlands. Dredq_ing of the lakebed or filling of the wetlands is prohibited. If navigable depth is not reached by this length dock, the City and LMCD would have to issue a length variance to go farther out, but this would be preferred over dredging. John, I do note one problem I found after you left. Your lakeside parcels are lots 15 and 16. Lakeward of yours is another lot 14, tax parcel 05-117-23 24 0082, listed to an owner in Chicago. All three parcels seem to be wetland (but his and maybe earn yours might be under water). What I told you above stands as far as I'm concerned, but you might have a problem with this other owner.
