Regular Meeting of the Planning Coiiimission.
Septenber 21, 1970 7:30 P.M.
The Planning Comnission met on the above
date with the following meinbcrs present:
Chairnan Russell, Dorn, Gnscli, Kullbcrg,
Nicholls, and Poisson. Absent: Bartig,
Dongoske, Elliott, O'Malley, and Schocning.
Bill Swoon and Floyd Buschbaum represented
thcasclvcs in an application to rozonc from
R-IC to I property located at 276S-27S5
Wayzata Boulevard, Parcels 3645-3600-36S0,
Section 33, The property has been purchased
by the Van Dale Corp, on a rezoning contingency
for the purpose of future expansion and is
adjacent to the present site of the firm,
now zoned I.

Mr. Sween expressed his view that the
addition of this property to the present
site would remove traffic from Highway *12
and rcchanncl it to Old Crystal Bay Road,
thereby creating a bettor traffic situation,
Russell stated that it had been the general
policy to considci re zoning in the area
Highway #12 and the railroad tracks.
Russell moved, Kullberg seconded, that a
public hearing on the rezoning be held and
recommended approval of the rezoning.
Motion, Ayes (5) - Nays (0). Horn made
his appearance after the vote.
Bill Sween represented Gordon Barbnrossa
in an application to divide Parcel 5600,
Section 9, 2445 North Shore Drive,
consisting of 3h acres into three lots.
Members studied the plat and questioned
Mr. Sween as to the extent of the lowland
on the property. Mr. Sween stated that he
could not say exactly, but that it was loss
than h aero, which would leave three acres
of high ground. It w.as also noted that
the driveway and turn around to service the
throe lots were shown on the plat as 50'
and 100', respectively, but that it probably
would never be developed to that extent
for usage on three lots. The Building
Inspector stated that adequate septic systems
^£Ould be installed and there was the
^Probability of municipal sewer in the near
future.

Russell moved, Xullberg seconded, that the
division be approved. Motion, Ayes (6) - Nays (0).

Mr Zubcr represented Jerry StaRcberp,
^ in an application to build on Parcels
'5610-5620, Section 17, 1920 FaRcrnuss
Point Road.
It Has brought out a similar application
by the former owner was denied last year,
since the lot depth would not allow
setbacks to bo met and that the lot size
would not meet the h-acrc requirements if
t^utlands were subtracted from the lots.
Mr. Zubcr presented soil tests taken by
soil engineers showing what needed to bo
done to construct a rosidcnce on the lot.
Russell stated that the purpose of our
wetlands ordinance was to 1) protect the
owner from poor construction and make him
aware of construction problems thereon,
2) keep swamp areas for the preservation of
the lake itself, 3) avoid sewage problems,
(embers noted that Mr, Stageborg was aware
of item one and that the area was served by
municipal sower. They were of the opinion
that a house of the quality shown would
enhance the neighborhood. !r. Zubcr, when
g||quo5tloncd, stated that there were 65' of
good lakcshorc on the lots.
Kullbcrg moved, Poisson accondud, that the
variance bo approved. Motion, Ayes (6) - Nays (0).

Marvin Carlson's application for a garage
rear-setback variance from the required
30* to S' at 2344 Olive Avenue, Lot S,
Wiley's Navarre Add,, Parcel 1200, was studied.
It was noted that fire hazard of the new
garage would be lessened as the present
garage is only 3' from the neighbor's
garage. Discussion was held on setting
a precedent for the whole area.
Niello 11s moved, Gascli seconded, that the
variance be allowed. Motion, Ayes (S) •
Nays (1). Poisson Nay.

workshop. The diagran of the site was
studied and Mr. Nicholson's reasons for
the application were read.
Since chore was a need for the workshop.
It posed no fire hazard, and neighbor's
jconsent was obtained.
Nicliolls moved, Russell seconded, that

The division of James Fullerton, 3400 Fox
Street, Parcels 4010-4500, And. Sub. 207,
consisting of approximately 45 acres into
three lots of 9 acres, 6.1 acres, and the
remainder one lot, was presented. The

for the division.
Gasch moved, Porn seconded, that the
