Herb Johnson represented himself in an application for a conditional use permit to fill 6,000 square feet of low land during construction on Lot 5, Block 2. ^^yrtlowood. Russell road a letter from Mr. Johnson's attorney to the Village Attorney followed by the reading of the two ordinances pertaining to filling low lands. Mscussion was then held on the legality of Mr. Johnson's application as to whether a building permit could be withheld if a person could build on a lot if all aspects of the codes were met. Mr. Johnson cxiilained that the biggest problem in construction was the constrtiction of an adequate septic system and that he I was assured by a reliable contractor it ' could bo done. Russell then explained that the reason for the ordinance covering filling was the village's concern for t!»c la?;c, that ponds nnd wetlands orcveiit rapid Tiui off of water and act* as a filtering agent to water entering Lake Minnetonka. McCarthy stated that so many applications for filling, similar to this, are being taken out, that some place a stand would have to be taken and lines drawn and held so there would not be a wholesale filling of these lands, niscussion was then held on the platting of Myrtlcwood and that future platting should dedicate these lands so no construction could take place on them. Members concurred that there was no legal ground to deny the permiv. Dongoskc moved, Kullberg seconded, to recommend approval. Motion, Ayes (S) - Nays (0). Mr. Sabor represented the Jehovah lfitn«5scs I in an application for a conditional use permit to erect a church on Ella Gruppe property, part of Lot 7, Block 10, Lnngdon Park, 3675 Togo Rond. Along with Conditional use permit, a proposed division of the property was also reviewed. It was noted that all the toning requireaents were net. Then the 12* easenent was studied, the plat map showing that the lot to the south servicofl by this easement could also be serviced by Northern Avenue. Traffic problems were next studied. Since Togo Road is only a minor 20* street, Russell asked if there would be two driveways to assure orderly exiting of traffic and was assured there would be. Parking was the next item checked. Mr. Sabor assured members the four to one ratio would be met. It was also learned that the estimated congregation would be 200 members. Russell moved, Kullbcrg seconded, that the permit and division be approved, providing the church meets the building code and the parking lot would bo surfaced to the proper size and that on-street parking would be prevented. *»otion. Ayes (S) - Nays (0). ^Arnold Hegge and Charles Hayes represented themselves to discuss the division of Arnold Hegge, Parcel 4050, Soc. 29, 3465 Sixth Avenue North, dividing 7~l/2 acres into three lots. Mr. Hayes stating that he had no objection to the division and that he would dedicate the necessary 25* for the street. Members studied the possibility of need for a thru strict in the future to Ifayzata Boulevard. It was shown that the street, placed whore it is now would run into a swanpy area and that the distance to Wayzata Boulevard was not so great as to warrant a thru street. Dom had reservations as to the overall planning as some houses would be facing back yards. He also expressed the opinion that more stringent regulations bo placed on street construction, citing examples from the experience of other Villages. Pisciission followed on public vs. private streets. The status of the accessory building on the south side lot was discussed. Mr. Hegge stated he intended to build on the lot ns soon as the division was Completed, and that, in the event ho could 'not, he would mo‘o the garage to Hayes property. Kullbcrg moved, Pongoskc seconded, the division be approved as shown. Motion, Ayes (4) - Nays (0). Horn abstaining. CONDITIONAL USE PERMIT H DIVISION 3675 Togo Road DI'MSION 3465 Sixth Avenue North HIMUTBS OF A REGULAR MEETING HELD JULY 20. 1970 Tho application of Dr. David nunlap. Lot 1, Lydiard Park, 1595 Bohn's Point Road, was reviewed. The site plan showing the ponding area was studied. After reviewing the plat, Elliott noved, Russell seconded, that the division be disallowed due to the fact frontage did not meet the 140' requirements, and the wet lot did not itoot acreage requirements after wet area was separated from dry. Motion, Ayes (1) - Nays (0). Horn abstaining. Russell spoke on some of the steps taken in tho past by Hennepin Countv on acquisition of Big Island as a park. Members were unnninous in their opinion that the island should never be used for traffic and any bridge built thereto be for pedestrian use only. Kiillberg stated he was of the opinion that no further improvement of tho island should bo allowed that would in ’ucc lot sail 3 or further development. ^ ^Russell moved, Elliott seconded, that the ^ ^permit bo approved. ?lotion. Ayes (4) - i'Jays (1). Kullberg >Iay. Tho application for a setback variance for the tool shed of Lyell Halverson, Lot 7, part of Lot 8, Shorehills, Parcel 1450, 2605 Mapleridge Lane, was studied. Members concurred in their opinion that the setback should have been 35* instead of the 10' now used. Dorn moved, Kullberg seconded, that the variance be denied. Motion, Ayes (4) - Nays (0). Dongoske left meeting prior to this. Brian Hope's application for a garage side setback variance from 10' to 7', 66 Hackberry Hill, Lot 5, Block 3, llackberry Hill was studied.
