WAIVER ON HARDSHELL • Vanderborght CONDITIONAL USE PERMiT - Trinity Lutheran Church VILLAGE OF ORONO Regular Meeting of the Planning Commission, May 18, 1970 The Planning Commission met on tnc above date with the followint* members present: Chairman Russell, Porn, Elliott, Gascii, Kiillberg, and Poisson. Absent: Bartig, Dongoske, Niciiolls, O'Malley, and Scliocning. The application for a conditional use permit to dredge and fill on Big Island was re­ viewed. Russell stated he had seen the projected project and had some reservations as to recommending approval and stated that all members should review the site before making their recommendations. Edward Packard, representing .liraself in a division of Lots 1-2-3, Block \ Hillside Park, Parcels 2600-2800-3000, 309 Westlake Street. Members studied the proposed division and asked Mr. Packard now hone.* in that block were setback in relation to his home, and learned they were all similar. It was also noted that they were ktiirough lots ajid in the interest of good ^planning, they would be better divided in lalf even if they were a little short of the one-acre requirement. Elliott moved, Poisson seconded, that the division be anproved. Motion, Ayes (5) - Nays (0). The setback variance of Allan lentgen. Lot 9, Block 2, Wiley's Park, Parcel 9000, 2171 Shadywood Road, was studied. In view of the fact that this would be a considerable encroachment--to three feet from the other lot--and there was a possibility that this cnc.^oachment could detract from tae value of tne adjacent lot, Dorn moved, Poisson seconded, that no variance be granted witaout the approval of the adjacent property owner, tiotion, Ayes (S) - Nrtya (0). Ronnie Kullbcrg's application for a conditional |use permit to grade doiyn Blaine Avenue and put ^ill on his adjacent lot, was sttuUed. Gasch moved, Elliott seconded, that tne permit be allowed under condition that area drainage would not be impaired. Motion, Ayes (4) - Nays (0). Kullberg abstaining. 7:30 P.M. Greenwood was represented by liis care­ -taker in an application for a conditional use permit to place a guest house, consisting of a mobile home on his property at 801 Tonkawa Road. The home would be used for housing for his caretaker. Since the acreage requirement for this liorae would be met, members went on to explore the other problems involved. The Building Inspector stated there was no provision for t’lis type of construction under the ll.B.C. whicn is adopted by reference. Members questioned the esthetics of this type of home, the dimension of 14'X 58^ being the most questioned aspect of the proposed home. Russell warned of legislating or recommend­ ing esthetics as a basis for refusal of the permit. Later in the meeting, a manufacturers representative of tiie proposed home, "Worthernaire”, made in Jordan, Minnesota, explained the engineering soundness of there homes and the difference in cost between tliis type and conventional home, norn questioned if they could be built much |Cheaper per square foot than a conventional Riome or even a prefabbed home. He also asked the representative how many individual mobile hones there were in the area excluding trailer parks and was told there were not to many. The caretaker left and said he would endeavor to find a home approved under our code. Kullberg moved, Russell seconded, thac the natter be tabled for further study. Motion. Ayes (5) - Nays (0). Robert Birkeland represented himself in a division of property at 1270 '.fildhurst Trail. Russell read Mr. Oirt:eland*s letter stating the reason for the division request, citing the high cost of assessments on one- acre properties. Preliminary approval of tnis property on a division to R-IC lots was given in Pecember, 1967. He now wishes to rezone the property into R-ID as ho questions the need for the R-IC zoning if sanitary problems are resolved by Municipal sewer. CONDITIONAL USE PERMIT 801 Tonkawa Road DIVISION 1270 Wildhurst Trail Kullberg moved, Dorn seconded, that a public hearing be ordered on the rezoning of this property, with a secondary purpose of finding the views of pronerty owners on the ultimate zoning of the entire area, after sewer is installed. Motion, Ayes (S) - Nays (0) RBGUUR MEETING OF THE PUNNING COPIISSION HULD ^tAY in, 1970 Page 5 Robert Larson, 724 Tonkaview Avenue, )Parcel 6800, Parten's Point First Hivision, represented himself in a request for a side< setback variance from 10* to 5*5'* for purposes of continuing a non-conforning structure by new addition. Since the property would be enhanced, the adjacent neighbor's approval was given, and there would be no fire hazard. VARIANCE 72S Tonkaview Avenue Kullberg moved, Elliott seconded, that the variance be approved, 'lotion. Ayes (S) > *4ays (0). Sfilliam T. Mills appeared to explain the M.S.A. Program to members, and outline proposals tor tnoroughfares rim routes. Members Dom and Poisson were appointed to a Transportation Study Committee. APPOINriENTS Transportation Study Committee Members reviewed the proposed Fence Ordinance and agreed there should oe some ordinance.FENCE OPPINANCE Russell again warned of the danger of rucoramending and legislating esthetics in tills type oi ordinance. It was agreed that >tae Fence Ordinance should be studied further, Russell stating he would bring some sample ordinances. Herman Vanderborght represented himself in a waiver of the hardshell requirements for his approved division and asked for HARPSHELL WAIVER permission to convey the property by and bounds description. He stated division took so long and had so many ramifications that he was in danger of losing the sale of the property fie had divided. meets lis Russell moved, Gasch seconded, tnat in view of the fact that he had so much delay in the division approval, the hardshell requirement should be waived. Motion, Ayes (S) - Nays (0). Gasch moved, Elliott seconded, that the conditional use permit for the construction ^f an addition to tiio Trinity Lutheran Church, 2060 Sixth Avenue North, be approved; Russell stating that in the original construction they stated an addition would be needed at a future date. Motion, Ayes (5) - Nays (0). He explained that he would be sitting by hiaself and that he would not be at variance with his neighbors. Dorn aoved, Poisson seconded, that the variance be approved. Motion, Ayes (S) - Nays (0).
