Public Hearing Rozoning - G 9 S Cabinets This has been on our agenda before • namely, to rezone the two R>1D lots behind G Q S Cabinets to B-1 2, Rozoning - N. I. J. Corp. - William Gagne - R-IC to I The property known ns the Eisenger farm east of Orono School. Ho has submitted a new application. As you are aware, he wishes to use the property for more than one zoning use, but does not know how to procuod under our zoning code. He feels his best chance is under 38,700 of the code. 3,Division - Philip Sttibbs - 4 acres from a 17 acre parcel. December 20. 1971 L The Planning Commission met on tae above (late with the following members present; Chairman Poisson. Butler. Elliott. Gasch, Hays. Herfurth. Kullberg, and Nicholls. Also present: Councilman Dorn. Absent; Xuhlemeier. Ryerse. and Southwortii. Butler moved. Gasch seconded, that the Minutes of the last meeting be apnroved. ilotion. Ayes (3) - Ways (0). Ev Geyen represented himself in a petition to rozone from R-lb to B-1. Lots 11-12. Block 7. Wavarre Heights, ext .aining that iie had no intent to change the use of the property now used as a parking area for ais ousiaess complex on Lots 13-14. Block 7. lie stated he was advised by the Village Engineer that the water assessment would be less zoned B-1 than R-ID. At this time, the Chairman asked if aiiyboiiy in tiie aiidcnce wished to be heard. Voicing opposition to the rezoning wore Messrs. William Bolder. 3513 Lyric Avenue; Albert Derry. 3559 Lyric Avenue; and Ruby Lundblad, 3505 Lyric Avenue. Chief opnosition v/as taat the Village now had so' much unused commercial property and the fear tliat the rezoning would establish a precedent and remove the residential status of the neigaboraood. Gasch asked way the unit assessment could not be deleted. Herfurth was of the opinion that since Mr. Geyen was enjoying ti:e use of the property, ac should pay the assessment. At this time. Mr. Geyen asked tant the netition for rozoning be dropped. Kullberg then stated it should be in the iiautes taat the property should remain residential and Mr. Geyen enjoy full rights of using tao property as a parking lot as previously. Members studied the plat of Philin Stubbs in tiio matter of a division of property at 400 Stubbs Bay Road Worth. Iterfurtii stated he was of the opinion that a more logical anproach to immodiato planning problems'wns to start working oa a PUD ordinance and to form a four member conuiittee to proceed first by obtaining sanple ordinances for study from otacr suburban areas. Mays, Elliott, Poisson, iierfurth. and Councilman Dorn volunteered and appointed Herfurti as Chairnpn. Gascn presented a preliminary report as made by iier committee on the comprehensive sewer study. Drought out was that the placement of the Metro Sewer system would nave great bearing on the priority of placing sewer iu certain areas and t lat t le exact placement of t:ie Metro system would not be kiiovm until later in 1972. Tne study siiowed areas of nriority, beginning with tiic liackbcrry ilill area and finishing tne Saga Hill area. The priority of tne Smiths day area and the Stubbs Hay area would be Jotermined by the placomont of the Metro Sewer. Members concurred taat there was plenty of access to the pronerty being clivided, but tno Building Inspector should obtain a document of land oimership from Mr. Kokesh. Attorney ’./hitehead now read a statement of conditions prepared by himself and Councilman McCarthy for the conditional use permit of the Freshwater Di ’o^ical Institute, explaining each condition to members, ile kalso explained that the exact placement for a boathouse to service the lake access of tne FV/BI had not been ascertained.
