Absent: Hays, Kuhlemeier, and Nicholls. The meeting from 7:00-S:00 P.?l. consisted of an open discussion with Attorney Ifhitehcad. Natters brought up were specifically, (1) How the Freshwater Biological Institute could put a channel in and how it could be legally controlled for all times, (2) Zoning enforce* ment, (3) Single separate ownership, (4) Coordination between Village Council, Planning Comnission, Administration and Legal Departments, it was decided between the attorney and members that another meeting would be scheduled in the near future. 7:00 P.N, OiSdlSSIOH Village Attorney Pwirick Wells prej?ented his preliminary plat for a division of property in both ‘ledina and Orono-**two six-acre lot? to be in Orono. Wian asked about the road into the property, he inf'^rmed members that Engineer lills had dtsi^ied the road and the cost would bo bet*.een M,000 and $5,000 per lot. Herfurth moved, Ryerse seconded, that the preliminary plat should Lo approved contingent on outlot 1 being combined with lot 1 to forestall any fu • 2 • usage thereof, Motion, Ayes (8) - Nays (0). DIVISION Patrick Nells Sixth Avenus North Members studied the variance of Harry Skrypec to place a home on a lot reeding a variance on frontage, acreage and side setback. After members studied the plat book to take in account the usage of the property in the rest of the subdivision, Kullberg moved, Gasch seconded, that the variance be recommended because all the properties in that plat are non-conforming to the same e: tent. Motion, Ayes (a) - Nays (0). Members studied the plat and the location of a carport placed on a garage on the property that was non-conforming in itself thus extending the non-conformance. Drought out was there was no permit taken out for the carport, the contractor thinking the owner took it out and Vies versa. VAJUANCB George Haeny 197t Shadywood Road (Continued) Members studied the plat of the park property recently purchased fron Lorenz Kutt and the snail parcel being divided from it to be conbined with the Kutz property as agreed on at purchase tine. DIVISION Lorenz Kutt Kullberg noved, Elliott seconded, that division as shown on the prelininary plat be approved. Motion, Ayes (7) - Nays (1). Herfiirth Nay. Willian Nolfe represented hinself in an application for a garage setback variance at 3255 Crystal Bay Road. After studying the sketch Mr. Nolfe showed nembers, Herfiirth advised Mr. Nolfe of the danger of placing any construction so close to railroad property without having a survey. VARIANCE Nillian Nolfe 3255 Crystal Bay Road Gasch noved, Herfurth seconded, that the variance be tabled until a survey was nade of the original property and the adjacent property recently purchased by Mr, Nolfe, showing all lines and placenent of present and proposed inprovenents; also, a statenent of approval fron the neighbor being encroached on. Motion, Ayes (8) - Nays (0), Mr. Howard Vogel of MECCA now read a statement saying his agency was opposed to the dredging of a channel to the FNBI. He cited various studies nade showing the value of swamps on water retention, in turn holding lakes and rivers at constant levels, taming floods and preserving wildlife. He then cited figures showing one-half of the nations swamp areas are already gone. MECCA Howard Vogel He rea^l* excerpts frrn t that all narsnes should be retained and no report stating variances be granted. He also read chapters 31.800 and 31.830 of Municipal Ordinance NO. 125 which he considered a model ordinance for the whole lake aroa. He questioned the value of the IDS report saying there were too many statements nade in it without statistics or scientific opinion to back then up. (Continued) MINUTES OF A REGUUR MEETING HEtD SEFTEMflER 7, 1971 P«ge 3 He was of the opinion that the channel was merely a convenience not a necessity using the limnological department of the University of Minnesota which has no lake near it at all as an example. He stated that a marina or the mouth of the proposed channel alone would be adequate for the requirements of the FWDI. ?/ECGA (Continued) Herfurth asked Mr, Vogel how long their task force had been interested in swamps to which Mr. Vogel replied three years. Then Herfurtli asked if they had done any work or made any progress towards getting any other villages around the lake to adopt ordinances sir.ilir to Ordinance NO. 12S, which was so hlprtly praised and Mr. Vogel replied they had not. Southworth asked Mr. Vogel if it would not be better for swamps to be placed in park reserves than private ot^nership. Mr. Vogel said there is no ready answer to this. Southworth said swamps are looked at in four different ways: (1) The owners way, (2) The (3) The ecologists way, and (4) The appraisers way. The meeting adjourned at 10:15 P.M. for a ioint discussion with the Park Commission. Planning Commission and Bauer and Associates, planners.
