HomeMy WebLinkAbout12-18-1972 Planning MinutesVI LUGE OF ORONO Regular Meeting of the Planning Commission, December 18, 1972 The Planning Commission met on the above date with the following members present: Chairman pro tem Elliott. Gasch, Gutirie, Hays, Ryerse, and Van Nest. Absent: Chairman Poisson, Kokesh, Kullberg, Nicholls, and Searles. 7:00 P.M. Elliott moved, Gasch seconded, that the Minutes of the Regular Meeting of December 4, 1972, be approved. Motion, Ayes (6) - Nays (0). MINUTES C George Howell represented himself in a division of property. Members studied the plat as proposed and were satisfied that it met the requirements of the R-IC zone it is in. Mr. Howell stated they were contemplating one more division of the property. He was informed this would be the last division under the simplified platting ordinance and any further divisions would have to be in full compliance witii the entire platting ordinance. Elliott moved, Guthrie seconded, that approval be recommended of the plat as presented including the easement. Motion, Ayes (6) - Nays (0). DIVISION 2640 North Shore Drive Mrs. Thomas fforison represented herself in a division of her property to provide a building site for her mother to construct a home. The Building Inspector stated he viewed the site and the wetlands in the site would not encompass over % acre, leaving the 2.4 acre lot as proposed well in the zoning requirements of R-IB, 14 acre requirements. Since all the requirements were met, Guthrie moved, Elliott seconded, that approval be recommended. Motion, Ayes (6) - Nays (0). DIVISION 1540 Fox Street Donald White, representing himself, stated his plan was for 48* X 20* fiber glass structure for equipment storage to be attached to a 90' X 20' poly type greenhouse. Van Nest moved. Hays seconded, approval be recommended conditioned on: 1. Further permission be obtained from four adjacent neighbors. CONDITIONAL USE PERMIT 180 North Shore Drive W. Motion, Ayes (6) - Nays (0). CONDITIONAL USE PERMIT (Continued) Q Hennepin County Park Reserve - Division Members studied the plat as proposed and determined that the zoning requirements of the R-IC zone were not met. They instructed the secretary to ask the attorney's oninion on the following: 1. What was the intent of Mrs. Hoppe pertaining to ownership? 2. Who obtains possession of the property when the owner dies? 3. What is the intent pertaining to taxes? Does the owner or Hennepin County pay the taxes? Would there be a way to pay taxes by keeping the property intact without a division? 4. Is the property deeded to Mr. Ford or Hennepin County only for Mr. Ford's use? The matter stands tabled until the Attorney's opinion is obtained. In the absence of a spokesman, a letter from Mrs. Gilbert, explaining her position was read. Members question Engineer Mills on the reason a sewer assessment was placed on this property when it did not meet the zoning requirements of the R-IC zone and was informed the principal reason was that it fronted on two streets. Noting that there had been a recent division of property in the area where a public hearing was held at which people in the area voiced an opinion that there sould be no reduction in zoning requirements. Elliott moved. Van Nest seconded, that approval should not be recommended and both the footage and unit assessment for sewer should be removed from the two lots fronting North Shore Drive. Furthermore, should there ever be a combination with any adjacent property, the footage assessment would have to be reassessed against the subject property. Motion, Ayes (5) - Nays (0). Gasch abstaining. DIVISION Noerenberg Property 2865 North Shore Drive DIVISION 4735 Tonka View Lane MINUTES OF A REGULAR riEETING HELD DECE'fBER 18, 1972 Page 3 Ryerse moved, Gasch seconded, that a public hearing on the vacation of Hill Street be ordered for the meeting of January 15, 1973. Motion, Ayes (6) - Nays (0). STREET VACATION Hill Street Gasch asked members if there was any objection to the proposed January 10, 1973, mueting on the comprehensive sewer plan to be held in the Orono school and was assured there was not. COMPREHENSIVE SEWER PLAN January 10, 1973 Elliott moved, Gasch secondeJ, that the meeting be adjourned at 9:20 P.M. Motion, Ayes (6) - Nays (0).
