Joint Meeting of the Planning Commission
and Village Council, October 16, 1972
The Planning Commission and Village Council
met on the above date with the following
members present: Chairman Poisson, Elliott,
Gasch, Hays, Kullberg, Ryerse, and Van West.
Present from the Council: Mayor Oberhauser,
Councilmen Dorn, Massengale, and McCarthy.
Also present: Village Administrator Cosby
and Village Engineer Mills.
Gasch reported on the progress of the sewer
comniittf'f. She said she agreed with Mr.
Cosby thac it should be called a utility
committee, keeping in mind water where
feasible. The committee's opinion was that
the procedure for bringing sewer to the
Village especially that area around the lake
was to:
1. Get a statement from the Metro Pollution
Control Agency on the need for sewer around
the lake.
2. Place an application for Federal funding
with the Metro Sewer Board.
3. Meet with the people in the area to be
sewered for discussion.
If funds would be available, the committee's
opinioii was that it should be all funded at
once not in small projects spread over years.
Mr. Mills gave members a population projection
chart and a map of proposed routes of the
Metro Sewer and its branches, showing the
area to be serviced. Mayor Oberhauser stated
that if funding should be available, more
areas should be included, explicity. Fox
Ridge, Webber Hills, and extension of North
Arm Drive, Leaf Street and Cygnet Place and
possible West Branch Road. Mr. Mills stated
that there were alternate routes some more
costly, requiring lifting of sewage which is
very costly. He explained three alternates
quoting rough figures for installation.
In any event, he said Metro Sewer had laid
down a dictum that we choose one plan and
send it to them.

Hays passed out a progress report by the P.U.D.
committee showing some concepts tiiey had
arrived at.

Van Nest questioned the need for a P.U.D.
ordinance feeline our present P.R.D. ordinance
was adequate, and expressed a fear that the
adoption of a P.U.D. ordinance would simply
open the way to a density increase. Mayor
Oberhauser stated he did not feel this was
the i^t*pose of the ordinance. It was merely
to give more flexibility in planning,
allowing large tracts to develop their own
service and to give them more freedom in
arrangement. It was decided to have more
discussion on this at the next meeting.
It was here decided to have another joint
meeting of the Planning Commission and Village
Council at 6:30 P.M. on November 5, 1972.
The regular business meeting commenced at
7:40 P.M.
Kullberg moved, Uyerse seconded, that the
Minutes of the meeting of October 2, 1972,
be approved. Motion, Ayes (7) - Nays (0).
Messrs. Stanke, Sween, and Simmons represented
tiie Eberhardt Construction Company in an
application for a variance to construct a
residence on Lot 4, Vern Mar Manor. It had
been determined at the last meeting that the
lot was 95* X 150* in a R-IC zone and was
the last lot in this subdivision. It is
serviced by and assessed for sewer and water.
A building permit was issued to the Eberhardt
Company by the staff during tne absence of
the Building Inspector on the assurance by
the company that everything had been checKed
out. The Building Inspector placed a stop
order on it until the matter of a variance
for lot size and frontage was obtained; also,
at the last meeting the matter was tabled
for a legal opinion and an engineer*s report
on the drainage in the area.

Lot 4, Vern Mar Manor
Mr. Poisson read the engineer*s report written
by Lyle Swanson of the Mills Engineering
firm stating he thought there was a problem
in the matter of drainage in the area before
excavation began and that it could be resolved
by a swale through the proposed driveway
channeling the water to the rear of Lot 3,
the adjacent lot, in the area wnere the
natural drainage had gone previous to the
commencement of construction. Poisson asked
Mr. Cosby what the attorney had reported at
the last Village Council meeting, rlr. Cosby
said he had informallly stated that due to a
permit being issued, the Village could be liable

in the event the present construction,
consisting only of footings, would be damaged
during the delay caused by obtaining the
necessary variance.
James Lassek, 2636 Lydiard Avenue, voiced
concern that the construction of the residence
at the elevation commenced, would give him
problems at his residence where the dra’ii^age
problem was already critical. Elliott stated,
that living in the vicinity, she had become
aware that there always had been some problems
with a wet basement in this residence. Van
Nest stated he lived in the area and there had
always been some problem with ponding of water
on the lot being built on. The Building
Inspector stated from his examination of the
lot after excavation for the basement, that
he could see where some water had ponded in the
nortnwest corner but he was of the opinion
most of Lot 4 had been lower than Lot 5
but higher than Lot 3, hence the natural
drainage had been through these lots to the
culvert on Lydiard and the area just west of
the Fabric House. Tnis was verified by
Elliott, owner of the Fabric House. The
following members verified they had seen the
subject property; Elliott, Van Nest, Poisson,
and Hays. Brad Hays said member Searles had
seen it with him.
Poisson moved, Ryerse seconded, to approve
the variance conditioned on the final
grading meeting the specifications from the
Village Engineer in his memo of October 11,
1972, with the Village Engineer making the
final inspection to see if these specifications
are met. Motion, Ayes (7) - Nays (0).
Donna Martelle and Gladys Olson, representing
Mrs. Martelle, explained the reason*for the
division was to give more lakeshore to the
easterly lot as the lakeshore was shallow
toward Tonkawa Road. The following members
said they had viewed the site: Poisson,
Gasch, Hays and Kullberg and could see nothing
adverse to allowiiig the division.
Poisson moved, Kullberg seconded, to recommend
approval since the sites met all zoning require
ments and the residence being divided off had a
legal easement. Motion, Ayes (7) - Nays (0).
