© VILLAGE OF ORONO Regular Meeting of the Planning Commission, October 2, 1972 The Planning Commission met on the above date with the following members present* Chair man Poisson, Elliott, Hays, Kokesh, Rvcise, Searles, and Van Nest. Absent: Gasch, Kullberg, and Nicholls. Poisson moved, Elliott seconded, that the Minutes of the Regular Meeting of September 18, 1972, be approved. Motion, Ayes (7) - Nays (0). Eberhardt Construction - Lot size and width variance. Lot 4, Vern Mar Manor. Members studied the plat map of the area. Brought out was: 1. 2. Lot is about one-third acre, 95* X ISO*. This is the last vacant lot in this sub division. 3.It is serviced by sewer and has a water unit assessment. 4.A building permit was issued by the staff when they were assured that the engineer from the company had everything in order. The footings are poured and the project has a stop order on it at the present. An adjacent neighbor, James Lassek, objected to filling so much of the lot with a rambler. He thought a two-story house of smaller size would be more appealing on this sized lot. He was assured tho setbacks were met. Searles moved, Poisson seconded, tiiat the neighbor and contractor should try to come to an agreement and the secretary should contact the Village Attorney for a legal opinion. Motion, Ayes (7) - Nays (0). Phillip Greenly, attorney for Kenneth Harter, presented letters he had received from adjacent neighbors to show compliance with the Planning Commission's recommendation of a prior meeting that they be contacted. Most were neutral to favorable. One was neutral to cold. In the ensuing study, it was brought out: 7:30 P.M. MINUTES VARIANCE Lot 4 ' Vern Mar Manor DIVISIOK 3120 North Shore Drive 1. The lot is ISO* X 560* or 84,000 sq. ft. just short of the required two acres. 2. It is ISO* wide, making for two 75* wide lots. 3. It is not serviced by sanitary sewer. Since the divided lots would not be compatible to the zoning code and adjoining use. Van Nest moved, Searles seconded, approval be denied. Motion, Ayes (5) - Nays (Ij. Poisson Nay, Elliott abstaining. William Dickey represented himself in an application for a conditional use permit to remove dirt from his property for use of Hennepin County's installation of an inter* change at County #15 and Highcroft. His presentation brought out: 1.An estimated 40,000 yards would be removed. 2. 3. 4. O s- 6. About six months would be needed for the project. No trees would be removed. Black soil would be removed first, the fill removed and black soil replaced. The area for the removal has steep hills that are not conducive to good land use for farming. There is not now nor would there be any drainage problem. Searles moved, Ryerse seconded, that approval be recommended. ?fotion. Ayes (7) - Nays (0). Poisson moved. Van Nest seconded, that the meeting be adjourned at 9:00 P.M, Motion. Ayes (6) - Nays (0). Respectfully submitted.
