FINAL PLAT • Blrkeland AGENDA o G o VILLAGE OF ORONO Regular ?!eeting of the Planning Commission, September 6, 1972 The Planning Commission met on the above date witii the following members present: Chair­ man Poisson, Hays, Kokesh, Kullberg, Nicliolls, and Ryerse. Absent: Elliott, Gasch, Searles, Southworth, and Van Nest. Hays moved, Kokesh seconded, that the Ilinutes of the Regular Meeting of August 21, 1972, be approved, with an addendum that tne Robert McKee final plat was approved at that meeting after the Village Engineer approved it. Motion, Ayes (6) - Nays (0). James McCleary represented himself in an application for a lot size variance. On file was a survey of his property showing the location of present structures and proposed structures, and easement as requested by the Planning Commission at their last meeting. Ryerse moved, Kullberg seconded, that approval be recommended because: 1.The lot was comparable wit.i other properties in that immediate area. 2.Tne proposed structure would be in line with other structures in the area. 3.That while there could be some legal problems with the easement, this was the owners problem. The building Inspector notified members that it was not economically feasible to remodel the house under the building code. Motion, Ayes (6) - Nays (0). 4. Robert Birkeland represented himself in a petition to obtain final plat approval. The Building Inspector adivsed members tliat V/illiam Mills nad checked the plat and placed the corrected acreage on one of the final plats, ilembers noted all the lots except Lot 3 corresponded closely with the preliminary plat as approved, ilr. Birkeland said the reason the one line was moved some was that when the survey was made, tiie contour of the property dictated that it be moved. Kullberg moved, Poisson seconded, recommendation be made that the final plat be approved as Lot 3 still would bo an adequate lot and the division in its entirety met the code, ilotion. MINUTES LOT SIZE VARIANCE 3587 North Shore Drive I FINAL PLAT Nildhurst Trail 4 North Shore Drive MINUTES OF A REGULAR ilEETIWG HELD SEPTE !BER 6^ X972 Rige 2 Pex Ressler represented himself to answer questions as requested in a prior meeting. Members asked why the present garage could not be removed and the new one built on that site. Mr. Ressler answered that he had purchased the property from his father and their furniture was stored in that garage and as soon as a new one was built the furniture would be moved in there and the old one torn down. Also noted, was the request was to place the garage one foot from the property line. All members concurred that there should be no variance allowed less than three feet as the building code had different requirements for fire protection on any construction less than that. GARAGE SETBACK VARIANCE 3683 North Shore Drive Poisson moved. Hays seconded, that they recommend that a survey of tne property should be made showing present and proposed structures. Motion, Ayes (6) - Nays (0). Poisson again instructed the secretary to explore the possibility of amending the ordinance to make it mandatory that a survey be required for all variances. PROPOSED ORDINANCE Surveys Required Q Roy Kriesel represented himself in an application for a garage setback of 4* instead of 10* as required. He showed a sketch of the proposed site and presented a letter from the neighbor stating lie had no objection if garage was placed as shown. Mr. Kriesel stated the reason for the variance was that the contour of the land dictated that tiie garage bo built on this site; also, that access to the garage was facilitated by this placement. GARAGE SETBACK VARIANCE 4132 Highwood Road Discussion was again held on surveysc Mr. Kriesel stated his property was surveyed and he nad three stakes and one was removed by municipal sewer installation. Members instructed him to have the fourth one replaced so the Building Inspector would be aware of the property line so there could be no discrepancy waen the site was inspect'^d. Ryerse moved. Hays seconded, that approval be recommended under these conditions. Motion, Ayes (6) - Nays (0). Members studied the proposed division of Forest Arms owned by Robert Dongoske to bring a 31' deeded access to a dredged channel to Forest Lake for Block 1 of tiiat addition. DIVISION 4250 Forest Lake Drive (Continued) MINUTES OF A REGULAR MEETING HELD SEPTE^^BER 6, 1972 Members requested that Mr. Dongoske be notified to appear to answer questions as they did not deem a 31* access adequate for five lots. The Building Inspector notified members that the Village Engineer had checked the division and okayed it. Poisson moved. Ryerse seconded, that approval be recommended contingent on the divided off Parcel C be combined with Lot B owned by Archibald Spencer as Lot C would be landlocked under any other condition* Motion, AyQ' (6) - Nays (0).
