I was asked to call the Minnehaha Creek Watershed District. You have already received the memo on this. I have an article on zoning which I am enclosing. This could be what the Mayor had in mind when he said we should be careful of too restrictive zoning. Take it for what it is worth. Scott Whitnah, 3390 Crystal Bay Road, withdrew his request for a variance when he appeared before the Village Council. He did not appear before the Planning Commission at the time it appeared before you and was denied. He is now asking for an appearance and a re hearing and has also moved the line in front of his property 5* as described in the enclosed plat. '.ft Nfr J C Regular ileetin August 21, 197 VILLAGE OF ORONO of tiie Planning Commission, The Planning Commission met on the above date with the following members present: Caairman Poisson, Elliott, Hays, ICokesh, Ryerse, Searles, Southworth, and Van Hest. Kokesh arrived late, Elliott left early« Council members ptesent: Mayor Oberhauser, Councilmen Butler, .iassengale. and McCarthy. Present from the Park Commission: »astny, ifatson, and !fysocky. 7:30 P.M. Tom Loucks passed out copies of the letter to be sent out to Orono citizens inviting them to the community seminars in September. A recommendation was made that the first sentence be changed so that it would be understood that all interested citizens are invited, not only those wiiose names were selected. Discussion was held on announcing the seminars in both the Mound and Wayzata Sun Newspapers and the metropolitan newspapers and an effort be made to get TV exposure. Searles, Gasch, and Van Nest were cnosen to promote the publicity. Searles stated ne had met with I.D.S. on tneir Navarre project. He suggested the seminars would be a good time to get the peoples thinking on this project. PLANNER - TO. I LOUCKS Gasch moved, Searles seconded, that the fiuutes of the Regular ?leeting of August 7, 1972, bo approved. Motion, Ayes (9) - Nays (0). MINUTES James McCleary represented himself in an application for lot size, setback variance. Members asked him to get a survey showing the private road as it is now, the easement as it is platted, and the site of the home he proposes, and present them at the next meeting. John Keller represented himself in an application for a lot size and width variance on Lots 4 Q 5, Skarp and Lind<tuists for the purpose of constructing a home on the site. Brought out: 1. A sewer unit assessment has been placed on the two lots. 2. Variances have been granted to Charles Carl, Hans Weiler and Darrel (onteith in the same area. The owner of Lots 4 {{ 5 also owns Lots 1-2*3 with a hoUse On Lots 1 f| 2i 4. Lot 3 is a drainage lot for the entire area and forms a natural barrier between Lots 4-5 and l-2« In view of the above. Van i^est moved, Ryerse seconded, that approval be recommended, subject to the village Engineer approving street, and drainage. Motion, Ayes (9) - Nays (0), Ron Bowen represented Bruce Dayton in an application for a iJico of Ordinance No; 125, dredging a ponding area and dispersing the spoils on various places on property he owns. Discussion was held on whether the Village or the Minnehaha Creek Watershed District gives the first opinion on the application. Van Nest stated Ordinance No. 125 reads that the Minnehaha Creek Watershed District does. Minnehaha Creek Watershed District informed tho secretary that they felt tne Village should as they are involved with many villages, having various ordinances, and they had to form opinions on matters that are legislated differently in tiiese villages. Southworth was of the opinion that our ordinances should be amended so the procedure is clearly defined. Van Nest stated Ordinance No. 125 states these variances siioulu be evaluated in the light of what the public benefits by tiic variance, and to him this was private benefit. Mr. Bowen stated Mr. Dayton's long range plan is that this property would eventually have public benefits as it was expected that one day they would be opened to tho public in the form of nature trails. Van Nest also opined that too little was yet known about the harm or good to be derived from disturbing the swamp, and he was concerned with placing the spoils across East Long Lake Road near Long Lake. It was then brought out rlr. Dayton would not place any fill nearer than 80* from the lake in compliance with Ordinance No. 125. Searles moved, Southworth seconded, that approval be recommended conditioned that the project also conform to the Minnehaha Creek Watershed District's recommendations. Motion, Ayes (8) - Nays (0). Q William Wear represented himself in an application to construct a commercial complex consisting of a gasoline island, a small strip shopping center and a proposed apartment building. Searles - The apartment building would have to have a separate conditional use application and be judged on its own merits. 2. The shopping center was a permitted use, but still would have to have approval for a building permit from the Village Council. 3. Members felt that for a complex such as this, his plans were inadequate and showed no landscaping whatsoever.* Mr. Wear here stated that for now he was only interested in the gasoline island as presented on the plan. Southworth moved, Ryerse seconded, that approval for the gasoline concept only be recommended conditioned on all toning requirements being met. Motion, Ayes (8) - Nays (0). Scott vrhitnaii represented himself in a petition for lot size and width variance on Lot 17, Wallaces Addition to Shadywood. Brought out: 1. He was placing another 5* on the front of the lot to make it 50* 2. He felt he was in conformity with the neighborhood and to make him keep two lots was depriving him of equal rights with the other residences on that street. (Gasch here brought out that there were only two other lots of 100* or over on this street, all others being mostly 50* with some 60*; also, the area was entirely built up and no precedent could be set for the future on that street). 3. He was economically or physically unable to retain this large a parcel 4. There was a sewer unit charge placed on the lot 5. That he now had a buyer for the lot who wished to 'place a beautiful home on it and that the abutting neighbors were in favor of this usage. Gasch moved, Searles seconded, that due to the above, approval be recommended. Motion, Ayes (8) - Nays (0), C. Steve Kuehl appeared saying he had been advised by the Building Inspector to appear before the Planning Commission and Village Coimcil before purchasing 7 acres on Big Island with views to construct two or perhaps three permanent homes on Dig Island. Some of these being: 1« Minimal police and fire protection. 2. No garbage or refuse collection. 3« Septic installation should be studied as to water table and adequate soil conditions. 4. There are long range plans for a park reserve on the island. That there is considerable use of theS. island and that moving there for solitude could by mythical. 6. Reaching the island all year around poses problems. 7. That there are no restrictions to build on the island if zoning and building require* ments are met. 8. Construction poses a problem on an island. Poisson moved, Southworth seconded, that the meeting be adjourned at 10:30 P.M. Motion, Ayes (I) - Nays (0). Respectfully submitted.
