VARIANCE - Monteith O VILLAGE OF ORONO Regular Meeting of the Planning Commission. July 5, 1972 The Planning Commission met on the above date with the following members present: Chairman Poisson, Elliott, Gasch, Kullberg, and Searles. Absent: Hays, Nicholls, Ryerse, Southworth, and Van Nest. Discussion was held as to whether five members were a quorum. It was decided that 501 was a quorum. Kullberg moved, Elliott seconded, that the Minutes of the Regular Meeting of June 19, 1972, be approved. Motion, Ayes (5) - Nays (0). Hans Weiler represented himself in a rearrangement of Lots 6-20-21-22-23-30- 31-32-33, Sharp 6 Lindquists Fernhill, Brought out was: 1. Lot 6 was only to be used as a lake access for the remaining lots. 2. His present home was on Lots 20 6 21, ^ extending about 4* into Lot 22. 3. He wished to place a new house on the remainder of Lot 22 and all of Lot 23. • 41 He wds not adverse to combining Lots 30- 31-32-33 in any combination with Lots 20- 21-22-23. Searles moved, Elliott seconded, that recommendation be made that Lots 21-20-32-33 should be combined and Lots 22-23-30-31 should be combined and a line should be drawn between the two to allow the 10* setback required for the existing house. Motion, Ayes (5) - Nays (0). Howard Lindow, 1390 Rest Point Road, represented himself in a front garage setback from the required 35* to 21*. Brought out was: 1. Rest Point Road is a dead end street and the site is very near the end. 2. The 21* would give him room to park a car in front of the garage without blocking street traffic. In view of the above, Poisson moved, Searles seconded, that the variance be recommended. Motion, Ayes (5) - Nays (0). 7:30 P.M. QUORUM MINUTES f ■»' / k rearrange: lENT OF LOTS North Arm Q Elmwood GARAGE SETBACK VARIANCE 1390 Rest Point Road o MINUTES OF A REGULAR MEETING HELD JULY 5, 1972 Wilbur Westerdahl represented himself in an application to vacate a fire lane next to 1535 Lon» Lake Boulevard. Kullberg stated he had met with the Long Lake Fire Department and was told that vacating the lane could raise insurance rates from Class in to Class 11 in the entire area; also, that in the event of a fire the lane could be used to assist firemen obtain necessary water. Kullberg was of the opinion that before any lane not in a water area was vacated, the interested fire departments should be consulted as to the advisability of sUch a vacation. Tiie legality of sellirig such property was brought up. Searles opined that such property could not be sold. Mr. LeVahn, Mr. Westerdahl's septic authority, was asked if an adequate Septic system could be installed if a variailce were granted to use his property for drainfield right up to the fire lane instead of maintaining the 10* side setback and he thought it could. Searles moved, Kullberg seconded, that it be recommended that the street vacation be denied but a variance be granted to use the property up to the property line on the west side abutting the fire lane. Motion, Ayes (5) - Nays (0). Page 2 FIRE LANE VACATION 1535 Long Lake Boulevard O In the matter of the lot size and frontage variance for Luther Amren, 1300 Spruce Place, due to: 1. Two sewer unit assessments having been placed on the property. 2. The lots being equal in size to most lots in the area, Kullberg moved, Gasch seconded, that the variance be recommended. Motion, Ayes (5) - Nays (0). Robert Smith was represented by his attorney, Mr. Fassett, in a presentation of the final plat for approval, Mr. Fassett stated the plat was the same as the one ^iven preliminary approval by the Village Council in 1970 with one exception--the line on Tract C had been moved to the south 20* at the lakeshore to accommodate the adjacent neighbor, Mr. Gilbert. At this point, Tom Carlson, Mr. Gilbert's attorney, stated Mr, Gilbert was led to believe the entire south line would be moved not merely at the lakeshore. Fassett then stated he was of the opinion there would be no detraction of property values of adjacent properties by the placing of t’lree beautiful homes on this site. Some neighbors, Messrs. Scjieffler, Bosinger, Pederson disagreed. Discussion followed on various ways homes could be placed on Tract C ^ A to tlie satisfaction of both owners and neighbors. FINAL PUT (Continued) Searles moved tiiat the plat be approved subject to moving the south line 15* south and adjusting tne home accordingly. Motion died for lack of a second. Searles moved, Poisson seconded, t.iat tne zoning ordinance be amended to iiave firmer guidelines for setbacks from the lake. No vote taken. Poisson moved, Gasch seconded, that the final plat as presented be approved contingent on moving the home to within 5* from the south line and tilting the house to the southeast instead of tne east. Motion, Ayes (5) - Nays (0). Mrs. ilonteith represented herself in an application for a lot size and frontage variance. Broug*it out was; LOT SIZE <1 FRONTAGE VAUIAiWCB 1. There was a nome on the property until years ago wnen it was burned. 2. The property has been in single separate ownership since the 1940*s. 3. A variance was granted to tiie adjacent lot about nine months ago, namely, Charles Carl, and a new home iias been built on it. 4. There is only a footage sewer charge so a unit charge will have to be assessed on the property if a home is built on it. Kullberg moved, Elliott seconded, because of the above, a variance should be recommended, ilotion. Ayes (5) - Nays (0). Tom Loucks of Brauer P| Associates, spoke to members. He explained that there were many alternatives to Phase I of the comprehensive plan, but rather then continue this by lengtneiiing Phase I, tiiese would be taken up. His greatest concern was getting public interest generated for the plan and obtaining the exposure to engender such interest. BPAUEP P, ASSOCIATES (Continued) o MINUTES OF A REGULAR MEETING HELD JULY 5, 1972 Poisson stated the Village was preparing a newsletter to be sent out soon and it would make a perfect media to make people aware of what has been done and what must be done. Mr. Loucks stated the plan was to conduct three public meetings in August and September to get public participation in the plan. Searles stated it would be advisable to wait till firm dates for these meetings were set and then publish them in the newsletter, iir. Loucks explained how these meetings were conducted in various Villages, ilis plan consisted principally of each member submitting 25 names of citizens who were knowledgeable in businessp land development, school administration, teaching, and citizens who were large landowners and presidents of various organizations such as the Jaycee’s and the Elks; also to be included were Park Commission and Council members. Tais would be tlie core of these meetings to lead the discussion. The consensus of opinion was tiiat these meetings should not bo held by precincts or zones, but should be central meetings. Eafch meeting would consist of approximately two 20 minute speaking sessions followed by discussion session. Mayor Oberhauser and Councilman ilassengale entered into the discussion as to what would make tiie best type of speaker--the "adversary” type or the ”pm § con” type. As for the ensuing discussion, Mr. Loucks stated the best method was to break the participating citizens do\fn into groups and obtain as much mix as possible and then randomly select certain citizens to lead the discussion. Discussion should tend, but necessarily limited to the following: 1. Environment 2. Park and open space 3. Marshlands 4. Taxes 5. Growth philosophy 6. Transportation 7. Housing 8. Metro government Since the hour was growing late, it was decided to hold a special meeting on Wednesday, July 12, 1972 at 7:30 P.iM. Members studied the proposed division of Kenneth Harter, 3120 North Shore Drive, noting it was the same division as was applied for last year.
