The Planning Commission met on the above date with the following members present: Chairman Poisson, Elliott, Gasch, Hays, Searles, South- worth, Ryerse, and Van Nest. Absent: Herfurtii, Kullberg, and Nicholls. Also present: Council- men Butler and ilassen^ale. Searles moved, Gasch seconded, that tne Ilinutes of the Regular Meeting of June 5, 1972, be approved. Motion, Ayes (8) - Nays (O'-. MINUTES O Stan Ecklund's son represented him in an application for a lot size and frontage variance on Lots 9 8 10, Pheasant Lawn. He stated the Pheasant Laim subdivision was made in 1945 and the lots divided were considered adequate although not all equal. He considered these lots compatible with built-on lots in the area. Gasch asked Mr. Ecklund, since there was a difference in size and width between the two lots, and they were contiguous, why they could not be combined and divided equally. Mr. Ecklund stated he had no objection to tiiis. LOT SIZE VARIANCE 2725 Pheasant Road Van Nest moved, Searles seconded, that the variance be recommended contingent on the boundaries be drawn so tiie two lots would approximate each other in size and width. Motion, Ayes (8) - Nays (0). Howard and David V.’illiams represented themselves jointly in an application for a lot size and width variance for the SWly % and NEly ij of Lot 2, Rest Point, resoectively owned by them. They informed members they have owned summer homes on the two lots for a great many years and that they were retired and could not afford the cost of two homes, and they wished to build a permanent home on eaeh lot. Since the property was in single separate ownersiiin. VARIANCE 1400-1406 Rest Point Road Southworth moved, Elliott seconded, to recommend approval contingent on: 1. Survey of the site and proposed buildings be submitted before any permit be granted 2. That letters from the encroached-on neighbors stating exactly what number of feet of setback they were not objecting to 3. That 3' could be tiie minimum side setback 4. That the proposed residences have a maximum separation to prevent total loss in the event of a fire. They did not deem it adequate and asked that he submit a survey of the property including the exact placement of buildings. LOT SIZE VARIANCE 3587 North Shore Drive George Johnson showed a plat of Partenwood, now ready for final approval. He shov/ed there were a few changes from the preliminary plat, for the expressed purpose of moving lines to preserve trees and the ecology of the area. He stated the street serving the subdivision was progressing rapidly and siiould be done suortly. On the evidence submitted, FINAL APPROVAL Partenwood Searles moved, Rverse seconded, that final approval should be recommend’d. Motion, Ayes (8) - Nays (0). Tom Loucks of Brauer 8 Associates, opened the meeting to discussion on Phase I of the Comprehensive Plan. Discussion opened on the population projection. Mr. Loucks stated that there have been various population projections for Orono with a great variation in estimates among planners. He thought as the plan progressed there would be more accurate population projections. Van Nest took exception to the Marshlands and Hydrology report. He deemed tlie report more of an opinion by the author rather than being factual. Searles was of the opinion there should be a separate paper on ecology alone.*. PHASE I REPORT fi Mr. Loucks stated the purpose of this first report was to set the tone of the report in its entirety. He also stated that thHe also stated that m ere has been much researcii in the area of hydrology and ecology resulting in many theories but they would h resulting in many theories but they ave to hold fast for concrete developments, In the matter of land usage, he said experience proved that the best way to get food input into a plan was to get the citizens themselves interested, and while it was easy to get any given citizen interested if he were personally involved, to get involvement in an overall plan for the Village was more complicated. He said there would iiave to be more articles in the news media setting forth that it is of vital interest for everybody to be involved. Members stated that while they did not concur “■ ■ ■ ‘ theon all things, they thought the report on the whole was good and so thanked him. r MINUTES OF A REGULAR MEETING HELD JUNE 19, 1972 Page 3 Mr. Pedersen repiecentlng himself in a rear setback variance on a let in the Robert T. Smith property. Casco Circle, which was given preliminary approval last fall for a subdivision into three lots. He showed a site plan with elevations stating the SETBACK VARIANCE Casco Circle reason for the variance was the topography >ite and that o of the property dictated the site any other placement would mean costly construction anti the loss of two beautiful largo trees. Mr. Walter and his attorney, Tom Carlson, presented a memorandum, setting down objections to the placement of the residence at this site; in fact, presenting objection to the property division such as this whereby the front of his house would face the rear of the proposed dwelling. Mr. Carlson, in his memorandum, stated Mr. Gilbert has proposed ar. alternative which would not depreciate his property nor cause Mr. Pedersen any undue hardship. Discussion followed on what legal obligation a p-oporty owner has to preserve a side view to the lake as long as thore was an unobstructed view down the property lines. Members asked the Building Inspector if he could issue a building permit on this property and he stated he could not until the final plat was approved and signed. Members unanimously agreed that they should make no recommendations for a variance until such time as the plat was finalized. Members studied the plat of Hans Weiler, 1135 North Arm Drive, consisting of 11 lots--10 offshore, and one shoreline. Mr. Weiler did not appear so members asked the secretary to notify .Ir. Weiler to appear and answer questions they had; also, for the secretary to obtain the number of unit sewer assessments placed on the property. REARRANGEMENT OF LOTS Elmwood Avenue % The secretary was advised the next meeting date would be July 5, 1972 at 7:30 P.M. JULY 5, 1972 MEETING Discussion was hold on how the "Finding and Recommendation** forms could best be used. The secretary was asked to fill out the first sheet on each case only and submit tlie rest cf the form to members. Ryerse moved. Hays i- - - -- - - W be adjourned at 10:20 P.M.
