June S, 1972 Tae Planning Commission met on the above date witii the following members present; Chairman Poisson, Gasch, Herfurth, Kullberg, Searles, Southwortli, and Van Nest. Absent: Elliott, Hays, Nicholls, and Ryerse. G Gasch moved, Southworth seconded, that the ninutes of the meeting of May 15, 1972, be approved. Motion, Ayes (7) - Nays (0). Richard Schieffer represented Howard Eisinger in an application for a variance from Municipal Ordinance NO. 125, for purposes of conducting a landfill operation using dirt, rock and construction materials. He pointed out that Mr. Eisinger was a legal non>conforming use and tliat he recognized it was necessary to get tite Village approval and obtain a license. He was of tae opinion that Ordinance NO. 125 was a rather vaguely drawn ordinance much like many obscenity and vagrancy ordinances, iic tnougat the Mills' report was more of a study on the speed of the runoff through the various culverts controlling the creek running through the property than an adverse report on the proposed landfill operation. Van Nest interspersed at this time that the Minnehaha Creek Watershed District had definitely taken a stand against tne use of the property as a landfill. Searles stated tae use of tne property throughout the years was unique and had carried certain privileges in its usage not common to ot.ier properties so tliat removing these privileges was not removing a right common to other properties. Mr. Schieffer countered that many variances have been granted in the Village and that variances always grant privileges. ?!r. Dale Palmatier from the Minnehaha Creek Watcrsiied District spoke briefly saying tne reason for the board's negative decision was because the site is a drainage collection basin for a very large area and the creek flowing tnrough it runs directly to Lake Minnetonka. Their concern was that there would be a contamination of the creek and also the ground water. Fir. Gene Hiclcock, also of the Minnehaha Creek Watershed District, used as an example the old Johnson Street landfill in Minneapolis where the city had dumped old buildings from urban renewal projects. He stated these old buildings definitely caused a contamination problem. (Continued) 7:30 P.M. MINUTES VARIANCE - ORDINANCE N012S Eisinger I . ; MINUTES OF A REGULAR MEETING HELD JUNE 5, 1972 Page 2 O Gascn asked Mr. Eisinger If he could contain the operation so as to conform to the conditions set by the Village Council at their meeting of March 27, 1972. Mr. Bisinger stated it would be very limited usage if he could only use the area 5* elevation above the watertable. CounciIwoman Butler spoke from the floor saying there should be recognition of the fact that a landfill operation in this site would be a public service. Van Nest moved, Searles seconded, taat due to the adverse report from the Minnehaha Creek Watershed District and Mr. Mills, the petition for the variance should be denied. Motion, Ayes (7) - Nays (0). Kullberg wished to be on record that if Mr. Eisinger could conduct his operation on property 5’ above the watertable, he would be in favor of granting the variance. Douglas Dayton represented himself along ^1rith Dennis Trisler from Brauer B Associates in an application for a variance from Municipal Ordinance NO. 125 to construct ponding areas for wildlife on his proerty at 300 Sixth Avenue North, ile presented letters from the U.S.D.A, and U.S.D.I. stating they iirere in complete accord with his objectives. He also had letters from neighbors saying they. were in complete accord with the project. Mr, Dayton stated it was hard to say how much of anything done on private property could be strictly in the public interest. Searles moved, Herfurth seconded, that since the project was in conformance with the intent of tne ordinance, recommendation should be made for approval of the variance. Motion, Ayes (7) - Ways CO)* Ray Mithun represented himself in an application for a division of 1.7 acres into four lots. It was determined that wliile the proposed division showed four lots, ilr. Mithun would only ask for tnree lots. Kullberg moved to recommend the division be into three lots conditioned that holding tanks be used for septic systems where necessary. Motion died for lack of a second. VARIANCE Continued) VARIANCE ORDINANCE NO. 125 300 Sixth Avenue North DIVISION 1065 Ferndale Road West (Continued) MINUTES OF A REGULAR MEETING HELD JUNE 5, 1972 Van Nest moved, Gasch seconded, that anproval be recommended for two lots conditicueJ on septic systems approved by the Village Engineer be installed. Notion, Ayes (5) - Nays (1). Kullberg Nay. iierfurth abstained saying economics, arrived at from tne assessed valuation of the property, dictated that this could not be used as two lots. Members studied the plat of James McCleary, 3587 North Shore Drive, and were unanimous in that they did deem the property as large as shown on the plat map which consisted of about 8,000 sq.ft. I iierfurth moved, Gasch seconded, that Mr. McClearv bring in a survey showing dimensions of the hard land in the parcel, the amount of square feet, location of the e’asement, and existing and proposed improvements. Motion, Ayes (7) - Nays (0). O Members studied the proposed division of Timothy Fiske, Fox Street and Old Crystal Day Road South. It was determined that the division did not comply with Municipal Ordinance NO. 132 since there was no residence on the property being divided. Searles moved, Southworth seconded, that the house stipulation should be waived since the parcel being divided was going to a parcel having a residence on it, and the division be recommended. Motion, Ayes (7) • Nays (0). Robert Schultz represented himself in an application for a size and frontage on Lots 2 8 3, Block 7, Summit Park. It was determined the lot was in single separate ownership since 1967. Van Nest asked Mr. Schultz if he could purchase the single lot next to him and add to iiis. Mr. Schultz said he was trying to do this. Page 3 DIVISION (Continued) VARIANCE 3587 North Shore Drive DIVISION Fox Street 8 Old Crystal Bay Road South VARIANCE 1425 Oak Street Searles moved, Southworth seconded, that the variance be recommended conditioned on plans for an adequate septic system be submitted before any building permit be granted. Motion, Ayes (6) Nays (1). Heirfurth Nay. Tom Loucks, Braure 8 Associates, passed out the first phase of the Comprehensive Plan, a summary of findings analyzing the community as he saw it, then in conjuction with five plates lie brought along, spoke on the contents in the report. They did not think it possible to maintain this setback. VARIANCE 1390 Rest Point Road Poisson moved, Searles seconded, that Mr. Lindow be required to make a survey showing these dimensions. Motion, Ayes (7) - Nays (0). Members recommended that an ordinance be enacted requiring surveys for all building permits and variances. SURVEY - PROPOSED ORDINAN^ Poisson moved, Searles seconded, that Rex Ressler, 3683 North Shore Drive, bring a good site plan and survey of his property. Motion, Ayes (7) - Nays (0). VARIANCE 3683 North Shore Drive Members studied the plat map in the area of Lot 17, Wallaces* Addition to Minnetonka Beach where Scott l/hitnah, 3339 Crystal Bay Road, has applied for a variance on lot size and frontage. VARIANCE 3339 Crystal Bay Road O Members did not deem the $3,855 assessment excessive and though there are many homes j in thearea on the same size lots, they did not feel the trend should be perpetuated. Southworth moved, Searles seconded, that the application be denied. Motion, Ayes (7) - Nays (0). Discussion was held on the possible use of Big Island as a park and the resolution by the Village Council to this end. Van Nest said DIG ISLAND he had received many calls from irate property owners on the island protesting this resolution being passed without any notification property owners. Searles explained the purpose of the resolution was only to allow Hennepin County to make long range plans on acquiring the island as a park.
