DISCUSSION - Big Island Park >- VILLAGE OF ORONO Regular Meeting of the Planning Commission liay 15, 1972 * The Planning Commission net on the above date with the following members present: Chairman pro tern Herfurth, Elliott, Gasch. Hays, and Ryerse. Absent: Caairman Poisson, Kullberg, Nic.iolls, Searles, South- worth, and Van Nest* Also present; ?*ayor Oberhauser, CounciImen Masse*'.gale and IlcCart.iy, Ryerse moved Elliott seconded, that the Minutes of the Regular Meeting of ??ay 1, 1972, be approved. Motion, Ayes fS) - Nays (0). .717 Douglas Dayton and Dennis Tirsler from Brauer 5 Associates presented engineering data in an application to dredge in order to pond water on the Dayton premises at 300 Sixtii Avenue North. Gascn questioned tne propriety of using Brauer Associates when the Village has a contract with this firm which states there shall be no conflict of interest during the period under the contract. Mr. Dayton stated he had tne firm under contract since July 1971. ifr. Trisler pointed out tne Village contract began February 1972. Discussion then followed whether the application v/as for a variance or conditional use permit. The building inspector stated the application was for a conditional use permit under Sec. 31.700 and the $30 fee for same has been paid. Mr. Dayton stated the land in question had once been a swamp and been filled in the past and now was a pasture and that they now wished to create new ponding areas where the old ones had been. He showed plans for maintaining water levels and for the prevention of siltation into Mooney Lake. Hays moved taat a public hearing be held and the the Commission should have a report from tiie Minnehaha Creek Watershed District before making a recommendation, ‘lotion died for lack of a second. Menbers asked Massengale for an opinion, ile stated tne Village Council was looking for some factual information from members as to whetner the project was in the interest of the public. MINUTES CONDITIONAL USE PERMIT Ordinance NO. 125 Dayton il MINUTES OF A REGULAR MEETING HELD NAY 15, 1972 Page 2 Mayor Oberhauser spoke froa the floor saying that it was up to the applicant to show the project was in the public interest, which is the prine objective Ordinance NO. 12S in its statenent of policy. Elliott moved, Ryerse seconded, that Mr. Dayton should bring in further substantiating information for the meeting of June 5, 1972, to show that the project will be in the public interest. Discussion was now held whether this an official meeting since there was not a quorum present. It was decided that all the remaining items on the agenda should be moved to the June 5, 1972 meeting, but that if anybody who had come for the meeting wished to be heard members would listen and discuss. Mr. NcCleary and Mr. Schultz spoke. On the natter of Mr. Schultz, members recommended that the lot be cleaned up before any further action would be taken; also, that he make an investigation of lot with somebody having expertise in the natter of septic systems before he purchased the lot.
