April 17, 1972 Tae Planning Conunission met on the above date witn the following members present: Chairman Poisson, Elliott, Gascli, Hays, Herfurta, Kullberg, Wiciiolls, Ryerse, Searles, Soutawortii, and Van West. Also present: Couiicilman liassengale and Village Administrator ilartin. Gasca moved, Soutawortii seconded, that the Minutes of tae Regular Meeting of April 3, 1972, be approved. Motion, Ayes (10) - Nays (0). lembers again reviewed the data in tae matter of a division for the Joiin Gerhardson property consisting of combined Lots 11-12-13-14-5-6, Block 1, Summit Park, whereby ae intends to divide off Lots 5^6 from the remaining lots. Brought out were the following: 1. Mr. Gerhardson sold Lots 11-12-13-14 with a residence on it in July 1969, 2. The combination of the above lots make for a through lot with frontage on Park Avenue and Tonkawa Road. 3. Taere could be a possibility of approving a division for tax purposes without approving the lot as a building lot. Kullberg moved, Southworth seconded, taat tae division be tabled until the next meeting and Mr. Gerhardson be asked to appear to answer questions as to his intent for the property. Motion, Ayes (11) - Ways (0), Poisson read the Minutes of the Village Council meeting of April 10, 1972, covering the landfill license for Howard Eisinger, 3245 Wayzata Boulevard. 7:30 P.»M MINUTES DIVISION Tonkawa Road f} Par LANDFILL LICENSE 3245 Wayzata Boul Massengale furtiier clarified the present status of the above matter by stating Mr. Eisinger already had a non-conforming conditional use permit to operate a landfill but had ceased operation last year wnen he felt he could not meet conditions imposed to obtain the necessary license to operate tae landfill. Further, the ^'illuge Council felt it was now necessary to obtain a variance under Municipal Ordinance No. 125 to operate a landfill. If, and when such zoning were in effect, and development took place, this area would be a natural catch basin for the drainage for tne entire area. If the area were filled, greet expense would result at such a time to runoff by means of storm sewers* LANDFILL LICENSE (Continued) Van Nest expressed concern over setting precedent bv allowing filling of this area, iie was of the opinion pressure would be brought to fill other sites in the area. Poisson questioned whether such a variance could be legally granted. Searles moved. Hays seconded, that there s.iould be a written report by the Village Eiigineer on how future development would effect the drainage of the entire area and how this could bo accomplished and to wiiat expense. Motion, Ayes (11) - Nays (0), Mrs. VaeVenzie and Leo Primus represented themselves in a petition to conduct an art fair at 4680 Uayside Road on two weekends in June. Mr. Primus and Mrs. ilacKcnzie explained tiiat there would be no amplified entertainment and that the main purpose of the fair was to exhibit art. One reason for naste was to get approval and get the various neighboring higii scnools to exiii'jit some of their art forms. They showed letters obtained from the Mapld Plain Fire Cnief and Hennepin County Slier if fs Department showing they would cooperate. Searles moved, Ryerse seconded, that approval be recommended conditioned on: 1. Tnat there be no loud enterainment nor any amplification. 2. Tliat there be no parking on public roads. CONDITIONAL USE PERMIT Ski Tonka Art Fair 3. That each days activity cease at 6:00 P.M. Also, that it be recommended a raincheck to move the fair ahead in the event inclement weather force postponement. Motion, Ayes (10) Nays (1). Hays Nay. 1 r MINUTES OF A REGULAR MEETING HELD APRIL 1/, 1972 Fred Luces represented himself in an application for a building permit to construct a building on Lot 5, Langdon Park, 2535 Shadywood Road for purposes of conducting a hooby business that would be mostly wholesale ma'l order with a small amount of retail, ile presented a simple sketch showing that the building would be 75' X 125' with four parking spaces under roof and a small office and display area. The remainder to be a warehouse for inventory. Poisson moved, Searles seconded, that approval be recommended providea all local and Statv ordinances are met. Motion, Ayes (11) - Nays (0). Page 3 BUILDING PER:IIT Commercial Building 2535 Shadywood .load O i-oisson opened the meeting to discussion on adopting an ordinance regulating large assemblies. Gasch asked if this would regulate meetings SUCH as those held by schools, the Minnetonka Art Center or Spring Hill Conference Center. Mass'^ngale explained the need and intent of the draft of the proposed ordinance. Searles moved Elliott seconded, that the matter bo tabled for further study until the next meeting. Motion, Ayes (11) - Nays (0). PROPOSED ORDINANCE Large Assembly Searles stated the Lake Minnetonka Conservation District was redrafting the policy which would be ready in about a week. The intent was to draft a policy that would take the LMCD out of the approval chain and place those powers in the hands of municipalities to legislate and enforce, the LMCD only maintaining a reviewing status. He stated the intent was not to place another layer of government on citizens to harass them, but on the other hand, the LMCD did not want a completely emasculated policy. He again stated the prime purpose of the ordinance was to control runoff and to this end they were working with other agencies, namely, the Pollution Control Agency, Minnehaha Creek Watershed District and Department of Natural Resources. A brief discussion was held on the relations between municipalities and the I.MCD. Searles told members to await the new draft which would be forthcoming shortly before formulating any concrete opinions. LAKE MINNETONKA CONSERVATION POLICY ^ • fUNUTBS OF A REGULAR f^BBTING HELD APRIL 17, 1972 To« Loucks briefly reviewed the proeress being aede on the co^>rehensive plan. He said Phase I of the plan should be ready for review about the third week in May. Mrs. Schroeder spoke fron the audience regarding the drainage problem on Kelly Avenue asking members to consider the problems that could arise from further development in light of the problems already there. Herfurth asked to be removed as chairman of the PUD committee due tu a lack of time to serve in such a capacity. He said he would gladly turn over all the research he had to the committee and serve as a member instead of a chairmen. The committee decided to meet after the meeting. Searles moved, Ryerse seconded, that the meeting be adjourned at 9:45 P.if. Motion. Ayes (11) - Nays (0). Respectfully submitted.
