Hake. Meni)ers Hannah, IXsilap, Van Nest and McDonald. Zoning Administrator, Henr)»^ F. Mi;^lch. Absent: Woolley, K^lestad, Curtin Guthrie and Pesek. Van Nest moved, Hannah seconded, that the Minutes of the Planning Conmission Meeting held Novenfcer 18, 1975, be ap­ proved as amended. Motion, Ayes (5) - Nays (0), Robert Frost requested a variance to construct a new garage 23 ft. from the side lot line and 35 ft. from the rear ot line. Although there would be room on the east side of the property, if the area were graded, the west site proposal had an existing driveway. The cqpplication for the tract, consisting of cue acre in a five acre zone, would have met the previous zo^g conditions. Mr. Frost explained that an old shed, in which he stores various ecfuipment, would be tom down inmed- iately after constiuction of the new garage. Van Nest moved, IXnlap seconded, that the Planning Ckminissicjn reconmend to the Council that due to the lot being in existence prior to the rgw zoning and that the petition would have met requirranents a one acre zone, approval of the variance recjuest of Robert riwt be granted, but conditional that Final Approval by the Building Inspector be withheld until the existing shed be tom down. Motion, Ayes (5) - Nays (0). Stephen Helland, representing himself, Dave Davei^rtt and Jms Wagener, presented the Final Plat of 'T)rono Orchards Highlands". It was noted that all the tracts met the two acre reqfuirement but members expressed concern about the old tract lines being shown on the hard shell. Dunlap moved, Hannah seconded, that the Planning Conmission recommend to the Council that the Final Plat of Orono Orchards Highlands be ap­ proved subject to the Engineer's recomnendations and the Paik Dedication Ffee being paid in accordance with forthcoming Fee Amendments. Motion, Ayes (5) - Nays (0). The Zoning Administrator explained the petition of Phillip Dykstra because no one appeared as a representative. The appli­ cation requested subdivision of a 2.22 acre tract near a channel, into two parcels, both of vdiich would exceed the minimum lot width requirement of 140 ft. The Zoning Administrator noted that the tract had been assessed for two units during the 1973 sewer pro­ ject. Both of the properties would require private easements for ^^ess to the road and the other for access to the lake. The ling Administrator conmented that the easement to the lake would probably create an additional dock. Due to the area having long, deep lots, the Commission expressed concern as to the public opinion of the possibility of another row of houses in the neigh­ borhood. The Planning Commission directed that a Public Hearing be held on 19 January 1976, at 7:30 P.M. in the Orono Village Hall. ATTENDANCE - 7:45 P.M. The Zo^g Administrator expressed his opinion that the pro­ posed fill may obstiuct the natural drainage and ponding in ^ ma. and could be a visu^ obstruction for the neighbors. Van Nest moved. Hake seconded, that the Planning Conmission recamiOTd to the Coiticil that the request of Roget Swanstrom TO denied because there are suitable boat stevaro aieas at m site that do not need filling and that Mf. Swartsttttll be advised that the boat could not be stored beyond the front setback line of the house. Motion, Ayes (5) - Nays (0). Wd Rovick made application for four variahces in order to build a hoTO on his property at 1055 West Ifemdale Poad. The tract consists of .75 acres or 32,670 sq. ft. and is presently zroed at two acres. The variances requested vrere (1) Area - 54,450 sq. ft. (2) Lot width of 25 ft. (3) Side Yard set- back of 15 ft. and (4) Street Setback of 33 ft. Tne location would meet the 75 ft. lakeshore setback requiremmt according to the application. The Coninission noted that there was no adjoii^ vacant property by the site and that the tract was held in single separate ownership. During the discussion, a z^resentative from Gessco Builders, appeared in behalf of ^ proceeded to discuss the building plans Ji the Conmission. Additional problems conceming a deck :adied to the house and within the lakeshore setback, were noted, as was the necessity of a hardcover variance. Mention was made that the present plans were to have a holding tank in place of a septic system at the site. After the problems were evaluated. Van Nest moved, Hannah seconded, that the Plam^g Conmission recommend to the Council approval of the application due to the hardship caused by the small size of the lot, because no adjoining land was available, and because ™ pr^rty w^ in sin^a^separate ownership although the following conditions are mer: (1) lhat the sewage system be a^roved by the Village Engineer (2) That the Building Peimit cite specific Village restrictions on filling, grading and tree remwal and oust be 75 ft. from the lakeshore. (3) In ad­ dition to the variances requested in the application, a 231 variance on hardcover be allowed (4) That the deck, cs shown TO the plan, within 75 ft. of the lakeshore be allowed provided it IS of open type, raised construction with — beneath and that no concrete be used. Motion, Ayes (5) - Nays (0). (2) That the Village of Oxono be granted an access onto Lot 2 for a public roadway in case this should be found desird>le in the future. (3) That the Village of Orono be grmted a scenic easeoent on Lots 1 and 2. (4) That the building setback on Lots 3 and 8 Hist be 35 ft. from the Old Long Lake Road ri^t-of-way. (S) That Lot 6 be allowed an on-site septic system until such a tine as any otbe: lot be built upon but sewer must be provided before occupancy of the second house. (6) That the Homeowners Association Agreement be reviewed by the Village Engineer and ai^roved by the Villan Attorney. The Planning Gcmnission determined that beginning January 1976 the Planning Commission would hold their meetings on the first and third Mondays of the month.
