The Chaimen revlet^ petition and noted that the Village Engineer oonfiymBid the wetlands area at a total of one acre. Hcwever, the Engineer's findings showed that the survey presented by the petitioner included the road ri^t-of-^gey in oonputing the total buildahle area. Biis reduced the HinAiMo area of the proposed 1.73 acre lot to 1.47 acres, the 1.85 acre lot to 1.57 acres and the 2.75 acre tract to 2.32 acres with the one acre wetland area included. Previous concern as to a cre^ naming thru the tract was unfounded and the creek's location VBS not in the area of the petition. After aU public present were given an opportunity to be heard, the hearing was closed. ^ Qcono Planning Ocmmission met on the above date with the following menbers present: Acting Chairman, C. Ifannah moved, Qartis seconded, that the Minutes of the Plan- T^ng Connission Meeting held November 3, 1975, be aipproved. btion. Ayes (7) - Nays (0). moved, Vhn Nest seconded, that the Planning Con- mission would not reoomnend to the Ooincil approval of the Ulmer Construction Company subdivision as it was presently proposed but would table the petition until the applicant could present an alternate plan showing only two lots as the entire parcel consists of only 4.36 dry buildable area in a two acre zoned district. Motion, Ayes (7) - Nays (0). Carol Ann Bialcn petitioned the Oommission to construct a deck onto her house which would require a variance of 14 ft. fron the lakeshoie setback reguiranent. The deck was pre­ sently in existence having been constructed without a building permit. When oonstruction weus suspended, it was discovered tuet the addition did not oonply with setback requirements. She described the dedc as' being of open wood oonstruction and set about three ft. off the ground, it could be a pro­ bable oonoem for the future, the Zoning Actodnistiator noted that someday someone might want to add a overhead covering to the deA or otherwise make the deck more solid than the one existing vbich would make a more substantial increase of #**jrdcover. Mb. Bialcn requested and was informed as to the wealing of hardoover. Guthrie moved, Hannah seconded, that the Planning Ocmmission reoammend to the Council approval of ^9 lakeshore setback variance application of Carol Ann Bialon mt that approval was on condition that the deck be of an open type ocnstructioi and that no oovering be put lum it. Originally fted Rogers, owner of the parcel, had made applicatim to build on the tract but the Planning Com­ mission reoonmended denial of his permit. Mr. Rogers withdrew the matter before the Oouncil oould act. Mr. Stewart is in­ terested in purchasing this parcel to combine it with his adjacent property so that he could construct a garage. The determination of the buildability of the lot would indicate vdiether it was economically feasible to proceed with his plan as the OMier would probably request waiving the recent sewer assessment on this lot. Member Hannah noted that he would abstain frcm participation with the Planning Omnission due to having an interest in the property. The Oo^AiSsion noted that both lots with houses on them were substandard than 1/2 acre and concurred with the Planning Oonniss: vicusly made. Van Nest moved, Dunlap seconded, that the ning Oomiission reoomnend to the Oouncil that because Tn 6 and H, Registered Land Suru^ 269, have been in oomon ship for many years and that Tract G is less than 1/2 acre in a one acre zoning area that the tract be determined not build* able. Motion, (6) - Nays (0) - Abstain (1) Hannadi. Curtis mmd, Hannah seconded, that the Planning Gcmnission ^psoonmend to the Oouncil that the Variance Application of MoCaffrey to renoue one tree within 75 ft. of the lakeshoze be approved as sidbadtted as he has many «S- ditional plantings sinoe purchasing the property. Motion, ^es (7) - Nays (0). Earl Norwood requested a variance of 5 ft. from the side lot line and 5 ft. frcm the street lot line in order to con­ struct a garage. Presently tlie lot that the garage would be built on is a separate tract from the hcmesite. Altogether Mr. Norwood canes a total of four substandard lots which ad­ join his property, all of which are tax delinquent. In order to ocnbine the lots %dth his hcmesite, Hennepin County would require all delinquent taxes to be paid. Mr. Norwood explainec that this VBS his intention but that even with the combination the variance request would he necessary. He explained that he had renewed the old garage to another location. n»sently it %ms on akids but he intended to use it as storage for cyclcm, boats and sports equ^nent. He explained that if tte garage %ere placed in another location his view from the house would be cut off. Gonmission menters agreed that the selected site %«s probably the best place _ _ _ __ _ was located on a dead end street and is adjacent frm the neighbor's garags. McDonald moved, Guthrie seconded, tha Pl^mning Oonmission recommend to the Council that the var ^iquest of Earl Norwood be granted due to the stmpe and t gzaphy of the location but only linquent taxes be paid and that all four lo the hcmesite. A larger unit had been approved by the Council in 1974 but OrB to eocncmic onnditiflns the previous plan had been postponed. Elevation, drainage and everything else about the plan v«as the same as in 1974 except that instead of a building of 50,000 sg. ft. in area and 21 ft. height, the net^ pLm called for a 30,000 sg. ft. area and a 25 ft. height. He eocplalned that the drainage problem of the 1974 petition had been corrected by installation of culverts. The Oonmisslon noted that the plan seaned to meet the conditions of the code, van Nest moved, Qithrie seconded, that the Planning Camission reoonmend to the Council approval of the site and building plan of Vai Dale, Ihc. for an industrial addition provided that on review of the plan the metal wall surfaces oonply with code, that all landscaping be included, and that the Village Engineer approve of the drainage. He noted ttet presently the area At hie tract was not natural gzound but conposed chiefly of dredgings from channel areas over the years. He did not want to change the elevation of site but wanted to fill holes to level with the natural ^^^ound on the Maxwell Bay side of the property vdiere he said erosion was very substantial. He stated that the east­ ern oontour would be left as is. Concerning the trees to be taken out, he was presently only aware of three but due to the mmerous amount at the site he had not had time to make close inspection of them and possibly more would have to be removed. The applicant was informed that no reconmendatlon could be made regarding his rip xi^ proposal until more com­ plete plans and data were submitted. Curtis moved, Hannah seconded, that the Planning Ccnmission xecatmend to the Council that the removal of trees be allowed and that due to the land of John AUenburg being chiefly oonpoeed of lake dredgings he be given permission to fill in depressions to the natural ground level but not to change any grade of the land and that all the above work be subject to the approval and discretion of the Zoning Akninistrator and the Village Qigineer. He noted that the sewer should be oonstruoted to Village specification so if someday the Village would maintain He stated that an it had been node with Meyzata to serve only six houses at the site. In his opinion, title to the property would have to be by registered land survey with the open area in six part undivided ownership. Ihe plan also included giving an open space easement to the Village to insure that the open space area would not be built upon at a date. Vian Nest moved, Dunlap seconded, that the Planning Conmission fully support the intent of the HesolutiGn entitled "A Be solution To Maintain The Water Patrol At Its Present Level” but suggest the fol­ lowing he added or revised to read: (1) Paragraph 1 - liiareas, Orono has in its boundaries at least 40% of the shoreline of Lake Minnetonka. Van NSst moved, Dunlap seconded, that the Planning Cenmission recoBmend to the Council that they draft a Resolution for pre­ sentation at the Metro Waste Control Conmission Public Hearing to be held Deoenfeer 4, 1975, stating that use of the intercep­ tor be restricted within the boundaries of Orono as it would not be oonpatible with the Orono Conprehensive Land Use Plan and would create urban development and a far greater pollution ispact to the Lcdce Minnetonka area thru stozm water runoff. Motion, Ayes (7) - Nays (0).
