Proposed Procedures Change - Concurred * f CITSf CF ORONO, MINNESOIA FEX31LAR PU^NNING OCrfOSSION MEETING HEID NCMMBER 3, 1975 Tile Chaizinan announced that this vbs the tine and the place for a Public Hearing to be held oonoexning the Preliminary aibdivisicn proposal of Uliter Construction Ccmpany. The Zoning i^dministrator read the Notice of Public Hearing and presented an Affidavit of Publication. The representativer Dennis Ulmer, of Ulmer Construction Conpany arrived late so the Zoning Adninistrator presented the application. Pre viously the Planning Coninissian learned that the property contained some marsh area and a new survey had been submit ted. The total area of the tract consists of 6.33 acres and one acre had been determined as wetlands. The propos£d was to divide it into three lots sized 1.73 acres, 1.85 acres and a 2.75 acre tract that included the one acre of wetlands. It was noted that the area had potential for future sewer vdien the Metro Sewer Line connects. Donald Gronberg, a nei^ibor living across from the property, felt there vould be a Kptic problem. The Zoning Administrator noted that a satisfactory perculation test requiring the Village Engine er's approval would be a requirement if a Building Permit was submitted. The Comnission noted that there was still 1.75 acres of dry buildable ground on the site containing the vetlands. various neighbors, iigluding Ivan Gunsolus, Dcug Peasley, and David Fischer, ware concemed primarily with sewer assessment methods and objected to the criteria f one side of the street having sewer and the other side n^ able to connect. The Chairman noted that these ques tions were not the issue and that the Oonmissian must wodc with the decisions that had been made. Althcu^ several people disagreed, Mr. PeasI^, believed that a creek ran thru tile property. In order to verify the conditions at the site the Commission made the following decision. Van l^t moved, Hannah seconded, that the Public Hearing be continued at the November 18, 1975, meeting and that the Oonmissian and other's oonceined msJce a personcd viewing of the site and the Village Engineer submit a report of the wetland status at the site. ORDNO VniAGB HAIL APPROVAL OF MINUTES MEETING OF 10/21/75 HAIWINS OCMCSSION JCETING - NOWMEER 3, 1975 - PAGE 2 Mr and Mrs. Kermit Eisinger presented a revised variance proposal for his plan to oonstxuct a new detached garage at his property. It vould xeguixe approval of three setback variarces. The front yard setback was requested to be 47.9 ft., with a 9*10” aide yard setbadc. A four foot variance on the required 10 ft. span between structures would also be The Ocninission stated that the new plan followed their raomBhdidations of the last meeting and acknowledged the difficulty of altering the house and the existing drive- area vhich had been ocnstructed so mai^ years ago. The reqpiest would also have met the zoning requirements prior to adoption of the new code in January. Dunlap moved, Kal- lestad seconded, that the Planning Garanission reocnmend to the Council approval of the revised variesioe application of Kermit Eisinger due to the hardship to the structure and be cause of sindliar locations of structures on neighboring properties. Motion, Ayes (7) - Nays (0).
