It was bieir contention Idiat the Village had approved a 30 ft. lakeshore setbadc on the plat at the time of Council approval of the plat in 1972 or 1973. Because the Council had knowledge of the setback at the time of platting and had in cluded it as part of the platting procedure and, also, because the lot could n66 under.any oonditions meet a 75 'ft. 'setback, the applicant did not feel he was bound by variance requirements The Planning Oomnissicn requested the Village Attorney to give his opinion on the matter and for the Council to review the J0»l AU£NBUB&4AIVB VARIANCE 805 PARDENHOQD RCAD matter at their next meeting. T3ie GoRmissicn requested that the Allenburg application be returned for their reconroendaticn if it is found that a variance is required. O Mr and Mrs. Howard Eisinger were present and ready to have their petition for a landfill operation hearj[ by the Com mission. Because their was not a quorum to act in an of ficial capacity die matter %as not heard but they were ad vised that the matter would appear on the Council Agenda on October 14th.
