Ifedce, Kallestad, Pesdc, Guthrie, Dunlap, Curtis and McDonald. Council Representative, Gary Welsh. Zoning Administrator, Hank Muhich. Absent: Woolly and Van Nest IXie to staff involvsment in other wcdc project time re­ quired with 73-1 Sewer assessments, the Zoning Ackninis- txator offered apology to the Planning Ocnmission for not having been able to oonplete the suninarization of information ocnoexning the Cheyenne Land Oonpany re zoning request and Eisinger Landfill Application. e The Planning Ocnmission proceeded to review the request of Hartley LaJoy for a street side property line variance for the oonstructicn of a detached garage. At the site was an existing slab approximated at 20 foot from the road. By this cement slab was a well and if a new slab were required it would necessitate the removal of trees and greenery and cut off the view from tiie house. He stated that there were no objections to the plan by the neighbors. Ihe menbers of the Oomnission, \Atd viewed the property, said that there w^ oonparable garages in the neighborhood. Ihe Zoning AAninistrator noted that Mr. laJoy was having a survey made. The 2qpplicant then pro­ duced tile survey stating that he had just received it. Examination showed that the existing slab was at zero lot line and in conflict with the application presented to the Ocnmission. Due to the survey being in variance with the original request, the matter was tabled until the applicant could si±mit an alternative plan. Mr. & Mrs. James Morava appeared in srqpport of their request for a variance on lot width and lot area for their tract at 910 Dakota Avenue. The parcel is 160 ft wide at the prcp-ised location of the house and has a total area of 31,800 sq. ft. Zoning codes require lots of 200* width and 2 acres in size. Presently at the site is a shed having a concrete slab, about 24' x 14', that they planned to convert into a garage. The appli­ cant has subnitted perculaticn tests are in the hands of the Village Engineer. Mr. Moravi^ noted that all the lots surrounding their property have been built ugcKi and without a varLanoe th^ would be left with an unbuildable but legally platted zesldentied lot. Dunlap moved, Guthrie seconded, that the Plemning Ccmnission reocmmend to the Oouncil the ^prcval of the variance application of James Moravel for 910 Dakota Avenue s\±>- ject to a favorable report from the Vlllcige Engineer concerning the perculaticn test and with the stipula­ tion that the shed located at the site would not be used as a second living quarters. O ^hree applicants, Stephan Helland, Dave Davenport and James Wagener, petitioned the Village for a lot rear­ rangement and division of the "Old Dave Duff property" located at 130 Sknith Av^fiuej^ The proposal was for a group of substandard lots toconobined and redivided in­ to four parcels exoeeding the two acre zoning require­ ment. It was verified that there were no problems with wetlands at the site and adl things conformed to Orcno Zoning requirements leaving a more desired situation th» the present one. It was noted that some years ago se had burned down at the site leaving an open mt and abandoned swinming pool. At the time of approval by the Oouncil of the Stubbs Bay Addition., the Oouncil stipulated that any structures placed on this easement would require Council approval. Kallestad moved, Dunlap seconded, that the Planning Oomnisslon reoonmend to the Council approval of the variance request of Herbert Olson for the installation of a private dock at the lakeshore easement, Stubbs Bay Addition, because the applicant's property is contiguous to the lakeshore. rtition. The ^fdividad portions would be ocnibined to increase the size of their present undersized lots. The Conmission viewed this as an inprovement over the present situation. Guthrie moved, Pes^ seconded, that the Planning Oamnission recom­ mend to the Council approval of the request of Dale Matson and Arvid Ledin to divide Parcel 9510, Rearrangement of Wallaces Addition, and combine one part with Parcel 9900, Rearrangement of Wallaces Additiciy and the other part with Parcel 4510, Wallaces Addition to the Village of Minne­ tonka Beach. Motion, Ayes (7) - Nays (0). North Star Meudna, represented by Paul Kenpf, presented their proposal for Building Permit site approval and rip rap. This was originally proposed in 1973 but due to the roGratoriim, never received a final decision. Tlie building, 30' X 105* X 30* hi^, was to be built of steel construc­ tion and would be used for the display of boats and as an unheated warehouse for storage of boats in the winter. There wculd be no szQes or service in the building. Mr. Kempf remarked that the height of the building had been lowered since the original application and storage capa­ city reduced to only 38 boats instead of 100. TWc struc­ tures, presently at the site were to be remcved and a third moved behind the new addition. Another building to be moved close to the shoreline that was presently^^was O situated outside of the 75' setback requirement. At present, shrub and evergreens are being planted in a strip along the east lot line. Included as part of the plan was a seawall with a 20 ft planting strip and a wooden or crushed rock walkway. The seawall could be concrete, steel, aluroinicin, wood, etc. At present they were mer^y looking ac possibilities. This seawall was needed to stop erosion of the shoreline due to boats pulling up to shore and to provide protection for the proposed planting strip. McDonald had objections to a concrete wall feeling that if it was allowed soon the neighboring marinas would try to follow suit, which could create hundreds of feet of wall. Most of the mem­ bers agreed and preferred a natural rip rap of rock. Curtis moved, Pesek seconded, that the Planning Commis­ sion recomnend to the Council approval of the application of North Star Marina provided: (1) That the objectives be acocmplished witliout rear­ rangement of the natural shoreline. (2) That no seawall be constructed but instecci a fmxr- able oonoept of rip rap using natural materials that meet the approval of all oonoemed agencies. (3) That the small house proposed to be set at the shoreline not be moved to within 75 ft of the shore. (4) That the site plan be approved with designated 3 ft setback area for planting on the east and west side of the lot lines. Motion, Ayes (53 - Nays (0) - 63 A. LEDIN 6 D. VHth the walkout facing idle lake, it would be necessary to remove roost of the existing steep bank. The proposed €ddition would add 99 sq. ft. of hardoover within the required 75* setback and also grading and removal of some trees. Mr. Boer explained that the only way to excavate would be from the front of the house. The Zoning Administrator felt it could also be done from the side of the house. Mr. Boer felt that by leveling the lake shore bank it would help the erosion pro­ blem. IXmlap felt that precedent could be set by allowance of this so close to the lakeshore and • -v^ferred that if a basement is put in that the walkout be el^iinabed or di­ rected to%«rd the side of the house as this would not re­ quire a different grade to the land than the existing one. ®ithrie moved, Curtis seconded, that the Planning Oonmis- sicn reoonmend approval of the application of Ted Boer ^'ur 1392 Baldur Park Road if the grading as proposed would improwB present erosion problems and that it be subject to the review and a favorable report of the Village Engineer. Motion, Ayes (7) - Nays (0). Enger Johnson presented his request for division of a ^ten acre tract. Parcel 6800, Section 5, into two lots six acres and four acres. Ihe analler parcel with a width of 171 ft. would also require a variance of 29 ft. fEom the 200 ft. Village code. The necessity for the vari­ ance VBS created due to a line of trees which formed a natural boundary between the two lots. Dunlap moved, K2lL- lestad seconded, that the Planning Oenmission reoonmend to Village Council approval of the application of Ehger Johnson as submitted \:qpon payment of the Fade Dedication Pee. Motion, Ayes (7) - Nays (0). Ulmer Oonstructicn Company requested that their property at 70, 130 and 190 Willow Drive North be divided into three lots each two acres. Although the new trunk sewer line goes through the property, the owners are not per­ mitted to hook up becuase of the Long LaJee restrictions on the line and so the zoning is still two acres. Dunlai noted lowlands at the site and examination of the Aerial Watlands Map verified her claim. Dunlap moved, Pesek seconded, that the £^lication of Ulmer Construction Co. be tabled for review by the Village Engineer or that the applicant sulanit a different proposal meeting all zoning requirements or include a variance request with the pro­ pel subdivision. PAUL mmR - VARIANCE 940 DAKOOA AMSNUE A1 Vliltman requested preliminary approval for subdividing his thirty acre tract at 1540 Sixth Avenue North into four parcels sized 15.5, 6, 5 and 4 acres. Ihe Ocnmission noted that the land was all buildable and dry containing only a tiny spot of wetlands in the 15 crrre tract. Mr. Viiitman asked the OcRiidssiGn to hear his appeal for a waiving of the Paxic Dadioation Fee. He produced a drawing showing that he could ’WLk” the property by dividing it into many building sites but as it was his plan to keep the larg^ tract and give his son another, he should not be penalized as a ocmnBicial developer by paying the Peudc Ce- ioatlon Fee. Hake moved, Pesek seconded, that the Plan­ ning Oomnission reoonnend to the Council that the Prelimi­ nary Subdivision of Al Whitman be approved and that the ^pJParic Dedication Fee be paid but ask the Council to oon- ^^ider the waiving of tlie Park Dedication Fee for this sub­ division. Although both the proposed lots met the ndnitnun lot size requireroent, one would be too narrow to build upon and maintain the 75 ft. lakeehore setback. Dunlap moved, Redle- stad seconded, that the Planning Conmission reocmnend to the Council denial of the applicatim because one lot would be unbuildable e3Goept within 75 ft. of the shoreline. The Zoning Acbninistrator stated he had forwarded it to the Village Attom^ for his review and preliminary draft. Pesdc moved. Hake seconded, that the Planning Conmission stronc^y reoonmend that the Village Attorney finish his draft of the Multiple Dwelling Ordinance in tiro for distribution before the next Planning Conmission Action Meeting so that a vote may be taken.
