ROGER PATCH- PUBLIC HEARING- 1330 6th Ave. N. Brad Van Nest made a motion to postpone approving the minutes for two weeks, having just received the material, and not ha^/ing time to lead same. McDonald Seconded. Ayes (5), Nays (0). . liOMJTES % Henry fUhlch presented the proposal for a rip rap-condi­ tional use permit for Windward ^tarina. That Windward Marina has the approval of DNR and his plans ai'e to rip rap with rock, and plant shrubber/ along the shore­ line. After further discussion. WINDWARD MARINA- OOT. USE PRI^tlT RIP RAP SIK5RELTNE 1444 Shoreline Dr. Curtis moved, Hannah seconded, that the Plannir.g Commiss­ ion apjnrove this request, under the conditions he rip rap with rock as shown in the diagram, and that the rock be one foot or larger in diameter. Also, that he must create green­ ery in that particular area. Curtis moved, Hannah seconded, that this be stibject to approval of MCWS. Ayes (5), Nays (0). Brad Van Nest opened the Public Hearing <m Ralph Burnett at 7:26. Henry Mtihich read the affidavit of publication and certificate of mailing. RALPH BURNETT PUBLIC HEARING SCenr PROPERTY -•= Ralph Burnett and Tom Hartzell presented their proposal to the public. Mr. Burnett stated that they wanted to divide the property into seven buildable lots. Lots 1,2, 6 3 were found to be substandard as to the area requirements of the code, lots 4 § 5 over the required acreage and lots 6 § 7 have the required acreage. The remaining acreage being in lot A which has an area of KK),000 sq. ft. Upon retceiving notice of the public hearing, a groip re­ presenting p^erty owners along Bay Pidge Road objected to a suggestion of connecting the private road of the newly proiiosed plat v.lth Bay Ridge Rd, a private Road servicing these people. The)'' contended tnis; would result in a loss of rTrea and nvzneroiis tree to eecli property owner. Brad Van Nest opened the Pdblic Hearing at 7:46 on Good Shepherd Lutheran Churdi, conditional use pemit. Henry Mihidi read the affidavit of pid>lication and certificate of nailing. Pastor Rigr Johnson presented to the Planning Conmission and the pid>lic» the badcground of idiat they are trying to do. They have a preschool care, child care center, and an infant stinulation program. They wish to be given the opportunity to use the parsonage for expandiixg a program for retarded infants from biitl months. After further discussion by the public and staff, the main issues were found to be the traffic on the road, which is Church Road, and avoiding the possibility of more traffic on that street and policing required and provided. After reviewing the plat of the Scott Property, Brad Van Nest moved, Dunlap seconded to reooinnend to ^e Cowicil the ipproval of the proposed ^at, with the following conditions: 1. Agreement with Paxh Board on the paxh dedication fbe. 2. Transfer that portioi« of outlot 8 which supports his private driveway to Doug Head. Consideration of oonhining the private road wi^ Basrridge Rd. A SO* utility easemait following the roadway and a 100* easement at the end of the private road for a possible fbture cul-de-sac. No comnittment as to lalce use rights. 3. S. 6. If outlot A is not accepted by the Parle Board or Village it shall be included as a undivided 1/7 interest among the other 7 parcel owners of the plat. Ayes (S), Nqres (0). Mayor Searles presented the matter of the E5ainger Land Fill Series asked that there be a review on some of the elements of public action that have taken place in the past. Mayor Searles reconmended to the Planning Commission tliat 13^ go out to the site and view and study it before nmking 81^ decision. After fbrther discussion. EISINGER LAND FILL OWD. Iknlap moved, Hannah seconded, to recomnend to Council, appremd of the subdivisions and that there be a cash paifc dedication of 101 of raw land value. Henry Mbich presented the Howard Larson proposed on-site disposal plans, and stated that the proposed structure ^ location meets all tiie setback requirements, with this. Brad Van Nest moved, Diane Dunlap seconded, to reconroend to the Council, approval of this variance for lot size and lot widtii subject to the fbllowing conditions; that the septic system be constructed in accordance with the approval of the Village Engineer, as laid out hy Gene luacok $ Associates, and that no other variances be re- ouired. Ayes (S), Niys (0). He asked that the staff coummlcate by letter, lx were able ooncm to the meibers: also, the Plannins Commissi would like to see plans submitted as to the intended usage including useage of the private road to the parsonage.
